Canaveral Beach Garden Apts. Inc. has a building; available at 211
Caroline St., Cape. Canaveral, Fla. that would be ideal for the Cape
Canaveral Public Library. It has floor -,race of 4 ,800 sq. ft. (compared
to the present 3,000 sq. ft.), and it includes a conference room and
auditorium for movies, clubs and any activities for which the Library
and Ci tv has need. It also has a. 3,l4 s . ft. open pave patio area
in the back that can be used for outdoor classes ani reading. '
The building has been inspected by the Building; Inspector, City Planner
and Fire Chief and found to be in perfect condition.
The Lease cost for this location is $600.00

Re: Validity of bid from volunteer fireman
Dear Anita:

This is in response to your inquiry as to whether or not the City can accept a
sealed bid for fire equipment in which the bidder is also a member of the Cape
Canaveral Volunteer Fire Department.
It is my opinion that the Volunteer Fire Department, based on Florida law, is
an entity of the City, and that officers and employees of said department would
be prohibited from doing business with that entity. Although the volunteer fire-
man, in this case, is not a full time paid employee of the City or Fire Department,
nevertheless he does receive drill pay from the City and, therefore, is considered
an employee of the Fire Department, for conflict purposes.
Section 112.313.12, Florida Statutes, provides an exemption and would permit the
acceptance of this bid if the following conditions are met:
(1) The business is awarded under a system of sealed competitive bidding
to the lowest or best bidder; and (2) the employee - bidder has in no way
participated in the determination of the bid specifications or determination
of the lowest or best bid; and (3) the employee- bidder has in no way used
or attempted to use his influence to persuade the agency (City of Cape
Canaveral or Cape Canaveral Volunteer Fire Department) or any personnel
thereof, to enter such a contract other than by the mere submission of the

bid; and (4) the employee - bidder, prior to or at the time of submission of
the bid, has filed a statement with the Clerk of the Circuit Court for
Brevard County, Flcr ida, disclosing his interest and the nature of the
intended business.
If you are satisfied that the above four requirements have been met in this case,
then it would be proper for the City to accept this bid; otherwise, to accept the
bid would be a violation of the Code of Ethicsfv3r public officers and employees.
