Dear Petitioner(s):
The Board of Adjustment of the City of Cape Canaveral has heard information and
testimony pertaining to your request at the meeting held on the 13th day of February, 2006.
Based on the testimony and information provided, the Boanl of Adjustment has granted
your request to allow on-premise consumption of alcoholic beverages at the above
referenced location.
As per City Code Section 110-48, Any special exception granted under this chapter shall
exprre if the applicant has not obtained a cenificate of occupancy or occupational license as
appropriate and utilized the special exception within 12 months of the date of its issuance;
provided, however, the Board of Adjustment may extend this time period by an additional
12-month period if the applicant can show good cause for the delay. If the applicant desires
an extension, the applicant shall submit its request directlyto the Board of Adjustment prior
to the expiration of the first 12-month period. Additionally, a special exception shall expire
and become null and void if the use granted thereunder is abandoned or otherwise ceases to
exist for a period of 18 consecutive months. As used herein, abandoned shall mean that the
applicant has gone out of business, let all business licenses lapse or has otherwise changed
the use of the property in conformance with the Code of Ordinances. Once a special
exception has lapsed due to abandonment, the applicant must resubmit its special exception
request pursuant to Section 110-46. Should there be a violation to anypan of this approval

We are unable to attend the public hearing this evening. As such, we are faxing yauour
decision seeing that we are loe:ated within 500 feet vl'this property.
We reject the request for cansumptian of alcohal at 8959 Astronaut Baulcvard for the
following reasons:
1. As residents of Cape Canaveral and Brevard County, we already see and read (in
the weekly (~pmetawn Newsl about numeraus alcoholic-related traffic accidents
in the area.
2. Alrnhal consumption also contributes elirectly and indirec !y tv dvrnestie
violence, felony battery, and disr,rderly conduct.
3. Then: are enough existing restaurants and public places that already have a license
to serve alcahol; we do oat need any more such alcoholdelivering facilities.
4. With its proximity to Port Canaveral, 8959 Astronaut Boulevard will
automaUCaily capture enough cruise clients for living accammodation. if these
cruise clients desire to consume alcohol, they can venture nut to the neighbciring
restaurants and businesses that already have the liquor license. This will also help
spread the tourist dollars insle:rd of satiating just ane business at 8959 Astrvnaut
Blvd.
5. Frarn our personal viewpaint, we are often afraid to venttue out in the evenings to
e»joy various activities in Gapc Canaveral, Cocoa Beach, Melhourne, and even
Drlanda because offear of aleohal-related accidents.
We would appreciate your kind attention to our concerns.

SPECIAL EXCEPTION
WORKSHEET
The purpose of this worksheet are two-fold: (1) to assist the Planning and Zoning Board and the
Board of Adjustment in the evaluation of all criteria relevant to the application; and (2) to educate
the applicant as to the criteria which must be addressed and satisfied prior to beginning the
special exception consideration process. If the applicant can not satisfactorily address one or
more of the following, this should serve as a preliminary indication that the request for special
exception may be rejected or that the application may not be acceptable for processing.
CRITERIA (Building Official or Designee to Verify)
1) Does the Special Exception create any adverse impact to adjacent property through the
creation of noise, light, vibration, traffic, utility requirements, or stormwater runoff that
would not have been created had the property been developed as a principle use in the
applicable zoning district.
The Residence Inn Site Plan has already been approved. This reguest for Special
Exception for on premise consumption of alcohol should not create an adverse
impact to adjacent properties. It is assumed that most lounge patrons will be hotel
guests. Therefore the alcohol is expected to be served primarily to internal guests
already in the vicinity, which should not affect the adjacent properties.
2) Will the Special Exception create any unusual police, fire or emergency services?
No unusual emergency services are needed.
3) Will the Special Exception meet all the requirements of the zoning district in which the
request is to be located, such as: lot requirements, building setbacks requirements, lot
coverage, height, buffers, off-street parking, signs, storage, landscaping, etc.?
The Special Exception shall meet all the requirements of the zoning district in which
the request is to be located.
4) Is there adequate ingress and egress, with particular reference to auto and pedestrian safety
and convenience, traffic flow and control, and emergency access in case of fire or medical
emergency?
Adequate ingress/egress potential exists. Access to the subject site can be gained
from Astronaut Boulevard.
5) Is there adequate off-street parking and loading areas available without creating
undue noise, glare, odor or other detrimental effects upon adjoining property owners?
Adequate parking currently exists as approved in the Residents Inn Site Plan.
6) Is there adequate and properly located utilities available or may be reasonably
provided to serve the proposed development (if applicable)?
Adequate utilities are available to the subject site.
7) Is there adequate sc,,;ening and/or buffering provided to ,rotect and provide
compatibility to adjoining properties?
Applicant must meet the screening and buffering requirements of Chapter 102, City of
Cape Canaveral Code of Ordinances.
8) Are signs and exterior lighting, if any, designed and arranged so as to promote traffic
safety and to eliminate or minimize any undue glare, incompatibility, and disharmony
with adjoining properties?
All lighting and traffic safety requirements must be meet according to City of Cape
Canaveral Code of Ordinances.
9) Is there adequate refuse and service areas?
There is adequate refuse capacity.
10) Do the setbacks, landscaping, and open space meet the requirements of the zoning
district?
The subject site meets the setbacks, landscaping and open space requirements of the
zoning district.
11)Is the proposed use compatible with surrounding uses in its function, its hours of
operation, the type amount of traffic generated, structure size and setbacks, its
relationship to land values and any other facts that may be used to measure or
determine compatibility?
The proposed development is consistent and compatible with the surrounding uses.
12)Is the Special Exception consistent with the goals, objectives and policies of the
Comprehensive Plan?
This `Special Exception' request is consistent with the goals, objectives and policies
of the Comprehensive Plan.
13)Is the Special Exception consistent with the intent of the zoning district with which
the Special Exception is sought?
Yes, the Special Exception is consistent with the intent of the zoning district.
14) Has the petitioner met the minimum requirements for the requested Special Exception
and demonstrated entitlement to the Special Exception which will not adversely affect
the public interest?
To be recommended by the Planning and Zoning Board and determined by the Board
of Adjustment.
15) Should the Special Exception be granted with any noted limitations, restrictions
and/or conditions?

Having spent nine months living at a Residence Inn in La Jolla, Ca, we enjoyed the
evening snacks, drinks and camaraderie provided at this time. Being from Indiana at that
time, it was very nice to meet new people.
We never saw any over indulgence at these occasions. We see no harm to our community
in allowing this Residence Inn hallmark at Cape Canaveral.

address is 3425 North Atlantic Avenue, Cocoa Beach, Florida 32931 ("Developer") and The
City of Cape Canaveral, a Florida municipal corporation ("City").
' WITNESSETH: j
WHEREAS, Developer has acquired two contiguous parcels by deeds recorded in O.R.
Book 5288, Page 2196 and O.R. Book 5288, Page 2198, all of the Public Records of Brevazd
County, Florida (the "Property"); and
WHEREAS, Developer anticipates developing the Property as three parcels (nrsutant toga
the Residence Inn Pazcel, Out Parcel 1 and Out Parcel 2 in attached Exhibit "A") p
site plan approved by the City (the "Site Plan"); and
~ WHEREAS, the Residence Inn Parcel as described in Exhibit "A" consists of a portion of
I the lands described in O.R. Book 5288, Page 2196 and a portion of the lands described in O.R.
Book 5288, Page 2198, all of the Public Records of Brevard County, Florida; and
WHEREAS, the City, as a condition of Site Plan approval, has required that the
Developer execute and record this Agreement to demonstrate unity of ownership and title as to
said Residence Inn Parcel; and
WHEREAS, Developer and the City desire to have the Residence Inn Parcel recognized
as one parcel for development purposes under the City's land development regulations; and
WHEREAS, the City as a condition of Site Plan approval has required that the Developer
restrict access from adjacent State Road No. A-1-A ("AlA") to Out Pazcels 1 and 2; and
WHEREAS, Developer and the City desire to formally preclude curb cuts from Out
Parcels 1 and 2 to AIA.
NOW, THEREFORE, for and in consideration of the mutual covenants contained herein,
the receipt and sufficiency of which is hereby acknowledged by the parties hereto, Developer
and the City agree as follows:

1. The foregoing recitals are true and correct and are hereby fully incorporated into
this Agreement by this reference.
2. Developer represents and warrants that it possesses fee simple title to the
~ Property, including the Residence Inn Parcel and Out Pazcels 1 and 2 as described in Exhibit "A"
attached hereto.
3. Developer agrees, as a condition of Site Plan Approval, that the Residence inn
Pazcel shall be unified in ownership and title for development purposes upon recording of this
Agreement; and Developer further agrees not to sell, convey or assign any interest in the
Residence lnn Parcel which would cause the loss of unity of ownership of title, without first
obtaining the written consent of the City.
4. Developer agrees, as a condition of Site Plan Approval, that Out Parcels 1 and 2
shall not access AlA directly through curb cuts on AlA without the prior written consent of the
City.
5. Developer agrees and consents that this Agreement shall be recorded in the office
of the Clerk of Circuit Court in and for Brevard County, Florida, and that all costs of recording
shall be paid by the Developer.
6. Developer agrees that the provisions of this Agreement shall be binding upon the
heirs, personal representatives, successors and assigns of Developer; and that this Agreement
shall run with the land.
7. AlA Acquisition Corp., a Florida corporation, as general partner of the
Developer, hereby represents and warrants that it has the right to execute this Agreement and
bind the Developer to the terms and condition hereunder.
