HomeMy WebLinkAbout03-02-1971 Regular MeetingA r MICROFILMED 4 -24 -80 REGULAR MEETING CITY COUNCIL March 2,1971 A Regular Meeting of the City Council of the City of m Cape Canaveral, was held on March 2, 1971 at the City Hall, 105 Polk ,,- Avenue, Cape Canaveral, Florida at 7:35 P.M. The meeting was called to order by Mayor Leo Nicholas. The roll was called by the City Clerk. Officials present were Mayor Nicholas; Councilmen George Firkins, E. H. Rhame, G. J. Salvaggio and Richard Thurm; City Manager A. J. Francis; Assistant City Attorney Richard Scott; City Clerk Anita Ostrom and Sgt. at Arms Willard Winnett. The minutes of the Regular Meeting of February 16, 1971 were read by the Clerk and approved as read. Item 1. This item was tabled by motion of Mr. Salvaggio, seconded by Mr. Rhame and unanimous vote of the Council. Item 2. Resolution 71 -7 - Participation in PAFB Credit Union Mayor Nicholas read the resolution entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, FLORIDA, AUTHOR- IZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT ON BEHALF OF THE CITY OF CAPE CANAVERAL, FLORIDA, WITH THE PATRICK AIR FORCE BASE CREDIT UNION TO PROVIDE FOR CERTAIN PAYROLL DEDUCTION PLANS FOR CITY OF CAPE CANAVERAL EMPLOYEES AND OTHER PRACTICES RELATIVE TO THE SAVING AND LENDING FUNCTIONS OF SAID CREDIT UNION; PROVIDING AN EFFECTIVE DATE." By motion of Mr. Rhame, seconded by Mr. Firkins and unanimous vote, the resolution was adopted. Item 3. Appointment of Pension Committee. Mr. Salvaggio moved to appoint Mr. A. J. Francis, City Manager, Mr. Stanley Wolfman, City Attorney and Mr. Roger Dobson, City Auditor as members with Mr. E. H. Rhame as ex- officio member. Mr. Firkins seconded and the motion carried by unanimous vote of Council. Item 4. Resolution 71 -8 - Single Registration with County Mayor Nicholas read the resolution entitled "A RESOLUTION OF THE CITY OF CAPE CANAVERAL, FLORIDA, ADOPTING THE COUNTY PERMANENT SINGLE VOTER REGISTRATION SYSTEM FOR THE REGISTRATION OF THE CITY ELECTORS TO QUALIFY THEM TO VOTE IN ALL ELECTIONS." By motion of Mr. Salvaggio, seconded by Mr. Thurm and unanimous vote of Council, the resolution was adopted. i�_. - P Ao t I op 3 MICROFILMED 4 -24 -80 Item 5. Repository for Flood Insurance and Flood Hazard Maps. Ar. Firkins moved to name the City Hall as repository for these maps. Mr. Salvaggio seconded and the motion carried by unan- imous vote of Council. Item 6. Ordinance 3 -71 - Amending Pornographic Literature Ordinance (1st reading) Mayor Nicholas read the ordinance entitled "AN ORDINANCE ADOPTING CHAPTER 847, FLORIDA STATUTES, TITLED "OBSCENE LITERATURE; PROFANITY" PROHIBITING CERTAIN ACTS IN CONNECTION WITH OBSCENE, LEWD, ETC., MATERIALS AND PROVIDING A PENALTY; PROVIDING AN EFFECTIVE DATE." Several Local Citizens were in attendance to voice their objections to licensing of some new businesses in the City, and to urge Council to use any legal method to prevent their operation. Among those present were Clifford VanWagner, Mrs. Raymond Nyce, Mrs. Wayne Kohout, Mrs. Walter Nyren, Mr. & Mrs. P. A. Scabarozi and Reverend R. Hooks , of the Baptist Church. Brevard County Solicitor Jerrold Bross explained the difficulty in prosecuting charges of pornography and obscenity. Resolution 71 -9 - Authority to sign permits Mayor Nicholas read the resolution entitled "RESOLUTION AUTHORIZING CITY MANAGER TO SIGN APPLICATIONS FOR PERMITS TO CONSTRUCT AND OPERATE WATER POLLUTION SOURCES; PROVIDING FOR AN EFFECTIVE DATE." Mr. Rhame moved to adopt the resolution, Mr. Thurm seconded and by unanimous vote the motion carried. . FAGEQ OF3 A 9 MICROFILMED 4 -24 -80 Item 8. Ordinance 4 -71 - Amending 81 -64 (lst reading) Mayor Nicholas read the ordinance entitled "AN ORDINANCE AMENDING ORDINANCE NO. 81 -64 BY DELETING CERTAIN USES PERMITTED IN C -1 DISTRICT: PROVIDING AN EFFECTIVE DATE." Mr. Salvaggio moved to approve first reading. Mr. Thurm seconded. Mr. Salvaggio made a motion to amend by deleting Drive -In Theaters from C -2 district, in Article V, Section 7, Subsection 1. �Ar. Thurm seconded the motion, and it carried by unanimous vote. Vote in favor of the main motion was unanimous and first reading was approved, as amended. y Mr. P. A. Scabarozi read a letter to Council regarding Jetty Park, a copy of which is attached to these minutes. Also attached is a copy of a letter from the Cape View PTA Executive Board re: Mini Theaters and X -rated Book Stores. a Mr. Rhame moved to add an item to the agenda. Mr. Firkins seconded. Mr. Rhame moved to name the item "Appointment of Zoning Commission ". Mr. Firkins seconded and both motionscarried by unan- imous vote. Mayor Nicholas read the resolution entitled "A RESOLUTION APPOINTING A ZONING COMMISSION; PROVIDING AN EFFECTIVE DATE." Mr. Rhame made the motion to adopt the resolution naming the present Planning F Zoning Board and the City Council as members of the Zoning Commission. Mr. Salvaggio seconded and the motion carried by unanimous vote. By motion of Mr. Rhame, seconded by Mr. Firkins, the meeting was adjourned at 10:15 P.M. APPROVED this day of 1971. i y Cler . If we are to be honestly concerned'about the welfare of children and youth, we must assume a commitment to the condi- tions of their environment. An unpleasant and disturbing aspect of environmental quality is pornography in all of its forms. Some bookstores and theaters have gone beyond the ;lines of decency. Although it is aimed for adults, it spill's over into, the hands of children. If we should tolerate these places without saying a word, our younger generation would accept them without resistance. Again, we support and urge you to continue-in your efforts. February 28th there were 25 vehicles, mostly cars in Jetty Park, and 28 in the Port Areas, mostly recreational vehicles. We want these people to know that it is only natural for them to want something Free. We wish we could live free and pay no taxes too. But I wonder if they realize that they are being used as pawns. If the existing private enterprise parks are run out of business they will probably be paying $5,00 per night to park at Jetty Park. Private enterprise is based on competition among themselves, I raised my hand back in May 1941 to protect the Constitution of theUnited States. We fought for this and won. Now we want the people who swore to uphold the Constitution to carry out their oath. The only other thing is that our story is not being told by the news media. We had only one editor here the last time. I can sa7 this that if he had the County giving away newspapers and advertisements fuse for almost two years he would not be in business now.
