A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY
OF CAPE CANAVERAL WAS HELD ON OCTOBER 17, 1972 AT THE CITY HALL,
105.POLK AVENUE, CAPE CANAVERAL, FLORIDA AT 7:30 P.M.
THE MEETING WAS CALLED TO ORDER BY MAYOR GEORGE H.
FIRKINS, JR.
ROLL WAS CALLED BY THE CITY CLERK. OFFICIALS PRESENT
WERE MAYOR FIRKINS; COUNCILMEN E. H. RHAME, A. M. RUTKOWSKI, G. J.
SALVAGGIO AND MRS. ANN THURM; CITY MANAGER A. J. FRANCIS; ASSIST"
ANT CITY ATTORNEY RICHARD SCOTT; CITY CLERK ANITA OSTROM AND SGT.
AT ARMS WILLARD WINNETT.
MINUTES OF THE MEETING OF OCTOBER 3, 1972 WERE APPROVED
BY MOTION OF MR. RUTKOWSKI, SECONDED BY MRS. THURM AND A UNANIMOUS
VOTE.
MITTED.
TREASURY REPORT FOR SEPTEMBER 1972 WAS APPROVED AS SUB-
UNFINISHED BUSINESS:
ITEM 1. ORDINANCE 19 -72 — AMENDING ZONING ORDINANCE 12 -71.

MAYOR FIRKINS READ THE ORDINANCE ENTITLED "AN ORDINANCE
AMENDING ORDINANCE NO. 12 -71 PERTAINING TO ZONING REGULATIONS;
PROVIDING AN EFFECTIVE DATE."
MR. RHAME THEN READ THE PROPOSED AMENDMENTS AS A PART OF
THE ABOVE ORDINANCE NO. 19 -72.
THE MOTION.
MR. RHAME MOVED FOR ADOPTION, AND MR. RUTKOWSKI SECONDED
MR. LYNN HANSEL, BREVARD COUNTY PLANNING DEPARTMENT,
GAVE A REPORT TO COUNCIL REGARDING POSSIBLE FUTURE GROWTH AND ITS
EFFECT ON THE SEWER FACILITIES. MR. TOM GROOVER WITH BREVARD ENG-
INEERING COMPANY AND FORMERLY WITH BRILEY, WILD S ASSOCIATES, ENG-
INEERS FOR THE CITY, ALSO GAVE A REPORT AS TO CAPACITY OF THE CITY
SEWER PLANT.
MR. RHAME MOVED TO AMEND THE ORDINANCE. (COPY OF AMEND-
MENTS ATTACHED). MR. SALVAGGIO SECONDED THE MOTION. MR. RUTKOWSKI
MOVED FOR A SECOND AMENDMENT TO ALLOW 15 UNITS PER ACRE, BUT THE
MOTION DIED FOR LACK OF A SECOND.
VOTE ON MR. RHAME'S AMENDMENT WAS AS FOLLOWS: FOR THE

MRS. THURM AND MR. RUTKOWSKI. THE MOTION CARRIED ADOPTING THE
AMENDMENTS.
MUCH DISCUSSION FOLLOWED FROM THOSE IN ATTENDANCE, BOTH
CITIZENS OF CAPE CANAVERAL AND DEVELOPERS.
VOTE ON THE MAIN MOTION, AS AMENDED, WAS AS FOLLOWS:
FOR - MR. SALVAGGIO, MR. RHAME AND MAYOR FIRKINS; AGAINST - MRS.
THURM AND MR. RUTKOWSKI. THE MOTION CARRIED AND THE ORDINANCE, AS
AMENDED,WAS ADOPTED.
AT ID:17 P.M., MR. SALVAGGIO MOVED TO ADJOURN. MRS. THURM
SECONDED. THE MOTION FAILED TO CARRY, WITH ONLY MR. SALVAGGIO AND
THE CHAIR VOTING IN FAVOR.
MR. RHAME QUESTIONED A BUILDING PERMIT WHICH HAD BEEN
ISSUED ON OCTOBER 16, 1972, AND STATED THAT THE STRUCTURES TO BE
CONSTRUCTED WOULD NOT COMPLY WITH THE ORDINANCE JUST PASSED. HE
FURTHER ANNOUNCED THAT HE WOULD APPEAL THE ADMINISTRATIVE DECISION
IF THE PERMIT WERE ALLOWED TO STAND AS ISSUED.
BY MOTION OF MR. SALVAGGIO, SECONDED BY MR. RHAME, THE
MEETING WAS ADJOURNED AT 10:32 P.M., WITH MR. SALVAGGIO, MR. RHAME,
MRS. THURM AND THE CHAIR IN FAVOR; MR. RUTKOWSKI ABSTAINED.
APPROVED THIS 7TH DAY OF NOVEMBER 1972.
