A RESOLUTION OF THE CIT -Y COUNCIL OF. THE CITY
OF CAPE CANAVERAL, FLORIDA, STRONGLY OPPOSING
SENATE BILL 1650 REGARDING CHANGES TO THE
NATIONAL FLOOD INSURANCE PROGRAM; PROVIDING'
FOR AN EFFECTIVE DATE.
WHEREAS, the U.S.- House of Representatives ov.erwheimingly
passed - H,.,R. 1.236, which, if enacted in the U.S. Senate, would
materially change the scope of the original National Flood
Insurance Program established in 1968; and
WHEREAS, the bill is currently being deliberated in the U.S.
Senate:, as S. 1650 and
WHEREAS, the bill, if enacted, would require the establishment
of 10 -year, 30- year, and 6'0 -year erosion control zones for -every
coastal community in the nation; and
WHEREAS, the bi;l,l, if enacted, would prohibit mortgage
financing institutions from financing structures within, flood -prone
areas unless such structures are insured under the national flood
insurance program; and
WHEREAS, 'the bill, if enacted, would therefore greatly
diminish the, value of property within virtually every coastal
community in the nation, because owners could not insure the
structures within their property, nor could they sell to buyers
having to finance the purchase of, such .,property; a,nd
WHEREAS, the bill., if enacted, will - render a' substantial
number of residential and commercial structures located within the
barrier islands of. Breward County and the City of Cape Canaveral,
ultimately uninsurable for flood insurance; and
WHEREAS, the Property Appraiser for Brevard County has
indicated that the restriction on flood insurance would have a
chilling effect on the real estate market due to potential buyers
being unable to obtain the 'flood insurance, required by lending
institutions and thin would,, in turn., reduce the market for
property.,- drive down property values.,,. and thereby, erode the tax
base; and

WHEREAS, the bill, if enacted, would drastically reduce the
tax base of the entire City of Cape Canaveral and Brevard County;
and
WHEREAS, the bill, if enacted, would impose no similar
prohibitions on the insurability of structures within other areas
of the nation which are flood prone, such as riverine areas, even
though statistics show that the number and value of flood insurance
claims from riverine areas has exceeded those from coastal areas;
and
WHEREAS, the bill, if enacted, would provide a total of only
$5,000,000 per year nationally for property owners within the
coastal erosion zones to demolish their structures or remove them
from the zones, even though the bill's provisions supposedly
authorize a subsidy of up to 110% of the cost of demolition or
removal of every structure; and
WHEREAS, the bill, which has not widely publicized during its
passage through the House of Representatives, obviously needs more
study; and
WHEREAS, the Senate should not enact the bill in its present
form, because the bill, is neither actuarially sound nor
fundamentally fair, and should be further scrutinized.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CAPE CANAVERAL, FLORIDA:
SECTION 1. The City of Cape Canaveral urges the United States
Senate to reject Senate Bill 1650 and study the facts surrounding
the flood insurance program further, in order to ensure that the
flood insurance program is actuarially sound and fundamentally
fair.
SECTION 2. The Florida Legislature is urged to commit its
resources to the full research of this critical policy area for the
purpose of recommending the appropriate U. S. Congressional action.

SECTION 3. The City Clerk is hereby directed to provide
copies of this resolution to Governor Lawton Chiles and all the
members of the Florida Cabinet, Senators Bob Graham and Connie
Mack, as well as to the Florida members of the United States House
of Representatives, the Brevard Legislative Delegation, the
Subcommittee on Housing and Urban Affairs of the U.S. Senate, and
other interested parties.
SECTION 4. That this resolution shall take effect immediately
upon its adoption.
ADOPTED by the City Council of the City of Cape Canaveral,
