HomeMy WebLinkAbout07-06-1971 Regular MeetingMICROFILMED 4.24 -80 REGULAR MEETING CITY COUNCIL July 6, 1971 A Regular Meeting of the City Council of the City of Cape Canaveral was held on July 6, 1971 at the City'Hall, 05 Polk Avenue, Cape Canaveral, Florida at 7:37 P.M. The meeting was called to order by Mayor George Fi kins,Jr. The roll was called by the City Clerk. Officials p esent were Mayor Firkins; Councilmen Roger Graefe, Leo Nicholas, E. H. Rhame and G. J. Salvaggio; City Manager A. J. Francis; Assistant City Attorney Richard Scott; City Clerk Anita Ostrom and Sgt. at Arms Officer Ramsey. The minutes of the Regular meeting of June 15, 1971 were approved as read by the Clerk. OLD BUSINESS: Item 1. Resolution 71 -26 - Areas of Interest of Councilmen Mayor Firkins read the resolution entitled "A RESOLUTION DESIGNATING AREA OF DIRECT INTEREST OF INDIVIDUAL COUNCILMEN; PROVIDING AN EFFECTIVE DATE." Nominations and elections were made as each section was read, as follows: Section 1 -Mr. Salvaggio nominated Mayor Firkins. Mr. Nicholas seconded. Nominations were closed by motion of Mr. Salvaggio, and Mr. Firkins was named to this area of interest. Section 2 -Mr. Rhame nominated Mr. Nicholas. Mayor Firkins seconded. Mr. Nicholas nominated Mr. Rhame. Mr. Salvaggio seconded. Nominations were closed by motion of Mr. Salvaggio. Mayor Firkins and Mr. Rhame voted in favor of Mr. Nicholas; Mr. Nicholas, Mr. Graefe and Mr. Salvaggio in favor of Mr. Rhame and Mr. Rhame was elected. Section 3 -Mr. Nicholas nominated Mr. Salvaggio. Mr. Graefe seconded. Nominations were closed by motion of Mr,. Rhame, and Mr. Salvaggio was elected. Section 4 -Mr. Salvaggio nominated Mr. Nicholas. Mr. Graefe seconded. There being no other nominations, Mr. Nicholas was elected by unanimous vote. Section 5 -Mr. Salvaggio nominated Mr. Graefe. Mayor Firkins seconded—Nominations were closed by motion of Mr. Salvaggio and Mr. Graefe was elected. Ordinance 10 -71 - Rules of Procedure of Zoning and Planning Board (2n red ing) Mayor Firkins read the ordinance entitled "AN ORDINANCE PRESCRIBING RULES OF PROCEDURE FOR THE ZONING AND PLANNING BOARD OF THE CITY OF CAPE CANAVERAL, FLORIDA; PROVIDING AN EFFECTIVE DATE, REPEALING ORDINANCE NO. 22 -65 AND ORDINANCE NO. 22 -65 -A. Mr. Salvaggio moved to adopt the ordinance. Mr. Graefe seconded. Questions arose as to conflict between parts of this ordinance and the new zoning ordinance regarding public hearing procedures. By motion of Mr. Rhame, seconded by Mr. Nicholas and unanimous vote of Council, the ordinance was tabled. NEW BUSINESS: Item 1. Ordinance 11 -71 - Regulating Trucks on City Street! 1st reading Mayor Firkins read the ordinance entitled "AN ORDINANCE PROHIBITING CERTAIN TRUCKS, TRUCK - TRACTORS, and SEMI - TRAILER TRUCKS FROM OPERATING OR BEING DRIVEN ON STREETS WITHIN THE CITY OF CAPE CANAVERAL, FLORIDA; ESTABLISHING CERTAIN EXCEPTIONS, PROVIDING PENALTIES; PROVIDING AN EFFECTIVE DATE." Mr. Rhame made the motion, Mr. Salvaggio seconded and by unanimous vote the ordinance was approved on first reading. Item 2. Ordinance 12 -71 - Comprehensive Zoning Plan & Ma 1st reading) Mayor Firkins announced that copies of this ordinance were available in City Hall for reading. Mr. Hansel of the County Plann- ing department noted that there were copies of certain sections available at this meeting for those interested. The floor was then opened for discussion. Questions and answers which followed --are attached and a part of these minutes. After the discussion, Mr. Rhame moved to table first reading. Mr. Nicholas seconded and by unanimous vote, first 'reading was tabled to July 20, 1971. Second reading would then follow can August 3, 1971. Item 3. Resolution 71 -29 - Bicycles and Bikeways Mayor Firkins read the resolution entitled "A RESOLUTION SUPPORTING A SYSTEM OF BIKEWAYS THROUGHOUT BREVARD COUNTY, FLORIDA FOR THE PURPOSE OF ATTRACTING AND ENCOURAGING SAFE BICYCLING; PROVIDING AN EFFECTIVE DATE." Mr. Nicholas explained the need for such a program, most particularly in regard to safety. By motion of Mr. Nicholas„ second by Mr. Rhame and unanimous vote of the Council, the resolution was adopted. Resolution 71 -30 - A pointment of Zoning Board Member Mayor Firkins read the resolution entitled "A RESOLUTION APPOINTING A MEMBER TO THE ZONING AND PLANNING BOARD; PROVIDING AN EFFECTIVE DATE." By motion of Mr. Salvaggio, seconded by Mr. Rhame and unanimous vote, the resolution was adopted naming Mr. Walter T. Burkett to the Board. By motion of Mr. Salvaggio, seconded by Mr. Graefe, the meeting was adjourned at 9:15 P.M. APPROVED this .20 4 day of 4 1971. � �- � J, C)"', r� � City Clerk Num d, MICROFILMED 4 -24 -80 COMMENTS QUESTIONS AND ANSWERS RE: ZONING ORDINANCE new business -Item 2 Q - What about the existing buildings under the new ordinance? A - They will become non - conforming if they do not meet the new regulations. Could not be added to, or reconstructed without special consideration. Q - On a non - conforming property, could the parking lot be re- surfaced? A - Yes, parking area does not enter into lot coverage. Q - Is new R -2 the same as old R -3? (Emily Sturm) A - Yes,.same uses Mr. Nicholas recommended that everyone come to City Hall to read the available copies and get their requested changes to the Board prior to second reading. Q - What is the reason for change from R -4 to R -3? (Jack Korenblit) A - It is more a change in the number, however there are some changes in regulations. Mr. Nicholas pointed out some of the changes being considered in the ordinance: 1. Belcher Oil property to M -3 2. C -1 extended as buffer zone between residential and Beach & Industrial property in north end. 3. Extension of R -3 to the north 4. Use in C -1 to allow apartments & condominiums. He stated that all recommendations are welcome. Mr. Rhame - stated that old ordinance 81 -64 had many conflict! and errors which the Board had tried to polish and found the task too great. Mr. Jack Korenblit asked that Council consider the following: 1. Change to R -3 the area north of Washington and West of Ridge- wood. 2. Lift the limitation on height of Bldgs. in R -2 Mr. Rhame stated that R -2 gives more latitude north of the school than does the present zoning. Q - If a residence is non - conforming, will it become obsolete? A - No, but it could norbe altered or replaced. Schedule of termination only in commercial $ industrial areas and not on residences. This is an effort to improve & beautify the City and will take years to accomplish. Q - Isn't 15,000 sq. ft. requirement for R -1 -A housing rather strict? (Joe Manfe) A - R -1 -A is concerning $25,000 to $30,000 homes and there is no R -1 -A on the map, but can be built in any area if lot is large enough. Mr. Cy Luley offered objection to C -1 expansion into M -2 and asked if formal action would be taken at this meeting. Mr. Nicholas explained that the map was to be redrawn - M -2 to include M -3 and C -1 will be the same as now except extended as a buffer line only. Q - Mrs. Sturm asked for explanation of regulation on outside displays on page 30, did not think it was clear A - The idea was to have shops with displays in an Arcade or Mall, and no window displays showing on the street, Mr. Rhame stated: R 11 ICROFILMED 4.24 -80 Q - Mr. Manfe asked about specifications for sidewalks and suggested 5 ft. on Ridgewood and 3 ft. on all other streets. A - Specs will be set up in the building department and belong in the building code, not the zoning ordinance. They would be built on right of way and not affect set backs of buildings. Q - Mr. Parks, of Loma Linda, asked about existing trailer parks. A - They will be con - conforming and cannot be enlarged. Mr. Nicholas reiterated the prime reasons for changes as follows: 1. Planned unit development with underground utilities. Z. New construction to include sidewalks 3. Delete requirement for notification of property owners in public hearings.as,,it is expensive. 4. Board of adjustment to hold public hearings so the Public need not attend two meetings and thereby save time. S. No public hearing requirement on alcoholic beverage permit. City only concerned with zoning and the Building Official can cover this. The County does require public hearings but the City will not. 6. Schedule of abatement of non - conforming uses.
