RESOLUTION NO. 81-8
A RESOLUTION SUPPORTING AN AGREEMENT FOR
MUTUAL AID IN FIRE PROTECTION BETWEEN THE
- CITY OF COCOA BEACH AND THE CAPE CANAVERAL
VOLUNTEER FIRE DEPARTMENT; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Cocoa Beach desires to enter into an
Agreement with the Cape Canaveral Volunteer Fire Department for
mutual aid in fire protection; and
WHEREAS, it appears to be in the best interests of the City of
Cape Canaveral , Florida to approve and support such an Agreement, in
that the City will benefit from such mutual fire protection;

NOW, THEREFORE , BE IT RESOLVED by the City Council of the City

of Cape Canaveral, Florida, as follows :

SECTION: 1. The City Council of the City of Cape Canaveral, Florida, °
does hereby support and approve the Agreement between the City of Cocoa
Beach and the Cape Canaveral Volunteer Fire Department for mutual aid
,— in fire protection, a copy of which is attached hereto and made a part
hereof by reference.
SECTION 2 . The City Council of the City of Cape Canaveral, Florida,
does hereby grant authority to the Mayor and the City Clerk to execute
said Agreement on behalf of the City of Cape Canaveral, Florida.
SECTION 3 . This Resolution shall become effective immediately
upon its adoption.

AGREEMENT FOR
MUTUAL AID
IN FIRE PROTECTIO\
This Agreement, entered into this 3 day of February , 1981 between the
City of Cocoa Beach Fire Department and City of Cape Canaveral FirQ Dept. for the purpose
of securing to each the benefits of mutual aid in fire_ prevention, in the protection of
life and property from fire and in firefighting.
It is agreed that:
1. Upon request to a representative of the City of Cocoa Teach rire Department by a
representative of the CAPE CANAVERAL FIRE DEPT. , firefighting equipment and personnel
of the City of Cocoa Beach Fire Department will be dispatched to any point within the.
area for which the CAPE CANAVERAL TIRE DEPT. normally provides fire protection as
designated by the representative of the CAPF CANAVFRAI FIRE DEPT. •
2. Upon request to a representative of thcCApp CANAyERAI FIRE DEPT. by a representa-
tive of the City of Cocoa Beach Fire Department, firefighting equipment and personnel
of the _CAPE CANAVERAL FIRE D it.'l be dispatched to any point within the firefighting
jurisdiction of the City of Cocoa reach Fire Department as designated by the representa-
tive of the City of Cocoa Beach Fire Department.
3. Any dispatch of equipment and personnel pursuant to thisbAgreement is subject to the
following conditions:
A. The requesting organization understands that in order for mutui.l aid assistance
to be rendered the Fire Department having jurisdiction must have at least one truck
on the scene which requires additional assistance or a condition exists where simul-
taneous emergencies have occured or may occur requiring the assistance of mutual aid.
B. The aughority having jurisdiction shall take charge of the operation and designate
the location of the responding equipment. This may be to stand by in their station
for additional emergencies or to assist in the initial emergency at the discretion
of the Fire Chief from which mutual aid has been requested.

C. The Fire Chief or designated officer in charge by the Fire Chief will dispatch
only that equipment and manpower which, in his judgement, will not jeopardize his
fire protection responsibilities within his own district.
D. Any request for aid hereunder shall include the amount and type of equipment
and number of personnel requested, but the.,amount and type of equipment and
number of personnel to be furnished shall be determined by a representative of
the responding organization, subject to the availability of manpower and equipment.
E. The responding organization shall report to the officer in charge of the re-
questing organization at the locations to which the equipment is dispatched and
shall be subject to the orders of that official. The firemen in the assisting
department will be supervised by their own officers who are, in turn, commanded
by the officers of the department .requesting mutual aid.
F. A responding organization shall be released by the requesting organization
when the services of the responding organization arc no longer required or when
the responding organization is needed within the area for which it normally pro-
vides fire protection.
G. In the even that equipment and manpower are not needed to actually assist in
fighting a fire, the request to stand-by shall be made clear, and manpower and
equipment shall stand-by in their own station. If the stand-by manpower and
equipment are called up, prior arrangements should be made to guide them to the
scene by escort.
4. Each party waives all claims against the other party or its insurance carrier for
compensation for any loss, or damage to its property or, personal injury, or death of
its personnel occuring as a consequence of the performance of this Agreement.
5. No party shall be reimbursed By any other party for any costs incurred pursuant

THE FOLLOWING POLICY PROCEDURES FOR MUTUAL AID AND OUT-OF-CITY
CALLS REFLECTS A MORE DETAILED AND CONCISE CLARIFICATION OF DEPARTMENT
POLICY. IT IS INTENDED TO MAKE STANDING ORDERS FOR THESE RESPONSES
BETTER UNDERSTOOD.
NOTE: MUTUAL AID AND OUT-OF-CITY RESPONSE PROCEDURES HAVE NOT CHANGED. . . .
THEY ARE SIMPLY RESTATED IN AMORE CLEAR AND DETAILED MANNER.
FIRE CALLS
NORTH, SOUTH AND WEST UNINCORPORATED AREAS
RESPONSE WILL BE ORDERED UNDER THE FOLLOWING CIRCUMSTANCES:
1. DISTRICT TWO FIRE CONTROL (MIVFD) IS ON THE SCENE AND REQUESTS
ASSISTANCE.
2. DISTRICT TWO FIRE CONTROL (MIVFD) IS COMMITTED ON ANOTHER FIRE CALL
OR HAS AN ACCIDENT OR BREAKDOWN IN ROUTE AND IS UNABLE TO RESPOND
(REQUESTING ASSISTANCE).
3. IT IS CONFIRMED BY INITIAL REPORTS THAT A PERSON OR PERSONS ARE TRAPPED
BY FIRE AND LOSS OF LIFE IS IMMINENT.
NOTE: IN THE CASE OF THE NORTH UNINCORPORATED AREA THAT IS NOW PROTECTED
BY THE CAPE CANAVERAL VOLUNTEER FIRE DEPARTMENT, THE SAME POLICY PREVAILS
IN THE EVENT THEY CALL FOR ASSISTANCE.
CITY OF CAPE CANAVERAL AND PATRICK AIR FORCE BASE
RESPONSE WILL BE ORDERED UNDER THE FOLLOWING CIRCUMSTANCES:
1. THE AGENCY IN CHARGE REQUESTS OUR ASSISTANCE.
NOTE: INITIAL RESPONSE SHALL BE LIMITED TO ONE ON DUTY ENGINE
COMPANY AND ANY ADDITIONAL OFF DUTY PERSONNEL WILLING
AND AVAILABLE TO RESPOND.
RESCUE AND EMERGENCY MEDICAL CARE CALLS
NORTH, SOUTH AND WEST UNINCORPORATED AREAS
RESPONSE WILL BE ORDERED UNDER THE FOLLOWING CIRCUMSTANCES:
1. A COCOA BEACH POLICE OFFICER REQUESTS ASSISTANCE.
2. BREVARD COUNTY AMBULANCE SERVICE REQUESTS ASSISTANCE (ORIS UNABLE TO
RESPOND DUE TO OTHER COMMITMENTS, BREAKDOWN OR ACCIDENT). NOTE: THIS INCLUDES
REQUESTS FROM BREVARD COUNTY CIVIL DEFENSE HEADQUARTERS.
3. THE AREA THE CALL COMES IN FROM IS NOT CLEARLY DEFINABLE AS BEING IN OR OUT
OF THE CITY LIMITS OF COCOA BEACH. NOTE: RESPOND IF YOU ARE UNSURE, ASK QUESTIONS
LATER.
CITY OF CAPE CANAVERAL AND PATRICK AIR FORCE BASE
RESPONSE WILL BE ORDERED UNDER THE FOLLOWING CIRCUMSTANCES:
1. THE AGENCY IN CHARGE REQUESTS OUR ASSISTANCE.

SHIFT OFFICER INSTRUCTIONS
A. NO CALLS WILL BE RUN FIRST RESPONSE INTO THE UNINCORPORATED'AREAS.
CAPE CANAVERAL OR PATRICK AIR FORCE BASE. MUTUAL AID, BY REQUEST
WILL BE PROVIDED ACCORDING TO THE ABOVE PROCEDURES.
B. IF A BONA FIED EMERGENCY AGENCY REQUESTS ASSISTANCE FOR MUTUAL AID, IT
SHALL BE PROVIDED. AUTHORIZED AGENCIES SHALL INCLUDE BUT NOT BE RESTRICTED

BREVARD COUNTY CIVIL DEFENSE
BREVARD COUNTY AMBULANCE SERVICE ,
BREVARD COUNTY SHERIFFS DEPARTMENT

C. IF THERE ARE ANY QUESTIONS OR DOUBT ABOUT WHETHER TO RESPOND IN A LIFE
THREATENING SITUATION ACCORDING TO THE ABOVE PROCEDURES, GO AHEAD AND RESPOND!
D. ON ALL MUTUAL AID AND OUT-OF-CITY CALLS, NOTIFY THE FIRE CHIEF IMMEDIATELY
AFTER THE FIRST CALL COMES IN. IF YOU ARE UNABLE TO DO THIS. HAVE THE DISPATCHER
DO IT. IN THE ABSENCE OF THE FIRE CHIEF, NOTIFY THE DEPUTY FIRE CHIEF.
E. THE SHIFT OFFICER HAS THE AUTHORITY TO MAKE THE DECISION TO RESPOND OR NOT,
BASED ON THE INFORMATION AVAILABLE TO HIM WHEN THE CALL COMES IN.
