HomeMy WebLinkAboutResolution No. 1991-03RESOLUTION NO. 91 -03 A RESOLUTION OF THE CITY OF CAPE CANAVERAL, FLORIDA., URGING THE BREVARD COUNTY LEGISLATIVE DELEGATION TO SPONSOR, SUPPORT AND ACTIVELY WORK TO PROCURE ENACTMENT OF STATEWIDE LEGISLATION PRO- HIBITING THE RELEASE FROM POLICE CUSTODY OF ANY PERSON.ARRESTED FOR THE OFFENSE OF DU'I WITHIN 24 HOURS AFTER SUCH PERSON'S ARREST; REQUIRING THE IMPOUNDMENT DURING SUCH 24 -HOUR PERIOD OF THE VEHICLE BEING OPERATED BY THE PERSON ARRESTED FOR - DUI; PROVIDING AN EFFECTIVE DATE. WHEREAS, at the present time there is no law in Florida requiring., that ,a person arrested for driving, while under the influence of alcohol or drugs (DUI) be held in police custody for a specific period of time after being arrested, and-- accordingly, there have been instances wherein persons so arrested have been released from custody soon after their arrest only - to continue driving while in an impaired state, resulting in injury or death to themselves or others; and WHEREAS, the dire need for appropriate legislation prohibiting the early release of persons charged with DUI is illustrated by the untimely death of Rockledge resident, Christopher Mueller, age 19, on October 21, 1990, who was killed in a collision of two vehicles, one of which was operated by a person arrested for DUI less than three hours prior to the collision.; NOW, THEREFORE, BE IT RESOLVED by the City of' Cape Canaveral, Brevard County, Florida as follows: SECTION 1. The members of the Brevard County Delegation to the Florida State Legislature are hereby urged -to sponsor, support and actively work to procure enactment, -at the 1991 . session, of appropriate statewide legislation prohibiting the release from police custody of any person arrested for the offense of DUI within 24 hours after such person is arrested, and requiring the impoundment during such 24 hour period of the vehicle being operated by the person arrested for DUI. That a copy of this Resolution be furnished to the Chairman of the Brevard County Delegation to the Florida State Legislature and the office of the Governor of the State of Florida. SECTION 3. This Resolution shall take effect immediately upon adoption.
