A RESOLUTION AMENDING THE CITY'S
REQUEST FOR THE STATE OF FLORIDA
INTERNAL IMPROVEMENT FUND PROPER-
TY) PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Cape Canaveral initiated action in 1985
to obtain following described property located in the City which
is under the trusteeship of the State of Florida Internal
Improvement Fundi

WHEREAS, the Canaveral Port Authority has subsequently
initiated action to obtain the same property; and
WHEREAS, the City of Cape, Canaveral and the Canaveral Port
Authority have had discussion regarding the nature and usefulness
of this property; and
WHEREAS, the City of Cape Canaveral agrees that the portion
of the property located eastward of State Road AlA is more suit-
able to the needs and plane of the Canaveral Port Authority; and
WHEREAS, the City of Cape Canaveral has as its prime
interest the conservation of nature and the protection of its
sovereignty over the river shoreline;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Cape Canaveral, Florida, as follows:
SECTION 1. The City. of Cape Canaveral relinquishes its
petition to acquire that portion of the Internal Improvement Fund
property in the City of Cape Canaveral, located eastward of State
' Road AIA, and joins with the Canaveral Port Authority in its
efforts to obtain that property for the Canaveral Port Authority.
SECTION 2. The City of Cape Canaveral petitions the
Governor of the State of Florida and the Cabinet Officers, acting
as Trustees of the Internal Improvement Fund, to deed the
property referenced to in Section I to the Canaveral Port
Authority.

SECTION 3 . The City of Cape Canaveral petitions the
Governor of the State of Florida and the Cabinet Officers , acting
as Trustees of the Internal Improvement Fund, to deed to the City
of Cape Canaveral all other property located within the corporate
limits of the City of Cape Canaveral under their trusteeship to
the City of Cape Canaveral.
SECTION 4 . The City of Cape Canaveral requests the assist-
ance of the Brevard County Legislative Delegation in pursuing the
transfer of ownership of these properties as described above to
the Canaveral Port Authority and to the City of Cape Canaveral.
SECTION 5 . This Resolution shall become effective immediate-
ly upon its adoption.
ADOPTED BY the City Council of the City of Cape Canaveral,
Florida, this 16th day of February , 1988.
