AN ORDINANCE AMENDING CHAPTER 683, OFF-ROADWAY
REGULATIONS, OF THE CODE OF THE CITY OF CAPE
CANAVERAL, FLORIDA, BY DELETING THE PROVISION
PERMITTING HANDICAPPED AND DISABLED PERSONS TO
PARK ON THE BEACH AT THE WASHINGTON AVENUE
APPROACH; REPEALING ALL SECTIONS OF THE CITY CODE
IN CONFLICT THEREWITH; BY PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED by the City Council of the City of Cape
Canaveral, Florida, as follows:
SECTION 1. Chapter 683 of the Code of the City of Cape
Canaveral, Florida, entitled "Off-Roadway Regulations " is hereby
amended as follows:
Section 683. 03 (B), which reads as follows, is deleted in its
entirety:
"Section 683. 03 (B) Persons who are physically disabled or
handicapped to such an extent that they are unable to walk to
the beach shall be permitted to park a motor vehicle upon the
ocean beach at the Washington Avenue beach approach, provided
said vehicles do not park beyond the boundaries of said
Wabhington Avenue on the beach. The police department shall
have the right to request that those handicapped or disabled
persons parking on the beach pursuant to this section, show
proof of their disability by competent and appropriate evidence. "
SECTION 2. All sections of the Code of the City of Cape
Canaveral, Florida in conflict herewith are repealed.
SECTION 3. This ordinance shall become effective immediately
upon its adoption.
ADOPTED by the City Council of the City of Cape Canaveral,

Dear Mrs Ostrom:
The staff has reviewed the proposal submitted for the dune
crossover project by the City. We concur with the proposal ,
project description and the task assigned to the project.
We concur that your beautiful beaches do require protection
and it is vital that the work be commenced as soon as possible .
We would, however, recommend that the City review the policy
of permitting driving over the dunes onto the beach. At
Washington Avenue there is a vehicle access that is quite
heavily used by people going to and from Jetty Park . We would
certainly recommend that this practice be discouraged. We
would require that the City, if State contributions are allocated
to this project, actively seek to protect the dunes , dunal
vegetation and the restored beach through enforcement of
State laws and/or city ordinances .
The City of Cape Canaveral' s request will be included in the
Bureau' s budget request for Fiscal Year 1979-81 .

Canaveral, Florida, entitled "Off-Roadway Regulations" is hereby
amended as follows :

entirety, and the following substituted therefor:
"Sec. 683 . 03 EEEDELLaaLTEaKiitl.
(A) The prohibition contained in Section 683. 02 above
shall not apply to emergency vehicles of the police or fire
departments, or to ambulance or to private towing vehicles,
provided the police department is notified prior to the
travel and the name of the person requesting towing assis-
tance and the location of the vehicle to be towed is fur-
nished.
(B) Persons who are physically disabled or handicapped
to such an extent that they are unable to walk to the brach
shall be permitted to park a motor vehicle upon the ocean
beach at the Washington Avenue beach approach, provided said
vehicles do not park beyond the boundaries of said Washington
Avenue on the beach. The police department shall have the
right to request that those handicapped or disabled persons
parking on the beach pursuant to this section, show proof
of their disability by competent and appropriate evidence. "
SECTION 2. All sections of the Code of the City of Cape
Canaveral in conflict herewith are hereby repealed.
SECTION 3 . This ordinance shall become effective immediately
upon its adoption.
ADOPTED by the City Council of the City of Cape Canaveral,
Florida, this 5th day of October , 1976 .
