MINUTES
A meeting of the City of Cape Canaveral Community Appearance Board was held on
September 18, 2013, in the Cape Canaveral Public Library, 201 Polk Avenue, Cape

1. Approval of Meeting Minutes: August 7, 2013.
Motion by Mary Jo Tichich, seconded by Rosalie Wolf to approve the meeting
minutes of August 7, 2013, as written. Vote on the motion carried unanimously.
2. Review & Motion Re: New Dollar General Store - 6395 N. Atlantic Avenue -
Concept Development LLC Designated Agent.
Planning & Zoning Director, Barry Brown gave his Staff Report. He advised that
The Dollar General was planning to construct a 9,276 sq. ft. store on the site of the
former Azteca Restaurant. The Board members reviewed and held discussion regarding:
photographs and aerials of the site and setting as well as abutting and adjacent properties;
property survey; proposed elevations; proposed landscaping; sidewalk, bike path and
driveway location(s); truck delivery movements; demolition of the existing building and
parking lot; lighting; dumpster location and screening; a/c location, including noise
buffering and screening; proposed building colors; and stormwater retention.
Attorney, Kim Rezanka, representative for John, Michelle, and Steven Porter, voiced
concern regarding the buffering of undeveloped residentially zoned property owned by
the Porter's, located west of this proposed commercial development. She spoke about
buffering of a 50 ft. strip of property, which could be utilized as a future access road,
located west of the proposed Dollar General property and east of the Porter's property.
Barry Brown pointed -out that theDollar General property did not abut the Porter's
property and the proposed development of the Dollar General property exceeded the

minimum landscaping requirements per Code. The Board viewed photographs of the
thick vegetative area west of the property. Discussion followed. Barry Brown explained
that if a road was ever built along the 50 ft. strip which abutted the two properties, a
landscape buffer would be required along the west property line by that property owner at
that time. Discussion continued regarding the 50 ft. strip of property.
Motion by Joseph Mathos, seconded by Rosalie Wolf to approve the new Dollar General
Store, with the following two conditions:
1) The AIC ground unit shall have a privacy and noise dampering
enclosure; and
2) The City's Building Department shall confirm that the colors on the
elevations conform to the color codes shown on the application
(Sherwin-Williams).
Voice vote on the motion carried unanimously.
3. Review & Motion Re: Selection of Summer Beautification Award Winners.
Planning & Zoning Director, Barry Brown verified that a "We Noticed" sign was placed
on each property nominated for a Beautification Award. He explained that one winner
would be selected for each of the following categories: single family, multifamily, and
commercial. He noted that at the Board's last meeting it became apparent that selection of
award winners would be more easily accomplished if they had selection criteria. The
Board members reviewed and discussed criteria preferences used by the Edgewood Park
Neighborhood Association, for the basis of creating the Board's own selection criteria,
submitted by Board Member, Angela Raymond. Discussion followed. The Board
members reviewed photos and discussed each property that was nominated for the
Summer Beautification Awards for each of the three categories. Chairperson Wasserman
announced that the Board would now select the Summer Beautification Award winners.
The Board members voted and the votes were tallied for each category.

Barry Brown advised that each winner would receive a $50 VISA gift card.
OPEN DISCUSSION
Chairperson Wasserman reminded the Board members that when they are questioning
applicants to stay focused on items germane to the application and to avoid hearsay. He
cautioned Board members to be careful if they are contributing something from a third -
party unless that person is at the meeting and they can ascertain that information
themselves.
Barry Brown announced that the Board would likely meet again in October to review
elevations for a new proposed townhouse project on Oak Lane.
Motion by Mary Jo Tichich, seconded by Rosalie Wolf to adjourn the meeting at 8:07
p.m.

Assistant City Attorney Kimberly Kopp swore in Mark Robbins, Director of Hotel
Development, on behalf of the applicant LBA Sunbelt Development.
Mr. Morley introduced the new Staff in Community & Economic Development & City
Attorney's office: David Dickey, Planning & Zoning Director; Susan Juliano, Senior
Secretary; Gary Stepalavich, Building Official; and Kimberly Kopp, Assistant City
Attorney.

Mr. Dickey provided the Board with a brief background on his history/past employment.
He spoke about the future growth for the City and brought a power point presentation to
their attention.
Power Point Presentation: (Slides 1-7)
• Review and approval of Level one (1) Application, consistent with Sec. 22-44 of
the City of Cape Canaveral Code of Ordinances,
• Review and approval of an increased building height to 65 feet, consistent with
Sec. 110-624 of the City of Cape Canaveral Code of Ordinances,
• Project Location,
• Project Site Plan,
• Building Elevation,
• AIA Economic Opportunity Overlay District Boundary Map -Northern end of the
C2 Zoning District and
• Overlay District Code.
Mr. Dickey explained the origin of the Overlay District, which provides
guidelines/standards for public/private development projects in commercially zoned areas
along AIA. The 2009 community visioning is to promote hospitality commercial
development that capitalizes on the economic benefits of the Port and provides guidance
and direction.
Mr. Dickey quoted the last paragraph of the letter from Planning Design Group (PDG),
Orlando, Florida, the consultant that drafted the overlay project, which stated that the
project being considered was consistent with the Overlay District rules, regulations and
policies. PDG and Staff were recommending that the Board approve the project.
No questions were forthcoming from the Board.
Mr. Dickey introduced Mark Robbins, Director of Hotel Development, on behalf of the
applicant LBA Sunbelt Development. Mr. Robbins stated he was with Larry Bloomberg
& Associates LBA, Hospitality. Sunbelt Development is the development arm of LBA.
They had been looking at Cape Canaveral for 3 — 5 years and chose the City due to the
beaches, attractions and the Port.
Mr. Robbins reviewed the slides and explained where they were aligning the building
entrance and noted there were only five trees on the property. The site is in the northern
C-2 Zoning district on 3.54 acres. They are proposing a six -story, 153 room extended
stay hotel. The building will be approximately 113,000 square feet with an oversized
swimming pool; sports court or splash pad and an oversized back area for breakfast with
100-110 inside seating for patrons and an outside kitchen for barbeques. Parking will
exceed the 166 required parking spaces, meeting the City's 200 sq ft criteria, with

additional parking totaling 215 parking spaces. A bike rack will be located near the
service entrance on the north side. There will be a 20 foot tall sign with their logo and
hotel name. They are designing a lift station and working with Staff on utilities. As
currently proposed all utilities, waste & sewer are going across AIA.
Mr. Robbins presented samples of the stone material being used and roof file samples,
which meet the color requirements, the Hilton brand criteria and the City's criteria. They
plan on starting construction in September of 2014 with completion in the fall of 2015.
Local contractors familiar with the site and the City would be utilized.
Mr. Wasserman asked the Board members if they had any questions.
Ms. Raymond asked about the entrance driveway for people coming from the Port off of
AIA. She was concerned about the people traveling in this direction and not being able to
turn in the entrance way. Mr. Morley stated that there is another completely different
project on AIA that will have medians in the road where people traveling from the Port
will either have to go to the next break in the median or next traffic light and make a U-
turn. Mr. Dickey stated that other hoteliers, Mr. Baugher and Mr. Hermanson, were
looking into this issue as well.
Ms.Tichich noted that one of the drawings showed the hotel rooms getting smaller and
smaller as the floors go up and it does not match with the site plan measurements. Mr.
Robbins stated that it depends on what type of rooms they are. There will be king studios,
king suites, extended king suites, double queens, etc. They had to introduce a double
queen to extend or bring back the buildings to accommodate the stepback requirements.
Mr. Wasserman asked if the a/c units will be room by room. Mr. Robbins stated there
will be vtac or ptac, but each room does have a separately controlled thermostat. The rest
of the a/c areas will depend on the area in the hotel.
Mr. Wasserman inquired about the lighting package. Mr. Robbins stated it is at each of
the building corners, 2 lights that go up, none glare. There will be lights in the parking lot
as well.
Mr. Wasserman inquired about the lift station. Mr. Robbins stated there will be a grinder
pump and they are working with the City on the utilities.
Mr. Wasserman asked about the parking lot over the storm water retention vault. Mr.
Robbins stated there will be a decorative barrier to limit traffic of larger vehicles.
Mr. Wasserman asked about the refuse/recycle area. Mr. Robbins stated it will be in an
enclosed area with a gate matching the Hilton brand.

Motion by Mr. Wasserman, seconded by Ms. Tichich to approve. The vote carried
unanimously.
Mr. Wasserman stated that the September 18, 2013 meeting minutes should be deferred
for consideration to the next meeting.

Summary:
This item consists of an application for a proposed retail convenience store located
immediately southwest of the intersection of N. Atlantic Avenue and South Cape Shores
Circle and includes a request for a Level 1 Application consistent with Sec. 22-44 of the
Cape Canaveral Code of Ordinances.
The Level 1 application is for Community Appearance Board review and approval of a
4,673 square foot, retail convenience store that includes eight fueling islands under a
detached canopy. The proposed building in located on a 1.42 acre parcel which has an
existing driveway cut onto A1A.
Sec. 22-42 (c) of the Code establishes certain criteria that the CAB must consider when
evaluating an application. In general, the criteria are to gauge whether a project is in
harmony and consistent with the surrounding natural and built environment.
Staff has reviewed the application and has found that it is consistent with Sec. 22-44 of
the Code, specifically:
(1)The plans and specifications of the proposed project indicate that the setting,
landscaping, ground cover, proportions, materials, colors, texture, scale, unity,
balance, rhythm, contrast and simplicity are coordinated in a harmonious manner
relevant to the particular proposal, surrounding area and cultural character of the
community.
(2) The plans for the proposed building or structure are in harmony with any future
development which has been formally approved by the city within the
surrounding area.
(3) The plans for the proposed building or structure are not excessively similar or
dissimilar to any other building or structure which is either fully constructed,
permitted but not fully constructed, or included on the same permit application,
and facing upon the same or intersecting street within 500 feet of the proposed
site, with respect to one or more of the following features of exterior design and
appearance:
a. Front or side elevations;
b. Size and arrangement of elevation facing the street, including reverse
arrangements; or
c. Other significant features of design such as, but are not limited to:
materials, roof line and height or design elements.

(4) The plans for the proposed building or structure are in harmony with the
established character of other buildings or structures in the surrounding area with
respect to architectural specifications and design features deemed significant
based upon commonly accepted architectural principles of the local community.
(5) The proposed development of the building or structure is consistent and
compatible with the intent and purpose of this article, the Comprehensive Plan for
Cape Canaveral, and other applicable federal, state of local laws.
(6) Within the C-1, C-2 and M-1 zoning districts, any exterior building or roof color
used shall be well designed and integrated with the architectural style of the
building and surrounding landscaping in order to create a subtle and harmonious
effect and promote aesthetic uniformity within the district. Bright or brilliant colors
shall not be permitted except for use as an accent color within the C-1, C-2, or M-
1 zoning district.

Instructions
Pre -app is being scheduled. Met with City
Planner previously.
A pre -application meeting with the City Planner is required prior to completion and
submittal of a Community Appearance Review application. All proposed projects
which have an exterior visual impact or effect on the community may require
approval of the Community Appearance Board prior to the issuance of a building
permit or before consideration of a site plan by the Planning and Zoning Board. If
the City Planner determines that the project is minor or insignificant, completion
of the application and approval of the Community Appearance Board will not be
required.
The Community Appearance Review Application shall be prepared in compliance with
the requirements of Chapter 22, Article III, Sections 22-36 thru 22-47 of our code. To

This application packet must be complete, legible, and submitted with all required
documents referred to herein, to the City of Cape Canaveral, Community and Economic
Development Department, 7510 N. Atlantic Avenue, Cape Canaveral, FL 32920. You
and/or your representative are required to attend the meeting(s) at which your
request will be considered. You will be notified of the dates and times of meetings.

buildings or structures within the C-1, C-2, M-1, or overlay zoning districts):
a. Vicinity map locating all zoning classifications, including orientation of all color
photographs;
b. Materials, texture and color board depicting location of colors; and
c. Minimum of three color photographs of site and setting (surrounding area).

Conceptual Plan requirements:
All conceptual plans submitted for consideration under this article for the new development of
unimproved property shall indicate the following sufficiently:
(1) Dimensions and orientation of the parcel;
(2) Location, height and use of buildings, structures and encroachments both existing
and proposed;
(3) Location and arrangement of manmade and natural ground cover;
(4) Proposed ingress and egress facilities;
(5) A conceptual preliminary landscaping plan;
(6) Unusual grading or slopes, if any; -retention area shown
(7) Location of walls and fences and the indication of their height and the materials of
their construction;
(8) Location and size and graphic content of proposed exterior signs, outdoor advertising
or other constructed elements other than habitable space, if any;
(9) Such other architectural and engineering data as may be requested to clarify the

Summary:
On June 30, 2011, the City Council approved a Binding Developer's Agreement
(Agreement) with Puerto Del Rio, L.L.C., Inc. regarding the development of the Casa
Canaveral Assisted Living Facility (ALF) located at 700 W. Central Boulevard in Cape
Canaveral. The project consists of a 288 bed facility on 7.7 acres.
As part of the City's approval process, a number of permits and/or approvals have been
granted to the project. These include:
1. Special Exception #11-02 was granted to the project to allow for the construction
of an Assisted Living Facility in the R-3 zoning district. The SE was extended by
the Board of Adjustment on August 30, 2012, and again on August 8, 2013. This
approval will be valid until August 8, 2014. Section 110-32 allows for a one-year
extension through approval of the City Manager.
2. Variance #11-03 was granted on April 28, 2011. It was subsequently extended on
August 30, 2012 and again on August 8, 2103. This approval will be valid until
August 8, 2014. Section 110-32 allows for a one-year extension through approval
of the City Manager.
3. The Community Appearance Board approved a Level 1 review on February 16,
2011. It was extended on August 15, 2012 and again on August 7, 2013. This
approval will be valid until August 7, 2014.
4. The City Council, on September 17, 2013, approved a Modification to Binding
Developer's Agreement to remove eight (8) units from the northwest corner of the
project. This approval extended Site Plan Approval until September 17, 2014.
Section 22.43 (b) of the Code stipulates that Approvals by the board (CAB) shall be
valid for a maximum of 12 months from the date the board renders its approval at a
public meeting." As indicated in paragraph 3 above, the board's Level 1 approval will
expire on August 7, 2014. For this reason it is being requested that the board extend its
approval for one year.
Section 22.43 (b) goes on to say "the board may approve extensions for good cause."
The applicant has indicated that financing has been difficult to obtain, however, several
opportunities are taking shape which should allow the project to move forward.

Please note that the approvals that have been previously approved by the City remain
in effect and the applicant shall comply with any and all requirements, standards, and
provisions of these approvals. Should any of the approvals lapse, the City may require
the project to meet any current standards.
