RESOLUTION NO. 78-48
A RESOLUTION AMENDING RESOLUTION NO. 78-13, GRANTING
AN EXTENSION OF TIME TO THE OWNER OF LOTS 5, 11 AND
12, BLOCK 55, AVON-BY-THE-SEA, TO COMMENCE
CONSTRUCTION ON SAID PROPERTY, WHICH RESOLUTION
ABANDONED, CLOSED AND VACATED A DEDICATED ALLEYWAY
ABUTTING ON SAID LOTS; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Cape Canaveral, Florida,
by resolution No. 78-13 abandoned, closed and vacated a dedicated alleyway
which abutted on Lots 5, 11 and 12, Block 55, Avon-By-The-Sea in the City
of Cape Canaveral, Florida; and
WHEREAS, said resolution provided that said abandonment was
contingent upon the owner commencing construction on the described
property on or before October 4, 1978; and
WHEREAS, for good cause shown the owner of said property has
requested an extension of time to commence construction on said property;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Cape Canaveral, Florida, as follows:
SECTION 1. The owner of Lots 5, 11 and 12, Block 55, Avon-By-The-
Sea, as recorded in Plat Book 3, Page 7, Public Records of Brevard County,
Florida, is hereby granted an extension of time until April 4, ' ,
1979' in which to commence construction on property described herein. In
the event said construction is not begun by this date, the abandonment of
. an alleyway abutting the described property as provided for in resolution
No. 78-13 of the City of Cape Canaveral, Florida, will be rescinded
and it will retain its original status as a dedicated alleyway. The other
provisions of resolution No. 78-13 shall remain in full force and effect.
SECTION 2. This resolution shall become effective immediately
upon its adoption.
