HomeMy WebLinkAbout08-17-1971 Regular MeetingM MICROFILMED 4.24.80 REGULAR MEETING CITY COUNCIL August 17, 1971 A Regular Meeting of the City Council of the City of Cape Canaveral was held on August 17, 1971 at the City Hall, 105 Polk Avenue, Cape Canaveral, Florida at 7:30 P.M. The meeting was called to order by Mayor George H. Firkins,Jr. The roll was called by the City Clerk. Officials present were Mayor Firkins; Councilmen Roger Graefe, Leo Nicholas and E. H. Rhame; City Manager A. J. Francis; City Attorney Stanley Wolfman; City Clerk Anita Ostrom and Sgt. at Arms Officer Ford. The minutes of the Regular meeting of August 3, 1971 were read by the Clerk and approved as read. The Treasury Report for the month of July, 1971 was approved as submitted. OLD BUSINESS: Item 1. Resolution 71 -31 - Animals on Beach (tabled 8 -3 -71) Mr. Nicholas moved to take the resolution from the table. Mr. Graefe seconded and the motion carried by unanimous vote. After some discussion, Mr. Nicholas moved to re -table the resolution. Mr. Rhame seconded and the motion carried. NEW BUSINESS: Mr. Rhame moved to add an item to the agenda. Mr. Graefe seconded and the motion carried by unanimous vote. Mr. Rhame moved to name the item "Ordinance 14 -71 amending Ordinance 10 -70 re: Animal Control. Mr. Nicholas seconded and the motion carried. Item 1. Ordinance 14 -71 - Amending Ord. 10 -70 re: Animal Control 1st reading) Mr. Wolfman read the ordinance entitled "AN ORDINANCE AMENDING ORDINANCE NO. 10 -70 TO ESTABLISH HOURS THAT ANIMALS SHALL BE PERMITTED IN THE DESIGNATED AREA COVERED BY THE ANIMAL CONTROL ORDINANCE." Mr. Rhame moved to approve first reading. Mr. Nicholas seconded. Discussion followed with comments from interested parties. Comments are attached and made a part of these minutes. Mr. Nicholas, Mr. Graefe and Mr. Rhame voted in favor of the motion for approval of first reading; Mayor Firkins opposed and the motion carried. Mr. Nicholas moved to name the item "Resolution No. 71 -33 - Appointment of Beautification Board Member." Mr. Rhame seconded. Both motions carried by unanimous vote of Council. Item 2. Resolution 71 -33 - Appointment of Beautification Board Nem er Mayor Firkins read the resolution entitled "A RESOLUTION APPOINTING A MEMBER TO THE BEAUTIFICATION BOARD; PROVIDING AN EFFECTIVE DATE." By motion of Mr. Nicholas, seconded by Mr. Rhame and unanimous vote of Council, the resolution was adopted naming Mrs. Virginia Valluzzi to the Board. By motion of Mr. Rhame, seconded by Mr. Graefe, the meeting was adjourned at 9:17'P.M. City Clerk APPROVED this 7th day of September 1971. PAGE z OF* MICROFILMED 4 -24 -80 COMMENTS RE: ANIMALS ON BEACH A petition was presented with 1,3.E signatures opposing animals on the beach, and it was noted that another petition had been presented at work shop with signatures of those in favor of no control or limitation of animals on the beach. 1. Can we permit animals on the beach from October through March, all day. Very few people use the beach in the winter time. 2. Does this ordinance comply with the animal control, as far as requiring animals to be leashed? 3. Animals need exercise and can not get it on a leash. 4. What is the purpose or benefit of hours for animals on the beach? High tide does not wash away defecation and our beaches should be kept clean. The beach is our main tourist attraction. 5. Tourists bring their dogs and should be able to take them to the beach. Motels advertise to bring your pets and we should utilize our facilities to the fullest extent. Very few people on the beach after 7:00 P.M. Apartments have regulations against animals defecating on the grounds, it is against the animal control to use the city streets; where can they go? 6. Dr. Tomas of the County Health Department was asked to comment regarding the health aspect of animals. His comments were as follows: The problem is spread of disease. Parasites remain where animals go through the feces, and could live in the hot summer sun for around 5 days and longer if in the shade. It is possible for salt water to kill them, if concentrated. Fish have few diseases and they are not transmittable to humans Flies are a very big.problem as they transmit diseases. Other animals, as well as dogs should be controlled. 7. We want to be able to take our dogs to the beach for exercise as they are not allowed on the streets. 8. Going to the beach with the dog is a form of family recreation; parents, children and animal all enjoy this play together. 9. A suggestion was made that owners carry a scoop with them to the beach, and the animals could have their exercise if the owner would clean up after them. Mr. Nicholas pointed out that animals must be leashed and were not permitted to defecate on the beach, according to the present law. PAGES OF 31 MICROFILMED 4 -24 -80 10. Mrs. Barbara DeVeau asked that regulations be changed to allow animals on the beach at anytime between the months of October and March, and that they would abide by the 7 to 7 regulation for the remainder of the year. 11. Mr. B. B. Purcell stated that in the 23 years he had lived here on the beach, people swim all year long, and that seasonal laws would not be good. All regulations should be year round. 12. Mr. John Osborne asked that dogs be allowed to run off a leash at night for exercise. PAGE* OFD►
