I was reviewing your weekly update and something caught my eye regarding
Cumberland Farms:
It said that they would need a SE for alcohol.
The implication could be that they do not need a SE for anything else.
Being the … type of person that I am… I didn’t want to mislead any
reader so I looked further into it.
That got me to looking into whether they needed a SE for gasoline sales.
Here’s what I found:
The code defines them as a “service station”.
110-334(c)(3) requires a SE for “Automobile Service Stations” and
provides a host of vehicle repair regulations unrelated to gasoline
sales.
It goes on to say that a service station shall not be erected within
2,000 feet of the property line of another service station.
That raises questions about the proximity of other service stations (the
7-11 on Grant and the Shell Station on Pierce.
At first look, Google Earth has it slightly more than 2,000 ft from
Shell, but definitely within range of 7-11.
So we need to have some conversation about 7-11 and the fact that it is
located in no-man’s land.
We should also talk about whether the terms “Service Station”,
“Automotive Service Station” and Vehicle Repair Facility” are being
using to liberally. We could possibly draw some distinctions among them
before we go along much further.
