HomeMy WebLinkAboutResolution No. 1979-53 MICROFILMED 4-11-80 RESOLUTION NO. 79-53 A RESOLUTION AUTHORIZING THE CITYATTORNEYTO INITIATE FORECLOSURE PROCEEDINGS AGAINST THOSE WHO HAVE NOT PAID THEIR PAVING ASSESSMENT LIENS, AS REQUIRED PURSUANT TO RESOLUTION NO. 68-1 AND CHAPTER 170,FLORIDA STATUTES; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of Cape Canaveral, Florida, has adopted Resolution No. 68-1, regarding a special assessment for paving and street improvements to those property owners specially benefiting therefrom, and WHEREAS, this special assessmenthas become a lien on the pro- perties sobenefited, and WHEREAS, certain of the property owners have failed to pay the assessments when due, and WHEREAS, the Chapter 170,Florida Statutes, adopted by Resolution No. 68-1, makes it mandatory for the City to foreclose the paving assessment liens when unpaid; NOW THEREFORE, be it resolved by the City'-Council of the City of Cape Canaveral, Florida, as follows: SECTION 1. The City Attorney is hereby authorized to initiate fore- closure proceedings of the paving assessment liens against those property owners in the City of Cape Canaveral, Florida, who have failed to pay the assessments when due and who are now delinquent, as determined by the City Treasurer. The City Attorney is authorized to begin,;these proceedings in accordance with Chapter170,Florida Statutes, immediately, against those property owners declared delinquent by the City Clerk. SECTION 2. This Resolution shall become effective immediately upon its adoption.by the:City. Council of the City of Cape Canaveral, Florida.
