Todd, I am sending this email you as from my understanding David Dickey
reports to you. There is a public record request to him under the
Florida Sunshine Law for all communication from and to the city from the
landowners and future landowners for the Cumberland Farms project
folder. So far, (3 weeks later) Mr. Dickey has not complied with this
request.
One of the reasons for this is to get a reasonable meeting of the minds
behind this development and I think it can be achieved. I expressed an
idea to you back on November of 2012 (see my immediate previous email)
when Bob Baugher first bought this property. He told me in a meeting
that he had thought of donating a portion of this land to the city to
use as a park. In fact, I shared this with you in a meeting and you said
he had told you too the same thing. Recently my contacts at the Cape
Shores expressed this as a negotiable point they may consider. And they
were recalling a previous conversation with him. Can this be brought to
the table now?
First off, I need to read what has been communicated with the landowners
and future landowners so far and that is the main reason for my request.
Lastly, to whomever reads this message I hope you understand that I am
thinking what is in the best interest of the city according to the city
comprehensive plan.

you add the latest first, can you do that?
Obviously many of the citizens of the city that you serve are concerned
about this matter and having the latest
factual communication will cut down on misinformation and thus time
spent by our residents on this matter,

Thanks for starting the process to populate the public records with city
and landowner communications in the section for the Cumberland Farms
project. From the transparency this provided I was able to learn one of
Mr. Baugher concerns, so am able to adapt my approach to the
archaeological survey. He sent an email stating he did not think public
funds should be used for this purpose, so I am now in addition to grant
possibilities am exploring crowd-funding an archaeological survey. There
are a number of web services such as Kickstarter that facilitate the
collection of funds from like-minded people for small projects such as
this. This tool may also enable us explore another item that Mr. Baugher
discussed; the possibility of donating land to the city to use as a city
park.
I look forward to the continue buildup of the public records for this
section and hearing back on the inquiries I made in my previous email.

I want to recap my conversation this past Monday September 29th, 2014
with David Dickey the city planner.
I stopped by briefly and reiterated to the city planner my willingness
to communicate to the land owner or new potential land owner that it is
not my intention to use the archaeological resources of this area to
stop their development. Others and I would like to see if the developer
would give us a period of 2-3 months to do a proper survey of this
significant archaeology site in our area. This would give us time to
gather some knowledge of an ancient culture of people that lived here
2000 years ago, collect artifacts and properly remove any archaeological
impediments to future development.
At the last city meeting when I spoke, the council voted that I could
move forward with making plans for an archaeological survey which
included and most importantly; obtaining permission from the land
owners. It looks unlikely that the current owner will give us permission
based on earlier conversations. My hope is with the new potential
landowner and I asked the city planner again if he would see what he
could find our if that would be agreeable with them. It was from my
understanding that he would. Is there any objection from the city on
this? I certainly want to see the best interests of the city served and
I believe they are.
I also mentioned to the city planner that it would be helpful to have a
copy of the contract between the buyer and seller of this lot of land.
Can a copy be requested for the city's records?
I look forward to reading the subject communications in the public
records soon. This will help us all make informed decisions and avoid
misunderstandings due to misinformation. But I request that it be made
available before the next P&Z meeting if the subject development is on
their agenda next week.
