SUBJECT: 211 CAROLINE STREET, CHANGE IN OCCUPANCY AND USE.
1. Please be advised that the below listed references apply to
the anticipated change in use and. occupancy, i.e: from night
club to library.

Fla. Statute Ch. 553, part -V.

2. The interpretations made through a careful examination of
these references is as follows:
A. The principal uses in the R -2 Zone, which includes 211
Caroline St., requires a special exception for a public library.
B. Thin change in occupancy from assembly (A) for night club
to business (B) for library does require a new certificate of
occupancy.
C. The requirements for performing work on existing buildings,
as stipulated by Standard Building Code, Para. 101.4 (e) wherein
an occupancy is entirely changed, does require bringing the
structure (or portion) into full compliance with the Code as. for
new buildings.
D. The accessibility for the handicapped is a minimum require-
ment per C above, and as outlined, with specifications, by Fla.
Statute 553 -Part V.
E. The City is required to obtain a permit (no fee) for the
alterations, repairs, improvements and occupancy change.
3. The interpretations made are the basis for the following decision:
In accordance with section 645.01 of Zoning Ordinance 10 -75
the Building Official hereby declares the City of Cape Canaveral
to be in violation of the Zoning Ordinance in that adequate
intent has been established and demonstrated.
A stop work order is hereby delivered for any illegal-work
being done or commenced prior to compliance with the Zoning
Ordinance.
This decision may be challenged as provided by Sec. 645.19 of
the Zoning Ordinance.
