PURSUANT to Section 162.06, Florida Statutes, and Chapter 2 Article VI, of the City of Cape
Canaveral Code of Ordinances, the undersigned Code Enforcement Officer hereby gives notice
of violation(s) of the City of Cape Canaveral Code of Ordinances, as more specifically described
below. Respondent(s) is/are hereby notified that corrective action(s) to cure the violation(s)
described below is/are to be voluntarily performed within -fifteen (15) days.
In the event that the violations(s) is/are not corrected within the time period set forth above or the
violations(s) recur(s) even if the violations(s) is/are corrected at the time of hearing
Respondent(s) may be required to attend a hearing before the Code Enforcement Board for the
City of Cape Canaveral, and a penalty as provided below may be imposed.
The Code Enforcement Board may enter an order requiring the Respondent(s) to correct the
violation(s) and penalties may be assessed up to $250 per day for each first violation or up to
$500 per day for each repeat violation described in this notice until the violations(s) has/have
been corrected. IF THE VIOLATION(S) IS/ARE CORRECTED WITHIN THE TIME PERIOD
REQUIRED, I -HE RESPONDENT(S) MUST IMMEDIATELY NOTIFY j -HE CODE
ENFORCMENT OFFICER AND REQUEST AN INSPECTION.

Our office received a complaint regarding the exterior condition of your property. A site visit
revealed your property needs to be mowed and the trees need to be trimmed. Continued good
appearance depends on the extent and quality of maintenance. Maintenance and upkeep are
required for all the land improvements within the City. Lawns and planting require considerably
more periodic attention than do buildings, nonetheless, both require maintenance in order to
retain a good appearance.
3. Description of Violation(s) at property: Section 34-96, (h), (d), Standards Established.
(b) The owner of every single-family or multiple -family dwelling, commercial or industrial
property or his appointed agent and any occupant, operator, tenant or anyone otherwise using the
property in any form or marmer shall be responsible for maintaining the exterior in a clean,
sanitary and safe condition. All parts thereof shall be maintained in good repair and shall be
capable of performing the function for which such structure or part of any feature thereof was
designed or intended to be used.
(d) Lawns, landscaping, driveways and fences shall be maintained so as not to constitute a
blighting or deteriorating effect in the neighborhood.
Section 34-97, (a) (2), Duties and Responsibilities for Maintenance.
(a) The owner of every single-family or multiple -family dwelling, commercial or industrial
property, his appointed agent and the occupant, operator, tenant or anyone otherwise using the
property in any form or manner shall maintain the premises free of hazards which include but are
not limited to:
(2) Dead or dying trees and, limbs or other natural growth which, because of rotting,
deterioration or storm damage, constitute a hazard to persons in the vicinity thereof. Trees shall
be kept pruned and trimmed to prevent such conditions.
Section 34-,122, (a), Public Nuisances Prohibited.
(a) All grass areas and yards on improved property shall be properly maintained in a neat and
attractive manner and kept free of dead plants, refuse, debris and. shall be maintained further in a
manner such that grass, weeds and other rank vegetation shall not exceed six inches in height.
4. Recommendation(s) to correct the violation(s) described above:
• Mow your property and trim the trees of all dead vegetation.
• Remove all dead material and/or vegetation from the property.
Failure to comply within fifteen (15) days from receipt of this Notice shall result in further
action, as outlined in the previous page(s) of this Notice of Violation.

Hi Duiree;
We found the Notice of Violation on Rob in our sent file. We also have current pictures of the Saga
Palm that he is not trimming and it continues to fall on our drive way and cars and then he puts his
yard waste on our property. We would like this enforced with the tree being trimmed and him not
being allowed to place his yard waste on our property we have a survey that says we have 2.65 ft
from the asphalt and he clearly puts his yard waste on our property and also blocks the public
sidewalk right away allowing kids to kick the stuff in our drive way as they walk also.
Please try to assist with this. He just does not want to comply. Thanks for all your help.

Robert Abbott at 414 & 416 Jackson Avenue continues to trespass on my property and litters
hiis yard waste in my driveway and on miy property. This is total retaliation fo:r a complaint filed
Robert Abbott continues to be a nuisance to the City and myself. He has put cameras facing
my daughters bathroom and over into our backyard. He has blocked my video surveillance
cameras, He has put his yard waste into oiur driveway and on our property. His cats continue
tR trespass and he doles also, onto our property. He blocks my parking space with his yard
waste. He places garbage rotting raw food beside a fence adjoining to our backyard so we,
have to smell clecaying rotting raw food. His yard has drawn rats into our backyard. Flehas
played a blaring Spanish speaking radio station in his backyard with wired speakers, to play
cont�inivailly to annoy us. The Sherriff called h,im out on that with Duree Alexander from the City
R f Cape Canaveral. This neighibo:r is annoyiing, frightening clearly harassing us and is a complete
nuisance to the City neighborhood and myself. The only thing we asked him to do was to mow
his grass when the weeds were two feet tall and keep his cats and yard waste off our property.
Hie will not do this and I am sure there are laws against this which at this time I req:uest�in:g
assistance with these continual harassm:ents from Robert Abbot. Please stop this harassment,
nuisance behavior and trespassing littering on my property of Mr. Robert Abbott. We have a
survey that shows we have 2.65 ft. from the asphalt hils debris should not be place anywhere
near or in our driveway.
