HomeMy WebLinkAboutResolution No. 1991-02RESOLUTION NO. 91 -02 A RESOLUTION OF THE CITY OF CAPE-- CANAVERAL SUPPORTING STATEWIDE LEGIS- LATION TO REQUIRE ASSESSMENT FOR AD. VALOREM TAX PURPOSES OF NEW AND IMPROVED CONSTRUCTION AT THE TIME OF ISSUANCE OF THE CERTIFICATE OF OCCUPANCY; PROVIDING ,AN EFFECTIVE DATE. - WHEREAS, current law does not require property appraisers to place new and improved. construction on the tax rolls at the time of issuance of the Certificate of Occupancy and therefore, such new and- improved construction does not yield ad valorem tax revenue for the first twelve to eighteen months after the Certi- ficate of Occupancy is issued; and WHEREAS, new and improved construction receives the benefits of municipal services from the time of issuance of the building permit; and WHEREAS, providing municipal services for new and improved construction without any tax revenue therefrom casts an inequitable financial burden upon municipalities; and WHEREAS, the deferral of assessment of new -and -improved construction for ad valorem tax purposes until January 1st of the year .following completion of construction requires present taxpayers to subsidize services for new and improved growth through current taxes for the first twelve to eighteen months after issuance of the Certificate of Occupancy; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cape Canaveral, Brevard County, Florida as follows: SECTION 1. The City of Cape Canaveral supports the proposed legislation calling for partial year assessment of new and improved construction for ad valorem tax purposes as a fair and equitable method of generating the tax revenues needed to fund the municipally rendered services to and for the benefit of such new and improved construction. SECTION 2. That a copy of this Resolution be sent to the Florida League of Cities, and to the Brevard County Legislative Delegation. Resolution No. 91 -02 Page 1 of 2 SECTION 3. This Resolution shall take effect immediately upon adoption. ADOPTED BY the City Council of the City of Cape Canaveral, Florida, this 5th day of February , 1991.
