A RESOLUTION ESTABLISHING A BULKHEAD LINE
OFF-SHORE FROM EXISTING LANDS BORDERING ON
THE BANANA RIVER FROM THE SOUTHERN TO THE NORTHERN (,
MOST TERRITORIAL LIMITS OF THE CITY OF CAFE `(.
CANAVERAL, FLORIDA; PROVIDING AN EFFECTIVE DATE. ;;II _..
WHEREAS, the City Council of the City of Cape Canaveral,
Florida, did by Resolution on the 5th day of January, 1965, set a
Public Hearing to hear interested citizens in regard to the establishment
[1/ of a bulkhead line off-shore from existing lands bordering on the
Banana River from the southern to the northern most territorial limits
of the City of Cape Canaveral, Florida, and
WHEREAS, a bulkhead line has not heretofor seen
established by the City of Cape Canaveral, Florida, and
WHEREAS, the City Council of the City of Cape
Canaveral, Florida did convene at 7:30 P.M. on February 9, 1965, at
a designated public meeting room in Cape Canaveral, Florida, and it
was announced by the Mayor that the matter of the establishment and/or
extention of the bulkhead line was open for public hearing, and the
premises having been heard after due deliberation,
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF
THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA:
SECTION 1.
There is hereby established a bulkhead line in the
Banana River in the City of Cape Canaveral, Florida;
said new bulkhead line being described as follows:
From the Northeast Corner of Lot 3, Block 35 of
Cocoa Ocean Beach Subdivision as recorded in
Plat Book 10, Page 16, of the Public Records
of Brevard County, Florida, run N.81°54'O5"W.,
1791.38 feet; thence N.00°48'14"W., 400.33 feet
to an angle point in the existing bulkhead line
as recorded in Bulkhead Line Book 1, Page 15,
of the Public Records of Brevard County, Florida,
said point being the Point of Beginning of this
Bulkhead; thence N.22°05'52"W. , 14,961.87 feet
more or less to the intersection of the center-
lines of State Road 528 and State Road A-1-A,
relocation.
SECTION 2.
The action of the City Council of the City of Cape
Canaveral, Florida, in establishing the above described bulkhead line
is subject to the formal approval thereof by the Trustees of the
Internal Improvement Trust Fund of the State of Florida, and a certified
copy of this Ordinance shall be forwarded by the City Clerk to the

said Trustees of the Internal Improvei¢ent Trust Fund. The said
Trustees are hereby respectfully requested to consider and approve the
aforesaid bulkhead line.
SECTION 3.
If the above described bulkhead line is approved by
the Trustees of the Internal Improvement Trust Fund of the State of
Florida, a certified copy of this Ordinance, together with the approval
of the Trustees of the Internal Improvement Trust Fund and also a map
showing said bulkhead line as approved all shall be filed for record in
the office of the City Clerk in and for Cape Canaveral, Florida, and
also filed for record in the office of the Clerk of the Circuit Court,
in and for Brevard County, Florida
SECTION 4.
This ordinance shall become effective immediately upon
its passage.
Passed and Approved this 30th day of March, 1965.
