MICROFILMED 1-18-.83 a ., ;P- A2 RESOLUTION NO. 80-24 ' A RESOLUTION AUTHORIZING THE CITY OF CAPE �\ % CANAVERAL, FLORIDA TO ENTER INTO AN AGREE- MENT WITH CEVESCO, INC. FOR THE PURCHASE OF REAL PROPERTY LOCATED IN CAPE CANAVERAL, FLORIDA; PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED by the City Council of the City of Cape Canaveral, Florida, as follows: . SECTION 1. The City Council hereby authorizes the Mayor and the [I/ City Clerk of the City of Cape Canaveral, Florida to enter into an agree- ment with CEVESCO, INC. for the purchase of the real property located immediately north and east of the Sewer Plant, a copy of said agreement being attached hereto and made a part hereof' by reference. SECTION 2. This Resolution shall become effective immediately upon its adoption. ADOPTED by the City Council of the City of Cape Canaveral, _ Florida this 5th day of August, 1980. (hereinafter referred to as the Seller) , WHEREAS, THE CITY OF CAPE CANAVERAL, FLORIDA is desirous -of expanding their' sewer plant site; and - WHEREAS, CEVESCO, INC. is the owner of real property located directly adjacent to' the sewer plant site. . NOW, THEREFORE, -in consideration of the mutual covenants herein, the parties hereto agree as follows: 1. The Buyer agrees to purchase from the Seller the real property located immediately- to---the north and east of. the sewer plant--site, more • particularly described by the- Surveyor'sap Offa. portion -of: Section 15; Township, 24 South, Range 37 East of Brevard County, -Florida. said map being attached hereto and made a part hereof by reference, for a purchase price of Thirty Thousand ,($30,000.00) Dollars to be paid as . follows: • • ' a. Twenty Thousand ($20,000.00) Dollars to be paid at the time of the signing of the contract for sale and purchase. - b. The remaining Ten ,Thousand ($10,000.00) Dollars to be paid after the installation of the water line. c. The cost incurred by the Buyer for the installation of the water line shall be deducted from the Ten Thousand ($10,000'.-00) Dollars . . - at the time' of the fin41=payment':- - - - 2. All parties hereto agree to sign any and all documents ne cessary to effectuate the terms of this Agreement. 3. Upon receipt of the final payment, the Seller agrees to release all right, title and interest to said real property and shall record a Warranty Deed, evidencing same. 4. In the event of a breach of any of the terms and conditions of this Agreement by either party, the defaulting party shall reimburse the other party -for all collection expenses, including attorney's fees and • • • .
