CITY COUNCIL
July 20, 1971
A Regular meeting of the City Council of the City of
Cape Canaveral was held on July 20, 1971 at the City Hall, 105 Polk
Avenue, Cape Canaveral, Florida at 7:30 P.M.
The meeting was called to order by Mayor George Firkins,Jr.
The roll was called by the City Clerk. Officials present
were Mayor Firkins; Councilmen Roger Graefe, Leo Nicholas, E. H. Rhame,
and G. J. Salvaggio; City Manager A. J. Francis; City Attorney Stanley
Wolfman; City Clerk Anita Ostrom and Sgt. at Arms Chief Winnett.
The minutes of the regular meeting of July 6, 1971 and the
Board of Adjustment meeting of July 6, 1971 were read by the Clerk
and approved as read.
The Treasury Report for June 1971 was approved as submitted.
OLD BUSINESS:
Item 1. Ordinance 10 -71 - Rules of Procedure of Zoning
& Planning:Board (2nd reading)
Mayor Firkins called for a motion to take this item from
the table. The item died for lack of such motion. Air. Rhame explained
the reason for not passing this ordinance was conflict with the prop-
osed new zoning ordinance.
Item 2. Ordinance 11 -71 - Regulating trucks on City Streets
(2nd reading)
Mayor Firkins read the ordinance entitled "AN ORDINANCE
PROHIBITING CERTAIN TRUCKS, TRUCK - TRACTORS, and SEMI - TRAILER TRUCKS
FROM OPERATING OR BEING DRIVEN ON STREETS WITHIN THE CITY OF CAPE
CANAVERAL, FLORIDA; ESTABLISHING CERTAIN EXCEPTIONS, PROVIDING PEN-
ALTIES; PROVIDING AN EFFECTIVE DATE."
Mr. Salvaggio moved to adopt the ordinance. Mr. Rhame
seconded. Mr. Irving Nathanson, Attorney, representing Don Clayton
owner of Don's Dormitory, and E. G. & Gladys Kendall, owners of the
Moon Hut, talked to Council objecting to this ordinance as being
discriminatory and a detriment to their businessess. A possible truck
route was suggested by Chief Winnett whereby trucks could enter these
business locations, via Madison, Poinsetta and Jackson Avenues.
By motion of Mr. Salvaggio, seconded by Mr. Rhame, this item was tabled.

Item 3. By motion of Mr. Rhame, seconded by Mr. Salvaggio,
this item was moved to the last item of business on the agenda.
NEW BUSINESS:
Item 1. Road & Bridge Funds
Mr. Nicholas moved to authorize the City Manager to notify
the Board of County Commissioners, by letter, that the City wished
to receive fifty percent share of Road $ Bridge funds in lieu of
services for the fiscal year 1971 -1972. Mr. Salvaggio seconded and
the motion carried by unanimous vote of Council.
Item 2. Ordinance 13 -71 - Bird Sanctuary (1st reading)
Mayor Firkins read the ordinance entitled "AN ORDINANCE
DESIGNATING THE ENTIRE AREA WITHIN THE CORPORATE LIMITS OF THE CITY
OF CAPE CANAVERAL, FLORIDA AS A BIRD SANCTUARY."
First reading was approved by motion of Mr. Nicholas,
seconded by Mr. Firkins and unanimous vote of Council.
By motion of Mr. Rhame, seconded by Mr. Salvaggio, the
meeting was recessed at 8:20 P.M. until after a meeting of the
Zoning Commission.
The meeting reconvened at 9:25 P.M.
OLD BUSINESS: Item 3. Comprehensive Zoning Ordinance F Map (lst reading;
Mr. Nicholas moved to approve first reading contingent upon

the City Attorney /incorporating into the ordinance the recommended
changes from the Zoning Commission*%* Mr. Salvaggio seconded the motion
and it carried by unanimous vote of Council.
By motion of Mr. Salvaggio, seconded by Mr. Rhame the
meeting was adjourned at 9:28 P.M.
