A Meeting of the Planning & Zoning Board was held on Wednesday, February 26, 2014, at the
City Public Library, 201 Polk Avenue, Cape Canaveral, Florida. The meeting was called to
Order at 6:00 p.m. by Chairperson, John Price. The Secretary called the roll.

Mr. Price brought up to the board and all attendees, the importance of speaking clearly and into
the microphones, Everything said is recorded and very important that the recording of the
meeting be recorded clearly.
NEW BUSINESS
1. Approval of Planning & Zoning Board Meeting Minutes — January 8, 2014.
Moved to approve the minutes from the November 13, 2013 meeting.
2. Quasi -Judicial and/or Public Hearing: Consideration and Recommendation to
Board of Adjustment Re: Special Exception Request No. 14-01 to Allow
Assembly; Outside Display of Merchandise; and Sales of Electric Vehicles,
Scooters, Bicycles, and Low Speed Vehicles in the C-2 Zoning District, per City
Code of Ordinances, Section 110-383 (c) (6), Special Exceptions permissible by
the Board of Adjustment - (7077 N. Atlantic Avenue) - Stanley "Ed" Schofield,
Designated Agent.
Todd Morley introduced the new Director of Planning & Zoning, David Dickey and made the
board aware that he was going to present the information in tonight's meeting.
Mr. Dickey presented 2 aerials of the property. He quoted the staff report and explained the
proposed uses of the property. He explained that the current code did not contemplate electric
vehicles. He stated that the code is sparse and quoted the code as what is allowed, the specific

statute that regulates the operation of electric vehicles. They can operate on roads that are
posted 35 miles an hour.
There is a section in the code that does address automotive, sales & service operations. All
outside display areas will need to be paved. All repair activity should be in an enclosed
structure. Staff is requesting that the board impose an additional condition which will prohibit a
vehicle rental facility. A buffer will also be required along A1A. Mr. Dickey referenced the slide
as to a very substantial vegetative area along A1A. He suggested the current landscape
materials can be credited toward the requirements.
Staff covered the potential impacts to surrounding properties and on public services and
recommended the special exception be approved.
The board verified that Mr. Dickey was recommending approval of the Special Exception with
conditions and Mr. Dickey concurred.
The board asked to see if the applicant, Mr. Schofield, had anything further to discuss. Mr.
Schofield spoke about the product and how popular it is with their customers. He stated that the
vehicles are DOT compliant and a low speed vehicle.
The board asked about assembling the vehicles. Mr. Schofield explained they have to assemble
the windshield and roof on the vehicle after it arrives. This is done under roof with air
conditioning.
Chairman Mr. Price motioned to recommend approval with conditions stated by Mr. Dickey. The
motion was seconded.
Vote on the motion carried unanimously, all FOR.
OPEN DISCUSSION:

There being no further business the meeting adjourned at 6:49 p.m.

Subject: Request for Site Plan Approval for proposed Homewood Suites hotel located
at 9000 Astronaut Boulevard.

Summary: This request is for Site Plan Approval for a 6 -story, extended stay hotel
located at 9000 Astronaut Boulevard. The proposed building is located on a 3.54 acre
parcel, consists of 112,000 square feet, and includes 153 units. The project represents
a $17 million investment in the community.
As required by Section 110-221(1) of the City Code, any new commercial building must
submit an application for Site Plan Approval and be approved prior to its construction.
Section 110-223 establishes the process that must be followed. In general, the
application is first reviewed by the various City review departments to determine its
consistency with applicable rules and regulations. The application is then considered by
the Planning and Zoning Board and a written recommendation is forwarded to the
Planning and Zoning Director for a final decision.
Section 110-222 of the City Code establishes criteria that must be addressed by the
Site Plan Application package. Attached is a Site Plan Checklist that inventories the
submittal's consistency with these criteria.
Required parking is 166 spaces, while the actual number of spaces being provided is
215. Utilities are being provided by the City of Cocoa (water) and the City of Cape
Canaveral (wastewater). Stormwater will be retained onsite via an underground vault
system located on the east end of the property. A deceleration lane into the project
entrance on A1A will be constructed by the developer per FDOT requirements.
Applicable permits will be required prior to any development activity.
As required by Section 110-606, the Community Appearance Board, on May 21, 2014,
found that the proposed hotel is consistent with the design and site plan guidelines
contained in the A1A Economic Opportunity Overlay District. In addition, the
Community Appearance Board approved an increase in height of the structure to 65
feet. Attached is a letter from Andre Anderson, the consultant that drafted the A1A
Overlay district. In his letter, Mr. Anderson certifies that the project is consistent with
applicable rules and regulations of the Overlay district and he recommends approval of
the project.
Upon Site Plan Approval, the next step will be to submit an application for a Site
Development Permit, then a Building Permit.

In reviewing the Sunbelt Hotel's June 2, 2014 responses to our P&Z review of May 31, 2014, we note the
following:
Civil Entyineeriniz Consultant Review
The recommended review comments have been acknowledged with proper plan corrections as requested
by the City Engineer, with one major exception.
The exception involved engineering comment number 7 which centered around the drainage outfall
system. Based on a telephone discussion with Sunbelt's site engineer (Noel Droor, PE) on June 3, 2014,
a design addition to the outfall system is in progress. This addition will provide a second 18" outfall
culvert from the retention system to SR A 1 A. Work on this design is currently underway and should be
presented to the City in the near future.
Based on this review and the above additional design being submitted (and approved by City staff), we
would recommend approval of the Sunbelt Hotel.

Planning Design Group (PDG) is currently under contract with the City of Cape Canaveral to provide
continuing professional planning services. This letter will serve to provide documentation and
recommendation of our review of the proposed subject development.
The request before the Cape Canaveral Community Appearance Board is to consider Approval of the
proposed Sunbelt Cape Canaveral Hotel pursuant to the requirements of Chapter 22, Article III,
Sections 22-36 thru 22-47 and Chapter 110, Article X of the Cape Canaveral Code.
The subject property is comprised of approximately 3.54 acres with parcel id## 24-37-15-00-26, which is
located at 9000 Astronaut Boulevard, Cape Canaveral, Florida 32920.
The request is to develop the property with a six story 153 -room hotel with associated parking,
required retention pond, and other on-site amenities in the C-2 zoning district. The subject property is
located within the A1A Economic Opportunity Overlay District and is subject to the provisions of
Chapter 110, Article X of the Cape Canaveral Code.
have reviewed the site plan and color rendered elevations for consistency with Chapter 110, Article X
of the Cape Canaveral Code. Please note, only the mandatory requirements of the code section were
reviewed in order to make a consistency determination. Optional components were considered, but
their omission in the site plan were not used as a basis for consistency determination.
Based on my technical expertise and qualifications as a Certified Planner, my 26 years of professional
planning experience, and my familiarity with Chapter 110, Article X as the author of that portion of the
Code, it is my qualified professional opinion that the proposed development is CONSISTENT with the
intent of the Al Economic Opportunity Overlay District pursuant to Chapter 110, Article X of the Cape
Canaveral Code. Therefore I recommend that the Community Appearance Board APPROVE the
proposed Sunbelt Cape Canaveral Hotel.

Public Works Services (PWS) has reviewed the Sunbelt Hotel Site Plan #2 submittal. All
previous PWS comments have been addressed; however, PWS has the following
comment:
The proposed stormwater system for the site is rather "unique" for this area and
still seems problematic when compared to more "typical" stormwater system
designs. However, it is our understanding that the project engineer is currently
designing changes to the stormwater system and will present the changes to the
City in the near future.
NOTE: Further review of the project will be conducted during the permitting process and
construction for compliance of all local and state codes. The Engineer -of -Record is
responsible for any requirements not identified by the City.

Dave talks about height of buildings and the process was addressed on may 21s' at CAB
meeting.

Ron asks about page 2 near bottom what is 10 inches and dave says it's a typo and should
probably be 10 ft.
Lamar asked for mark to come up and asks for what the difference is between sunbelt dev and

Dave came back and back to site plan check list. Lamar asked about the 10 inches/10 feet
again. Dave explained he already said it was a typo. Lamar asked for why 10 ft. dave explains
and verifies with mr pekar.
Dave reads some highlighted areas of mr pekars review of the project. (listen to tape)
John price asks john pekar to come up and he explains about stormwater and it has a broad
range of criteria. DOT and county reviews. The project has a dry detention system. He explains
the water goes to a detention basin. Some of the basin is open and some are covered. The
basin bottom is at elevation 4. The water quality is looked at. In the last few days there is now
going to be an underdrain beneath the basin. (listen to tape for rest) the system will meet all
criteria for DOT, county and st johns. Everything will be controlled and john recommends this is
the way to go. In conformance as to what st johns wants also.
Lamar asks about underground chambers. Lamar asks for pictures. Nole has a small picture to
show the board. John keeps explaining how supportive these are. Chamber conversation
ensues and mr pekar explains further. Lamar says the pics are in the site plans and he's never
seen an underground chamber. Mr. pekar explains there is a lot more out there now that a lot of
people haven't seen yet. He explains about the same thing is under at the new fire station.

Lamar; he asks about the drainage going down to the retention pond. He asks that these
chambers handle what the retention pond can't handle. John explains they are part of the
retention pond. Pekar explains more about what the process is (tape)

Lamar; still don't understand how they exchange water but he will get with pekar offline to
understand this.

This is the first hotel project completely under the code

Lamar; reason he's asking is because he's gotten calls and why 65 now. He's asking for
explanation at meeting due to this. Andre explains the code. And the setback for hotel is far
enough away from ala. it is consistent with code requirement at being 65 ft.
Harry; bldg height, over years consdiered 65 ft and he's always voted against. Harry asked for
picture of hotel again. He stated the top story is the same as the
