REGULAR MEETING
CITY COUNCIL
January 4, 1972
A Regular Meeting of the City Council of the City of
Cape Canaveral was held on January 4, 1972 at the City Hall, 105
Polk Avenue, Cape Canaveral, Florida at 7:32 P.M.
The meeting was called to order by Mayor George H. Firkins.
The roll was called by the City Clerk. Officials present
were Mayor Firkins; Councilmen Roger Graefe, Leo Nicholas -, E. H. Rhame,
G. J._Salvaggio; City Manager A. J. Francis; City Attorney Stanley
Wolfman; City Clerk Anita Ostrom and Sgt. at Arms Willard Winnett.
The minutes of the Regular Meeting of December 21, 1971
were-read by the Clerk and approved as read.
UNFINISHED BUSINESS:
Item 1. Ordinance 22 -71 — Amending Sign Ordinance (2nd
reading)
Mr. Rhame moved to take this item from the table. Mr.
Nicholas seconded and the motion carried.
Mayor Firkins read the ordinance entitled "AN ORDINANCE
AMENDING AN ORDINANCE REGULATING THE LOCATION, CONSTRUCTION, SIZE
AND MAINTENANCE OF SIGNS, ETC., ADOPTED MARCH 30, 1965, BY PROHIBITING
SIGNS ON VACANT LOTS; BY PROVIDING CERTAIN EXCEPTIONS, ENFORCEMENT
PROCEDURES, AND EFFECTIVE DATE."
Mr. Nicholas moved for adoption. Mr. Rhame seconded.
Mr. Rhame moved to amend the ordinance by inserting the words "sign
owner and property owner" wherever property owner appeared. The
motion was seconded by Mr. Nicholas and carried by unanimous vote.
The vote to adopt the ordinance as amended was unanimous.
Item 2. Ordinance 23 -71 - Escape Penalties (2nd reading)
Mayor Firkins read the ordinance entitled "AN ORDINANCE
RELATING TO AN ESCAPE FROM JAIL OR CUSTODY, PROVIDING FOR PENALTY,
PROVIDING AN- EFFECTIVE DATE."
By motion of Mr. Salvaggio, seconded by Mr. Graefe, and
unanimous vote of Council, second reading was approved and the
ordinance was adopted.
Item 3. Resolution 71 -42 - Proposed Law Enforcement
Changes
Mayor Firkins read the resolution entitled "A RESOLUTION
SUPPORTING THE PROPOSED CHANGES IN LAW ENFORCEMENT WITHIN BREVARD-
COUNTY, WITH EXCEPTION, AS SUBMITTED BY THE BREVARD COUNTY CHIEFS OF
POLICR ASSOCIATION.
Mr. Nicholas moved to take the item from the table.
Mr. Salvaggio seconded and the motion carried.

Motion to adopt was made by Mr. Nicholas, seconded by
Mr. Salvaggio and carried by unanimous vote of Council.
NEW BUSINESS:
Item 1. Resolution 72 -1 - re: Four laning U.S. 192.
Mayor Firkins read the resolution entitled "A RESOLUTION
URGING OFFICIALS OF THE STATE OF FLORIDA AND THE STATE DEPARTMENT
OF TRANSPORTATION TO APPLY NECESSARY URGENCY TO THE FOUR - LANING OF
U.S. 192.
Mr. Salvaggio moved to adopt the resolution. Mr. Rhame
seconded the motion. Mayor Firkins, Mr. Rhame, Mr. Salvaggio and
Mr. Graefe voted in favor, Mr. Nicholas against and--the motion
carried.
Item 2. Ordinance 1 -72 - Uniform Traffic Law
Mayor Firkins read the ordinance entitled "AN ORDINANCE
SUPPLEMENTING CHAPTER 316, FLORIDA STATUTES, KNOWN AS THE FLORIDA
UNIFORM TRAFFIC CONTROL LAW BY PROVIDING FOR PROCEDURES ON ARREST
AND AUTHORITY TO IMPOUND OR REMOVE VEHICLES; PROVIDING AN EFFECTIVE
DATE."
Mr. Nicholas moved that this ordinance be passed on an
emergency basis, on the advise of the City Attorney and the Chief of
Police. Mr. Rhame seconded the motion and the vote of Council was
unanimous.
Mr. Salvaggio moved to approve first and second reading of
the emergency ordinance, and first reading as a permanent ordinance.
Mr. Graefe seconded and the motion carried by unanimous vote.
Mr. Lawrence Fleckinger asked Council to permit an increase
in garbage collection rates of 25¢ for single family residences and
10¢ per yd. on commercial customers.
Mr. Franklin Maclay reported to Council on the status of
emergency dredging to be done by the Corp of Engineers.
By motion of Mr. Salvaggio, seconded by Mr. Rhame, the
meeting was adjourned at 9:01 P.M.
