HomeMy WebLinkAboutResolution No. 1982-14 • • MICROFILMED 1.18.83 RESOLUTION NO. 82-14 A RESOLUTION REQUESTING THE BREVARD LEGISLATIVE DELEGATION TO CANCEL PROPOSED AMENDMENT TO SECTION 7 OF SPECIAL ACT CHAPTER 63-1143; APPOINTMENT RICHARD J. TILLMAN AS LIAISON AND CONSULTANT WITH NO COMPENSATION REGARDING "TICO" AIR. PORT AUTHORITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Tico study report by former Brevard.State Legislator, Richard Tillman, transmitted to the City by letter of January 29, 1982, which is attached to and forms part of this resolution, documents the fact that there were highly significant disparities between the levels of tax contributions by the two originating cities represented by their appointees [1/ in the TIC° Authority, and the levels contributed by the remaining three cities, including Cape Canaveral, which are not so represented, and WHEREAS, the aforesaid report documents the fact that the legislative finding, Special Act 63-1143 that: the property benefits within the District are equal to the taxes imposed, has become invalid, because of large magnitude changes in the relative levels of taxation between the two founding cities, Special Act 59-1933, and the other three cities in the District, and WHEREAS, inequality of, and lack of, direct representation in the Authority, are self evident in the basic Act, 63-1143: two cities are directly represented by their own total of two Authority appointees, while three cities are not. Also, four County Board appointees to .the Authority are independent of any political responsibility to any city or its citizens, and can always outvote the two city appointees, and WHEREAS, the "freeholder" requirement for Authority members may have been rendered invalid by Constitutional Law, NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Cape Canaveral, Florida, as follows: SECTION 1. That the Legislature is hereby petitioned to cancel` the proposed amendment to Section 7 of Special Act Chapter 63-1143 which would add an additional appointee .by the County Board, on the ground that it would only increase the "taxation without representation" inequities. SECTION 2. That the Legislature is hereby informed of a further reason for altering the proposed TICO Act: the probably unconstitutionality of the "freeholder" requirement. SECTION 3. Richard J. Tillman of Cocoa Beach, Florida is appointed as liaison representative and consultant to the City sof Cape Canaveral, Florida in connection with the matters set forth in this Resolution relating to TICO. Said consultant shall serve without compensation-. To the Legislative Delegation Honorable Members: • This is to inform you of a TICO study triggered by a request to me by Mr. James Venable, TICO Authority member. With his knowledge of my independent actions, I am also informing all three un-represented cities. My major effort is directed toward convincing the city most adversely affected by TICO taxes, Cocoa Beach, that action is urgently needed and .that the City could appropriately lead a newly conceived Special Act revision. effort. To the City Commission of Cocoa Beach • Honorable Members: While it is yet to be determined whether there is time to modify the present form of the proposed Special Act revision in this Legislative session, at least, the inadequate proposed change in the number and allocation of one more appointment to the County for Authority members, which has not changed since '933, could be deferred. • . • It was not until I had made the computations for Table 1, that I realized how far ' the District has strayed from the Legislative finding in 1963 that the property benefits within the District are equal to the taxes imposed. For instance; Table 1 shows that in 1977 the two TICO originating cities, (Group 1), - paid 27% of the TICO taxes, while the three cities not represented in the Authority,(Group 2) paid 25%. Four years later, in 1981, the situation was reversed: Group 1, 24%; Group 2, 30%. Cocoa Beach paid 14% of the TICO taxes in 1977 and 17% in 1981, ($112,000, highest - of any city. The four year tax increase for Group 1 was 19%; for Group 2: 55%. Within Group 1 the increases were 20 and 16%. Within Group 2: 42, 57, and 61%, with Cocoa Beach, at 61%, being the highest of any TICO unit. Cocoa Beach far outdistanced the field in 1981 per capita taxes, since the same per- centages apply as above (61%). The amount was $10.27. TAXATION WITHOiT.P REPRESENTATION is the major issue. Representation would not cure the disparities, but the Cities would be in a better position to study and justify some form of relief, such as enlarging the District to county wide. Table 1 shows that taxes would thus go down to 46% of their former level. • I have arranged to be available at the Feb. 2 Workshop to discuss this study and suggest succeeding actions.
