A Regular Meeting of the City Council of the City of
Cape Canaveral was held on August 3, 1971 at the City Hall, 105 Polk
Avenue, Cape Canaveral, Florida at 7:30 P.M.
The meeting was called to order by Mayor George H. Firkins,Jr.
The roll was called by the City Clerk. Officials present
were Mayor Firkins; Councilmen Roger Graefe, Leo Nicholas, E. H. Rhame
and G. J. Salvaggio; Assistant City Attorney Richard Scott; City Clerk
Anita Ostrom and Sgt. at Arms Willard Winnett. Lynn Hansel, of the
County Planning Department was also in attendance.
The minutes of the regular meeting of July 20, 1971 were
read by the Clerk and approved as read.

OLD BUSINESS:
Item 1. Ordinance 11 -71 - Regulating Trucks on City Streets
(2nd rea 1ng)
This item was moved to the end of the agenda by unanimous
Item 2. Ordinance 12 -71 - Comprehensive Zoning Ordinance
(2nd reading)
Due to the length of this ordinance, it was agreed to cover
the balance of the agenda and come back to this item.
Item 3. Ordinance 13 -71 - Bird Sanctuary (2nd reading)
Mayor Firkins read the ordinance entitled "AN ORDINANCE
DESIGNATING THE CORPORATE LIMITS OF THE CITY OF CAPE CANAVERAL., FLORIDA
AS A BIRD SANCTUARY."
By motion of Mr. Nicholas, seconded by Mr. Salvaggio and
unanimous vote of Council, the ordinance was adopted.
NEW BUSINESS:
Item 1. Motion to approve withdrawal of Renewal & Replacement
Funds
Payment of bills in the total amount of $442.50 was approved
by motion of Mr. Salvaggio, seconded by Mr. Nicholas and unanimous
vote of Council.
Item 2. Resolution 71 -31 - Animals on Beaches.
Mayor Firkins read the resolution entitled "A RESOLUTION
DESIGNATING BEACHES IN THE CITY OF CAPE CANAVERAL, FLORIDA, ON WHICH
ANIMALS ARE SPECIFICALLY PROHIBITED."
By motion of Mr. Salvaggio, seconded by Mr. Graefe and a
unanimous vote, this item was tabled to the next meeting. Interested

parties were invited to attend the next workshop on August 12, 1971.
Item 3. Resolution 71 -32 - re: Jetty Park Development
Mayor Firkins read the resolution entitled "A RESOLUTION
URGING THE BREVARD COUNTY BOARD OF COUNTY COMMISSIONERS TO RESCIND
ITS ACTION REGARDING THE,DEVELOPMENT OF CAMPING FACILITIES AT JETTY
PARK."
Paragraph 2 was removed from the resolution, as it was
repetitious. By motion of Mr. Salvaggio, seconded by Mr. Rhame and
unanimous vote, the resolution was adopted, as amended.
OLD BUSINESS ITEMS:
Item 2. Ordinance 12 -71 - Comprehensive Zoning Ordinance
2nd reading)
Mayor Firkins read the title of the ordinance "AN ORDINANCE
ESTABLISHING COMPREHENSIVE ZONING REGULATIONS FOR THE CITY OF CAPE
CANAVERAL, FLORIDA, AND PROVIDING FOR THE ADMINISTRATION, ENFORCEMENT
AND AMENDMENT THEREOF, IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 176,
FLORIDA STATUTES, AND FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT
HEREWITH."
Mr. Scott gave to the Mayor the final report from the Zoning
Commission. Mayor Firkins read the report to Council.
Mayor Firkins proceeded with the reading of the ordinance, as
required by Charter. Mr. Nicholas assisted and 78 pages of the
ordinance were covered. Corrections and amendments were read into
each page, where necessary.
At 10:00 P.M., Mr. Salvaggio moved to recess the meeting to
Wednesday, August 4, 1971 at 6:00 P.M. Mr. Rhame seconded and the
motion carried by unanimous vote.

The meeting reconvened at 6:05 P.M.
Officials present were Mayor George H. Firkins, Jr.,
Councilmen Roger Graefe, Leo Nicholas and E. H. Rhame; Assistant City
Attorney Richard Scott; City Clerk Anita Ostrom; and County Planner
Lynn Hansel.
The balance of the Zoning Ordinance 12 -71 was read by Mayor
Firkins and Mr. Rhame. Mr. Rhame moved to adopt the ordinance, as
amended. Mr. Nicholas seconded and the motion carried by unanimous vote
of Council,
Item 1. (Old business) Ordinance 11 -71 - Regulating Trucks
on City Streets (2nd rea ing)
Mr. Rhame moved to take this item from the table. Mr.
Nicholas seconded and the motion carried. Mr. Nicholas moved that
Ordinance 11 -71, regulating trucks on City streets not be adopted.

Mr. Rhame seconded and the vote was unanimous against adoption.
By motion of Mr. Rhame, seconded by Mr. Nicholas, the meeting
was adjourned at 8:50 P.M.
