1. That the City of Cape Canaveral, Florida is the owner and holder of an Order Imposing Penalty on
First Violation (Lien) regarding City of Cape Canaveral Code Enforcement Board Case No. 2012-00005,
bearing the date February 23, 2012, and recorded in Brevard County Official Record Book 6551, Page 3 on
March 6, 2012, securing a fine in the amount of Two Hundred Fifty Dollars ($250.00) for each day the
violation continued to exist.
2. That the Lien was recorded upon the property situated in Brevard County, Florida, described as

Bear Ms. Hustey:
The City of Cape Canaveral City Council granted the request for the reduction of the
outstanding lien filed against the property known as 201 International Drive, Unit 214, Cape
Canaveral. The total amount due is ten thousand dollars ($10,000.00), and shall be paid within
thirty (30) days of the City Council meeting, which was held on December 17, 2013.
Pursuant to Section 2-260, (g), Application for satisfaction or release of code enforcement liens;
in part; the violator shall have 30 days in which to comply with the conditions imposed by the
city council. Failure of the violator to comply will result in the automatic denial of the
application for satisfaction or release of lien.
In order for the lien not to revert back to the original amount of $40,750.00, we will need to
receive payment no later than January 16, 2014..Payment may be made via a certified check or
money order payable to the City of Cape Canaveral, 7510 N Atlantic Avenue, Cape Canaveral,
Florida 32920.

I have just been informed that the City will provide your client (Fanny May) and additional rive f5hhusiness days to issue
a certified check in the amount of $10,000.00, as payment in full for the lien filed by the City of Cape Canaveral against
the property known as 201 International Drive, Unit 214. The check must be post marked no later than January 24, 2014.
As you know the original payment deadline date was January 16, 2014.
1 called Danielle Sanders at 919-257-5660, a representative for Seterius, who contacted me yesterday requesting
additional time to process the payment, to inform her of the onetime extension. I left her a voice mail regarding the
granted additional five (5) business days to pay the reduced amount of $10,000.00. If the payment is not received or
postmarked by January 2, 2014, the lien will revert back to the original amount of $40,750.00 dollars.
Please forward this information to her as I was unable to obtain an email address for her

Code Enforcement Board of the City of Cape Canaveral, Florida, on February 23, 2012 to
determine whether any violations of the City of Cape Canaveral Code of Ordinances exist or
existed on the property. The Board, having heard the arguments of the parties and the
evidence presented and having reviewed the record and being otherwise fully advised, makes
the following Findings of Fact and Conclusions of Law incorporated into this Order as set forth
herein.

Based upon the evidence and testimony presented at this hearing, the Coll ' W

1 . That Okespondents were provided a Notice of Violation in accordance with
Section 2-258 of the City of Cape Canaveral Code of Ordinances ("City Code") and consistent
with sections 162.06 and 162.12, Florida Statutes;
2. That a violation of Section 108.1.3, Structure Unfit for Human Occupancy;
Section 304.1, General; and Section 306.1, Infestation, of the of the International Property
Maintenance Code (1998 edition), as adopted by Section 82-221, of the City Code exist or
existed upon the Property and Respondents were further provided a reasonable time to correct

3. That Respondents either failed or refused to correct such violation within t1l

4. That based on the testimony and evidence presented, Respondents ha
violated the City Code, to wit: Section 108.1.3, Structure Unfit for Human Occupancy; Secti
304.1, General; and Section 306.1, Infestation, of the of the International Property Maintenan
Code (1998 edition), as adopted by Section 82-221, of the City of Cape Canaveral Code
Ordinances; Section 34-122(a), Public Nuisances Prohibited; and Section 34-96, Standar
Established, of the City Code; I
5. That said violations exist or existed within the City of Cape Canaveral and that
such constitute violation of the City of Cape Canaveral Code of Ordinances.
BASED UPON THE FOREGOING FACTS AND CONCLUSIONS, IT IS HEREBY
1 . A fine shall be entered immediately in the amount of two hundred and fifty dollars
($250.00) per day, including all cost authorized by law related to the violation, until the violation
is corrected and full compliance is confirmed by the Code Enforcement Officer. Respondents
shall be responsible to provide notice of such violation being corrected to the Code Enforcement
Officer. Upon such confirmation, the Code Enforcement Officer shall promptly file a Notice of

OFFICIAL RECORDS BOOK 2466, PAGE 2562, PUBLIC RECORDS OF
BREVARD COUNTY, FLORIDA. TOGETHER WITH AN UNDIVIDE1
INTEREST OR SHARE, IN THE COMMON ELEMENTS APPURTENANT
THERETO.
5. If the total sum with interest at the rate described in paragraph I and all costs accrued
subsequent to this judgment are not paid, the clerk of this court shall sell the property at

for cash, at the Brevard County Government Center North, 518 South Palm Avenue,
Brevard Room, Titusville, FL 32796 in accordance with section 45.031, Florida Statutes.

plaintiff is purchaser, the clerk shall issue title to plaintiff, or its Assignee (upon Assignment

7. On filing the certificate of title, the clerk shall distribute the proceeds of the sale, so far as
they are sufficient by paying: first, all of plaintiffs costs; second, documentary stamps

less the items paid, plus interest at the rate prescribed in paragraph I from this date to the
date of the sale; and by retaining any remaining amount pending the further order of this
court.
8. On filing the certificate of sale, defendant(s) and all persons claiming under or against
defendant(s) since the filing of the notice of lis pendens shall be foreclosed of all estate or
claim in the property, except as to claims or rights under chapter 718 or chapter 720, Florida
Statutes, if any. Upon the filing of the certificate of title, the person named on the certificate
of title shall be let into possession of the property. The right of redemption shall terminate
upon the issuance of the certificate of sale as per Florida Statute 45.0315.
9. Jurisdiction of this action is retained to enter further orders to give Plaintiff adequate and
complete relief as may be necessary and proper, including: (1) the entry of a writ of
possession; (2) entry of a deficiency decree if borrower(s) has not been discharged in
Bankruptcy or constructively served; and (3) determining the claims in and to any cash
surplus that may be produced at the foreclosure sale, together with additional attorney's fees,

10. In the event that a foreclosure sale is conducted pursuant to this Order and the successful
purchaser fails to pay the initial deposit to the Clerk of Court and/or pay the complete
purchase price to the Clerk of Court in accordance with the rules of the sale, the Clerk of
Court shall reschedule the foreclosure sale pursuant to Florida Statute §45.031(2).

IPMC Section 108.1.3, Structure Unfit for Human Occupancy; A structure is unfit for human.
occupancy whernever the code official finds that such structure is unsafe, unlawful. or because of
the degree to which the structure is in disrepari or lacks maintenance, is insanitary, vermin or rat
infested, contains filth and contamination, or lacks ventilation, illumination, sanitary or heating
facilities or other essential equipment required by this code, or because the location of the
strucutre constitutes a ha7ard to the occupants of the structure or to the public.
