FLORIDA 32920 IV TELEPHONE 305 763-1100 01I CAPE CANAVM 16, 1978 The Honorable Mayor and City Council Members City of Cape Canaveral 105 Polk Avenue Cape Canaveral, Florida Dear Mayor Thurm and Council Members: Upon a thorough investigation and review by me of all of the pertinent facts, I hereby recommend dismissal of Harry E. Keller, Building Official, based upon the following grounds and reasons: 1. Failure by Mr. Keller to comply with Section 231.11B and E of the City Code, in that he has failed to review with the City Manager certain programs and projects which affected the public interest, and further, that he has failed and refused to keep the City Manager advised as to the programs and projects of his office, specifically his handling of the Housing and Real Estate Inventory Project and location of the new City Library. 2. That he has knowingly and wilfully failed to comply with Sections 203.6.7.9.10 of the City Code, which is the Uniform Procedures Ordinance, by his repeated failure to furnish the City Clerk with documents, papers, letters or other public records for the purpose of being logged and otherwise recorded by the City prior to being mailed or otherwise distributed. Chapter 203 of the City Code was enacted to insure compliance by City Officials and employees with Chapter 119, Florida Statues, entitled '"The Public Records Act". 3. His failure to comply with Resolution 66-6 as amended, Sewer Regulations, in that he failed to notify the City Engineers that pertain sewer lines and hookups were in operation at both the North Electric building site and the Ocean Woods Project. In the Ocean Woods Project, certificates of occupancy were issued by Mr. Keller prior to an inspection and approval (continued) y MICROFILME.E) 4-24.8.0 Page 2 June 16, 1978 Mayor and City Council Members by the City Engineers of the sewer line, and in the North Electric project, the sewer line was actually in operation prior to the inspection by the City Engineers. As a result of the above items, it is my opinion that Mr. Keller should be dismissed, pursuant to the City's Personnel Policy (Ordinance 14-75, Sections IV. 5(c)) in that his attitude and deportment did not promote the goodwill and favorable attitude of the public toward the City administration and its programs (N. 9(d)) in that the activity described above constituted flagrant or persistent insubordination (IV. 9(h)) and certain of his acts as described above constituted a repeated neglect of duty. Therefore, it is recommended that the City Council dismiss Mr. Keller for the foregoing reasons. Respectfully submitted, aC4�4, a4�- Anita J. Ostrom City Manager
