Please note email below. The City will not take on the burden of providing notice in excess of that required by City Code and State Law. Simply stated, doing so creates a "slippery legal slope" that can result in potential financial responsibility to the City's residents and taxpayers. I had a lengthy conversation yesterday with Mr. Gary Toenjes (Cape Shore Condo Pres.) regarding the Cumberland Farms project. We discussed the various approvals the project needed, the opportunities for the public to be involved, and the required public notification measures we would follow. I made it very clear that the City's notification process is established by state and City law and that it does not include a "special" notification to individuals. My point in bringing this to your attention that Mr. Toenjes may be getting a conflicting story from the Mayor based upon the email the Mayor sent last night to Mr. Toenjes. His reply and selection was received in his message below. I called to introduce myself, and asked what the length of her vacation was going to be? As our next meeting to discuss may be before she returns. My request to Gary is to provide a backup that he has confidence in, so they may be invited to hear the meeting if it is scheduled before his first choice returns from vacation. I just called her as you suggested and we discussed the same concerns you stated in your e-mail to me previously. I also assured her that our City will add her e-mail to the noticing of all future meetings that involve the proposed Cumberland Farms store. Is there an additional person you as President, would desire to receive the notifications of future meetings until Rebecca returns from her planned vacation? As I mentioned during our phone conversation, our City Code requires a buffer area between Commercial and Residential Areas, usually consisting of; fence, shrubbery, or walls, so that should address one of your desires and we will speak to the others as they appear.
