HomeMy WebLinkAboutHendry - Farmers Market Addendum 3-2-2015 � y ADDENDUM TO CAPE CANAVERAL FARMERS MARKET OUTDOOR ENTERTAINMENT EVENT AGREEMENT THIS ADDENDUM TO FARMERS MARKET AGREEMENT ("Addendum") is made by and between the CITY OF CAPE CANAVERAL, a Florida municipal corporation ("City"), whose address is 105 Polk Avenue, Cape Canaveral, Florida, 32920 ("City"), and RICHARD HENDRY, an individual,d/b/a BREVARD FARMERS MARKETS ("Contractor"). RECITALS: WHEREAS, the City and the Contractor have entered into that certain Contract for Services dated February 23,2012 ("Contract"); and WHEREAS, said Contract requires the Contractor to demonstrate a desire to extend the contract; and WHEREAS, pursuant to the authority set forth in Article 26 of the Agreement, the City and Contractor mutually desire to extend the term of the Agreement and to make other, minor modifications to the Agreement as set forth herein; and IN CONSIDERATION of the mutual covenants and provisions hereof, and other good, diverse and valuable considerations, the receipt and sufficiency all of which is hereby acknowledged, the parties desiring to be legally bound do hereby agree as follows: 1. Recitals. The foregoing recitals are hereby deemed true and correct and by this reference are incorporated herein as a material part of this Addendum. 2. Section 3.3 Vendor Booths: Site Plan. Shall be amended to read: The Farmers market shall be limited to a maximum of 24 vendor booths approximately ten feet by ten feet (10' x 10') in size, which shall be set up on the north side of City Hall according to the site plan attached hereto as Exhibit "A", fully incorporated herein by this reference. Contractor shall be responsible for providing any staging materials necessary to effectively produce the Farmers Market including, but not limited to tables, chairs, and tents. 3. Section 26.0 Term. Shall be amended to include: The term of the Agreement is hereby extended through February 23, 2016. 4. Other Terms and Conditions. Any terms and conditions of the Agreement not expressly modified by this Addendum shall remain in full force and effect.
