Ostrom City Manager City of Cape Canaveral 105 Polk Avenue Cape Canaveral, Florida 32920 Re: Validity of bid from volunteer fireman Dear Anita: Cocoa Beach This is in response to your inquiry as to whether or not the City can accept a sealed bid for fire equipment in which the bidder is also a member of the Cape Canaveral Volunteer Fire Department. It is my opinion that the Volunteer Fire Department, based on Florida law, is an entity of the City, and that officers and employees of said department would be prohibited from doing business with that entity. Although the volunteer fire- man, in this case, is not a full time paid employee of the City or Fire Department, nevertheless he does receive drill pay from the City and, therefore, is considered an employee of the Fire Department, for conflict purposes. Section 112.313.12, Florida Statutes, provides an exemption and would permit the acceptance of this bid if the following conditions are met: (1) The business is awarded under a system of sealed competitive bidding to the lowest or best bidder; and (2) the employee - bidder has in no way participated in the determination of the bid specifications or determination of the lowest or best bid; and (3) the employee- bidder has in no way used or attempted to use his influence to persuade the agency (City of Cape Canaveral or Cape Canaveral Volunteer Fire Department) or any personnel thereof, to enter such a contract other than by the mere submission of the (continued) W Page 2 f' May 11, 1978 Mrs. Anita J.
