HomeMy WebLinkAboutResolution No. 1979-42 MICROFILMED 4-11-80 �, _ PEA : B � ��-Sg RESOLUTION NO. 79-42 A RESOLUTION DETERMINING TO MAKE CERTAIN LOCAL STREET IMPROVEMENTS IN THE HARBOR HEIGHTS RE- SURFACING PROJECT IN THE CITY OF CAPE CANAVERAL, FLORIDA, ADOPTING THE ASSESSMENT PLAT AND PLANS AND SPECIFICATIONS SUBMITTED BY THE CONSULTING ENGINEERS; DETERMINING TO DEFRAY THE EXPENSE THEREOF BY SPECIAL ASSESSMENTS AGAINST THE PROPERTIES BENEFITED THEREBY; AND DIRECTING THE ENGINEERS TO MAKE AND FILE WITH CITY COUNCIL AN ASSESSMENT ROLL COVERING SUCH LOCAL STREET IMPROVEMENTS; PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED by the City Council of the City of Cape Canaveral, Florida, as follows: SECTION 1. The assessment plat, plans and specifications for certain local street improvements, including the repair, grading, paving, guttering, hard surfacing and driveways in the "Harbor Heights Resurfacing Project" in the City of Cape Canaveral, Florida, prepared by the Consulting Engineers and presently on file with the City Clerk, are hereby adopted and approved. The location of suchlocal street improvements (herein called "project" ) is hereby described as follows: A resurfacing with asphaltic concrete pavement, including base and all excavation and stabliization extending along the following named streets, and including all intersections: Harbor Drive - from east intersection of 401 which terminates on the east approximately 24 feet of Lot 103. Coral Drive - from the intersection of Sea Shell Lane to the terminus at Harbor Drive. Coquina Lane - from the intersection of Harbor Drive south approximately 100 feet and the intersection of Coral Drive north approximately 100 feet. Sea Shell Lane in its entirety. SECTION 2. It is hereby determined to construct such project and to defray the cost thereof by special assessments to be levied against the properties benefited. The nature of the proposed public improvements is the construction of certain street improvements in the City, including the repair, grading, paving, guttering, hard surfacing, and driveways. Such assessments shall be paid in not exceeding five (5 ) equal yearly MICROFILMED 4-11-80 installments, with interest at the rate of not exceeding eight (8)- percent per annum on the unpaid balances from the date of acceptance by the City Council of such project, to which, if not paid when due, there shall be added a penalty of one per cent (1%) per month until paid; provided that such assessments may be paid without interest at any time within thirty (30) days after the project is completed and a resolution accepting the same has been adopted by the City Council. Such special assessments shall be levied on a front foot basis against all lots and lands adjoining and contiguous, or bounding and abutting upon such improvements or specifically benefited thereby and further designated by the assessment plat. The assessments shall be levied against such properties in direct proportion to the benefits received from the construction of the project. The total estimated cost of suchimprovements: is $43, 900.00. The City shall pay from its general contingency fund the sum of $ 16,000.00, SECTION 3. The assessments as finally determined and adjusted shall be payable at the office of the City `Treaurer. The' first installment of such assessment, together with interest upon the whole assessment, shall be due and payable in cashon the first day of the month which is one (1) year from the date of acceptance of the project by the City Council, and a like payment, together withinterest upon the unpaid balance of the assess- ment, shall be due and payable on the same date in each and every year thereafter until paid in full; provided, however, that such assessments may be paid infull without interest at any time within thirty (30) days after the adoptionof a resolution accepting the completed project; and that unpaid balances of assessments may be paid at any time by payment of the principal and interest thereon to the next quarter annual date. SECTION 4. The Consulting Engineers are hereby directed to make promptly and file with the City Council an assessment roll, on the front foot basis, showing the lots and lands assessed, the amount of the assess- ment against each lot or parcel of land, which assessments, if not paid in RESOLUTION NO. 79-42 PAGE 2 OF 3 MICROFILMED 4-11-80 cash, shall be divided into not exceeding five (5) equal annual installments. SECTION 5. . The City Clerk is hereby directed to cause this Resolution to be publishedonce a week for a periodof two weeks in a newspaper of general circulation published in Brevard County, Florida.
