HomeMy WebLinkAbout07-22-1980 Special Meeting and Public HearingCITY COUNCIL MICROFILMED 4 -I5 -85 SPECIAL MEETING PUBLIC HEARING JULY 22, 1980 THE SPECIAL MEETING AND PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, FLORIDA WAS HELD ON JULY 220 1980 AT CITY HALL, 105 POLK AVENUE, CAPE CANAVERAL, FLORIDA, THE MEETING WAS CALLED TO ORDER AT 7 :36 P.M. BY MAYOR JOHNSON L. MURPHY, JR. THE ROLL WAS CALLED BY THE CITY CLERK. OFFICIALS PRESENT WERE; 14AYOR J,L. MURPHY, JR., COUNCIL MEMBERS L, BOYD, J. CALVERT, P. LEE AND W. RUTHERFORD; CITY ATTORNEY JOSEPH SCOTT, CITY MANAGER ANITA J. OSTROM, CITY CLERK PATRICIA BEAULIEU AND SGT. AT ARMS JOAN HUDEPOHL, MAYOR MURPHY READ THE TITLE PAGE OF THE ORDINANCE IN FULL. THE TITLE WAS AS FOLLOWS: AN.ORDINANCE ADOPTING THE COMPREHENSIVE PLAN FOR THE CITY OF CAPE CANAVERAL, FLORIDA IN CONFORMANCE WITH THE LOCAL GOVERNMENT COMPREHENSIVE PLANNING ACT OF 1975, BY ESTABLISHING CHAPTER. 630 OF THE CODE OF THE CITY OF CAPE CANAVERAL, FLORIDA, ENTITLED; COMPREHENSIVE PLAN; BY PROVIDING AN EFFECTIVE DATE, ' MRS. CALVERT MOVED TO APPROVE SECOND READING, MR. LEE SECONDED MOTION, COUNCIL HAD BEFORE THEM THE LOCAL PLANNING AGENCYtS SUGGESTED CHANGES AND MINOR CHANGES THAT COUNCIL HAD MADE PRIOR TO THIS FINAL HEARING. THE PLAN WAS READ IN FULL (WITH THE EXCEPTION OF THE PREVIOUSLY ADOPTED TRAFFIC ELEMENT) AND MINOR EDITING CHANGES WERE MADE ALONG WITH THE RE- WORDING OF PARAGRAPH 3, PAGE 2 -22 TO READ AS FOLLOWS: "PROMOTE ADDITIONAL RESIDENTIAL.DEVELOPMENT OF SINGLE - FAMILY AND MULTI- FAMILY AREAS TO PROVIDE A BALANCE OF HOUSING OPPORTUNITIES. ENABLE COMMERCIAL AND INDUSTRIAL ZONED LANDS TO BE UPGRADED AND REZONED TO RESIDENTIAL ". ATTORNEY SCOTT ADVISED COUNCIL THAT ONCE THIS COMPREHENSIVE PLAN WAS ADOPTED THE ZONING ORDINANCE SHOULD BE REVIEWED TO COME INTO COMPLIANCE WITH THE PLAN. A SHORT DISCUSSION FOLLOWED BETWEEN COUNCIL, ATTORNEY SCOTT AND LOCAL PLANNING AGENCY MEMBER JOHN FOSTER REGARDING THE PROPOSED LAND USE MAP ON EXHIBIT AT THIS HEARING AND THE PROPOSED CHANGE WEST OF ROAD 401 TO THE SECTION LINE FROM COMMERCIAL TO RESIDENTIAL, MR. FOSTER POINTED OUT THAT HE HAD BEEN QUESTIONED BY CITIZENS REGARDING THE TENTATIVE CHANGE. ATTORNEY SCOTT POINTED OUT THAT IF THE PROPOSED LAND USE MAP WAS ADOPTED THAT THE BOARD PROBABLY COULD NOT MAKE THE CHANGE FROM RESIDENTIAL BACK TO COMMERCIAL, ATTORNEY SCOTT MENTIONED THAT EXISTING BUSINESS IN THE AREA IN QUESTION COULD BE GRANDFATHERED IN AS NON - CONFORMING USES. VOTE ON THE MOTION ON THE FLOOR. FOR ADOPTION PASSED UNANIMOUSLY. THE COMPREHENSIVE PLAN AND LAND USE MAP FOR THE CITY WAS ADOPTED AT SECOND PUBLIC HEARING ON ORDINANCE m MAYOR MRPHY -MOVED. TO ADJOURN AT 11 :07 P.M, MRS. BOYD SECONDED MOTION.
