HomeMy WebLinkAboutResolution No. 1978-39 MICROFILMED 4-11-80 RESOLUTION NO. 78-39 A RESOLUTION APPROVING SIXTH RENEWAL OF THE FIRE PROTECTION AGREEMENT BETWEEN CITY OF CAPE CANAVERAL AND CANAVERAL PORT AUTHORITY; PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED by the City Council of the City of Cape Canaveral, Florida, as follows: SECTION 1. The City of Cape Canaveral, Florida, hereby approve6 the Sixth renewal of the Fire Protection Agreement between the City of [1/ Cape Canaveral, Florida, the Canaveral Port Authority and the Cape Canaveral Volunteer Fire Department. A copy of said sixthrenewal is attached hereto and made part hereof. SECTION 2. The Mayor and Clerk of the City of Cape Canaveral are hereby authorized to execute said Sixth Renewal Agreement on behalf of the City. SECTION 3. This Resolution shall become effective immediately upon its adoption. ADOPTED by the City Council of the City of Cape Canaveral, Florida, this 5 day of -September , 1978. ,At k*W'l htletteN ' 94`9, yor •;.41%) teal P- • • • -----.... =1111 YES NO . -City.141615 'J - tAiNt1/41,9"N BOYD Mill LEE 111111 MURPHY fill1111 • • S tO FOnn: MEMO 11110r kf. / is Attorney r'% r MICROFILMED 4-11-80 SIXTH RENEWAL OF FIRE PROTECTION AGREEMENT FOR GOOD AND VALUABLE CONSIDERATION given and received respectively, by the parties hereto, the undersigned, the CANAVERAL PORT AUTHORITY, a body politic and a body corporate under the laws of the State of Florida, the undersigned CITY OF CAPE CANAVERAL, a municipal corporation under the laws of the State of Florida, and the undersigned CAPE CANAVERAL VOLUNTEER FIRE DEPARTMENT, a non-profit — corporation, hereby covenant and agree that the. fire protection agree- ment executed by them an November 18, 1970, November 4, 1970 and November 9, 1970, respectively, and as amended by the third renewal of said fire protection agreement dated November 26, 1975, should be and is hereby extended for an additional one year period, commencing October 1, 1978 and ending on the 30th day of September,-1979, accord- ing to the same terms and conditions set forth in said fire protection j agreement; 1. except that the annual payment therefor shall be the sun of $6,000.00 as set forth in the Third Renewal of said agreement, pay- able by the CANAVERAL, PORT AUTHORITY to the CITY OF CAPE CANAVERAL, on or before November 1, 1978 , with the same geographic area covered under said fire protection agreement to be as set forth in the Second Renewal of said agreement, 2. In addition to the equipment set forth in Section 5 of original agreement, dated, November 18, 1970, one large pump truck is added.
