RESOLUTION N0. 88-3
A RESOLUTION PRESCRIBING ASSESSMENT
CRITERIA TO BE USED IN ASSESSING LAND
OWNERS UNDER THE CITY'S COLUMBIA DRIVE
STREET REPAIR PROJECT; ESTABLISHING
METHOD OF PAYMENT; PROVIDING AN EFFECT-
IVE DATE.
BE IT RESOLVED by the City Council Of the City of Cape
Canaveral, Florida, as follows:
SECTION 1. The following prescribed assessment criteria
shall be used by the City of Cape Canaveral, Florida, it's
I agents, servants and employees in assessing property owners under
the proposed Columbia Drive Street Repair Project of the City Of
Cape Canaveral, Florida:
A. Assessments shall be levied on each residential/dwelling
unit or commercial unit abutting or specifically benefited by
said improvements and only on those properties.
B. On unimproved property the assessment shall be based on
the number of residential/dwelling units per acre that may be
built on said property.
SECTION 2. In the event that the criteria prescribed in
Section 1 does not allow for equitable assessment to the
benefited properties, any inequities resulting may be adjusted by
the City Council sitting as the Board of Equalization at the
conclusion of the Columbia Drive Street Repair Project.
SECTION 3. The City shall be responsible for paying 258 of
the total cost of the project. The remaining 758 of the total
cost of the project shall be assessed to the benefited property
owners. The assessment shall be based on a per-unit basis
determined by dividing the total number of units, both
' residential and commercial, and unite per acre on unimproved
land, into 758 of the total cost of the project. The City shall
pay the contracted price and shall allow the assessed property
owners to repay the assessment fee over a three (3) year period,
or sooner, in annual installments to include principal and
interest as allowed by State Statute.
