RESOLUTION NO. 78-23
A RESOLUTION AUTHORIZING THE CITY OF CAPE CANAVERAL,
FLORIDA, TO ENTER INTO A FIRST ADDENDUM TO THE
AGREEMENT WITH FLECKINGER REFUSE, INC., FOR THE
COLLECTION OF GARBAGE AND TRASH; PROVIDING AN
EFFECTIVE DATE.
BE IT RESOLVED by the City Council of the City of Cape Canaveral,

Florida, as follows:
SECTION 1. The Mayor and City Clerk are hereby authorized to
,[1 execute a First Addendum to the Agreement between the City and
Fleckinger Refuse, Inc. , entitled "Garbage And Rubbish Collection
Agreement", a copy of which First Addendum is attached hereto and
made part hereof.
SECTION 2. This resolution shall become effective immediately
upon its adoption by the City Council of the City of Cape Canaveral,
Florida.
ADOPTED by the City Council of the City of Cape Canaveral,

FIRST ADDENDUM TO GARBAGE AND
RUBBISH COT T:FCTION AGREEMENT
WHEREAS, the CITY OF CAPE CANAVERAL, a municipal corporation,
hereinafter referred to as "City", and FLECKINGER REFUSE, INC.,
hereinafter referred to as "Collector", have entered into a Garbage
and Rubbish Collection Agreement, dated April 21, 1978, hereinafter
referred to as "Agreement"; and
\ill ' WHEREAS, certain provisions of the Agreement require modification;
NOW, THEREFORE, in consideration of the exchange of certain
mutual promises and covenants herein contained and contained in the
Agreement, the parties agree that said Agreement be amended as follows:
1. Section 16(a) (4) of the Agreement, entitled "Charges and
Rates", shall be amended by substituting therefor the following:
"(4) Individual commercial business accounts with trash cans
at $4.50 per month."
2. Section 20 of the Agreement, entitled "Certification of
City Refuse Accounts" shall be amended by the deletion of the second
—" sentence thereof, which reads as follows:
"The Collector agrees that the City may, in the discretion of
the City Manager, delete those dwellings or commercial units
which are vacant or unoccupied, from the billing for each
month."
Section 20, as amended, shall read as follows:
"20. Certification of City Refuse Accounts
The City of Cape Canaveral shall certify to the
Collector on the last Friday of each calendar month
the number and size of all individual and industrial
containers in service in the City."
IN WITNESS WHEREOF, the parties hereto have caused this
