Yes, there is a draft ordinance. City staff will present substantial, competent evidence in support of the proposed ordinance. Very similar to what was presented when the City Council adopted the initial overlay document. If you are referring to a special exception application related to the proposed Cumberland Farms, yes one has been submitted. The development team, represented by Phil Knorr with Grey/Robinson, is sponsoring a public meeting to introduce the project to interested parties as well as answer questions there may be regarding the proposed project. The meeting is to be held at the Cape Canaveral Public Library (see attached notice). The EOOD expansion has tentatively been scheduled for the January Planning & Zoning Board meeting. Once a recommendation is received from the P&Z Board, it will be scheduled for the City Council. Regarding Cumberland Farms, there is a public meeting on December 2nd for the applicant to discuss the pending Special Exception request. Grey/Robinson, who is representing the applicant, will be conducting the meeting. There are currently no scheduled City hearings related to this project. Let me know if you have further questions. As proposed, the overlay would trump all conflicting local land use regulations/limitations. This is all consistent with the existing overlay as well as the Visioning. The P&Z will get the first bite at the expansion of the EOOD next Wednesday night. If successful, we could have an expanded overlay by the September 16th Council meeting. Do you need a DA on the 3.66 acres within 90 days? Or just a letter from us during the 90 day inspection period? This sketch does not include the easement that we are retaining across Cumberland Farm to A1A that I discuss in today's earlier email. Nor the Cape Shores prescriptive easement. Our plan is to use Holman Road as our legal access and do a common entrance with Golf and Gator. This would consolidate driveways, push them to the west away from A1A, we would refigure some of Golf and Gators parking lot (enlarge it). Golf and Gator would also have a build able pad where their old entrance was to expand family entertainment. The triplex would be demolish. The triplex might be used for other purpose while we work on the plans and permits. Of course all this would have to go before the CC boards, but I want to make sure there is nothing in the codes that would disallow this. This would be done no matter how we developed the land, single family, condo, or commercial. Your comments would be appreciated.
