A RESOLUTION AUTHORIZING THE MAYOR AND THE CITY CLERK
TO ENTER INTO AN AGREEMENT WITH BREVARD COUNTY COMMIS-
.
SIGNERS TO VOID THE LEASE AGREEMENT ENTERED INTO ON
APRIL 27, 1967 WITH THE BREVARD COUNTY COMMISSIONERS;
PROVIDING AN SIVE DATE.
WHEREAS, the City of Cape Canaveral, Florida, entered into an
agreement with the Brevard County Commissioners for the lease of Lot 3,
Block 19, Chandler Park Subdivision of Lot 5, Section 14, Plat Book 3,
Page 20, and
WHEREAS, said agreement was executed by the Brevard County
51 Commissioners on April 27, 1967, and
WHEREAS, the Brevard County Commissioners are in the process
of developing Phase I of Cherie Down Park of which said lot is a part, and
WHEREAS, in order to eliminate problems in acquiring grants
and consolidate operational and developmental responsibilities, it is incum- :�'.

bent on the City of Cape Canaveral, Florida, to void said lease agreement,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
. of Cape Canaveral, Florida, as follows:
SECTION 1. The Mayor and the City Clerk of the City of Cape
Canaveral, Florida, are hereby authorized to enter into an agreement with
the Brevard County Commissioners voiding the agreement executed by the
County Commissioners on April 27, 1967 for the lease of the following'
described real property:
Lot Three (3) , Block Nineteen (19) , CHANDLER PARK i.
SUBDIVISION of Lot Five (5) , Section 14, as platted
in Plat Book 3, Page 20, public records of Brevard
County, Florida.
SECTION 2.. This Resolution shall be contingent upon the County
commencing construction within twelve (12) .months from the date of this
Resolution. -;
SECLLON 3. This Resolution shall take effect immediately upon

AGREEMENT
THIS AGREEMENT entered into this 20th day of may ,
1982 , by and between the Board of County Commissioners of Brevard
County, Florida, .a political subdivision of the State of Florida,
hereinafter referred to as "County, " and• the City of Cape Canaveral,
Florida, hereinafter referred to as "City. "
WHEREAS, the City and the County entered into a Lease Agree-
ment' dated April 27, 1967, whereby the County leased to the City
the following described real property: Lot 3, Block 19, Chandler
Park Subdivision of Lot 5, Section 14, as platted in Plat Book 3,
Page 20, Public Records of Brevard County, Florida, and
• WHEREAS, the Board of County Commissioners of Brevard County,
Florida, is in the process of developing Phase I of Cheri Down
Park, of which the above described property is a part, and
WHEREAS, in order to consolidate operation. _and development
. �` responsibilities for said park, the City of Cape Canaveral, Florida,
adopted •Resolution No. 82-29 , authorizing the Mayor and City Clerk
of the City to enter into this Agreement with the County to void
that certain Lease Agreement entered into by the parties on
April. 27, 1967,
NOW, THEREFORE, in consideration of the premises contained
herein, the parties hereto agree as follows:
1. That certain Lease Agreement entered into by and between
the County and the City on April 27, 1967,. in regard to Lot 3,
Block 19, Chandler Park Subdivision of Lot 5, Section 14 , as
platted in Plat Book 3, Page 20 , Public Records of Brevard County,
. Florida, is hereby terminated as of the date of execution of this.
Agreement.
2. The County hereby agrees to commence construction upon
Phase I of Cheri Down Park prior to May 4 , 1983.
