This may help demonstrate the relationship between our building
department and Bob Baugher. Please notice dates. Bob Baugher and Todd
Morley have been setting the ground work for a while without any warning
or input from our neighborhood. The fundamental issue is that the
building department (and by default) the city is serving Bob Baugher’s
interests above the voting residents of this city.
Bob Baugher is trying to get under the EOOD so that his riverfront
property has option of going commercial. Cape Shores will not want
restaurant or hotel next to them on the river. I can say that the Porter
would feel the same way. Again, this appears to be very back room.

to make sure there is nothing in the codes that would disallow this.
This would be done no matter how we developed the land, single family,
condo, or commercial.”
Also, Bob Baugher in his own writing “Our plan is to use Holman Road as
our legal access and do a common entrance with Golf and Gator”
My opinion on this is that Bob Baugher gave up his access to Holman
when he sold land to Dollar Store. That is where we had access to Holman
Rd. when we owned it and same with Bob when he bought the property from
Bank. This access no longer exists and he is planning to use EOOD as
cover for a nonconforming and no longer existent access to Holman. This
is a concern to me and many others as this will not only route all his
traffic right up against our property, but will increase traffic for
Holman Rd for uses they do not approve of – gas station, dollar store,
hotel or restaurant traffic etc.

Todd: I would like a letter that this is a buildable lot, with legal
access off Holman Road, understanding that we have two other access
points (Cape Shores) that we know the city that does what to get into
that fight (just help settle it amicably between both parties) but
historically you are aware that we had access, and the new access point
through the Cumberland Farm piece we are selling. Need something in
the letter that the city will enter into a DA with us for signage on A1A
for the Riverfront piece we are retaining. Sooner rather than later.
Don not want to sell to Cumberland Farms and find out that this is not a
buildable lot or cannot get signage per our discussion. Bob

Bob,
We are proposing that this property be included in the southern
expansion of the Economic Opportunity Overlay District (EOOD). As
proposed, the overlay would trump all conflicting local land use
regulations/limitations.
This is all consistent with the existing overlay as well as the
Visioning.
The P&Z will get the first bite at the expansion of the EOOD next
Wednesday night. If successful, we could have an expanded overlay by
the September 16th Council meeting.
Do you need a DA on the 3.66 acres within 90 days? Or just a letter
from us during the 90 day inspection period?

Attached is the legal description and sketch of the remaining land
after we complete the sale to Cumberland Farm.
This sketch does not include the easement that we are retaining across
Cumberland Farm to A1A that I discuss in today's earlier email. Nor the
Cape Shores prescriptive easement.
Our plan is to use Holman Road as our legal access and do a common
entrance with Golf and Gator. This would consolidate driveways, push
them to the west away from A1A, we would refigure some of Golf and
Gators parking lot (enlarge it). Golf and Gator would also have a build
able pad where their old entrance was to expand family entertainment.
The triplex would be demolish. The triplex might be used for other
purpose while we work on the plans and permits.
Of course all this would have to go before the CC boards, but I want to
make sure there is nothing in the codes that would disallow this. This
would be done no matter how we developed the land, single family, condo,
or commercial.
