REGULAR MEETING
CITY COUNCIL
October 20, 1970
A Regular Meeting of the City Council of the City
of Cape Canaveral was held on October 20, 1970 at the City Hall,
105 Polk Avenue, Cape Canaveral, Florida at 7:38 P.M.
The Meeting was called to order by Mayor Leo Nicholas.
The roll was called by the City Clerk. Officials
present were Mayor Nicholas; Councilmen Charles Berkebile, George
Firkins and Richard Thurm; City Manager A. J. Francis; City Attorney
Stanley Wolfman; City Clerk Anita Ostrom and Sgt. at Arms Willard
Winnett.
Minutes of the Regular Council meeting and the Board
of Adjustment meeting of October 6, 1970 were read by the Clerk and
approved as read.
The Treasury Report for the month of September, 1970
was approved as submitted by motion of Mr. Berkebile and second by
Mr. Firkins.
OLD BUSINESS:
Item 1. Resolution 70 -31 - Port Fire Fighting Agreement
By motion of Mr. Berkebile, seconded by Mr. Thurm and
unanimous vote, this item was tabled.
Item 2. Ordinance 8 -70 - Amendment to Alcoholic Beverage
Ordinance (2nd reading
Mayor Nicholas read the ordinance entitled "AN ORDINANCE
AMENDING ORDINANCE 6 -63 -A, AS AMENDED, REPEALING SECTION 2B, WHICH
REQUIRES THE CLOSING OF ALL BAR ROOMS, SALOONS, COCKTAIL LOUNGES
AND OTHER PLACES WHICH SELL ALCOHOLIC BEVERAGES AT RETAIL, AND WHICH
PROHIBIT THE SALE OF ALCOHOLIC BEVERAGES AT RETAIL WITHIN THE CITY
OF CAPE CANAVERAL, FLORIDA, WHILE THE POLLS ARE OPEN FOR ANY STATE,
COUNTY, MUNICIPAL, GENERAL OR PRIMARY ELECTION; PROVIDING AN
EFFECTIVE DATE."
The ordinance was adopted by motion of Mr. Firkins,
seconded by Mr. Berkebile and unanimous vote of the Council.
Item 3. Ordinance 9 -70 - Personnel Program (2nd reading)
Mr. Berkebile moved to table this item, Mr. Thurm
seconded and the motion carried by unanimous vote.

Item 4. Ordinance 10 -70 - Adopting Brevard County
Animal Control (2n reading)
Mayor Nicholas read the ordinance entitled "AN
ORDINANCE ADOPTING BREVARD COUNTY ORDINANCE NO. 70 -15 PROVIDING
FOR ANIMAL CONTROL IN BREVARD COUNTY AND WITHIN THE CONFINES OF THE
CITY OF CAPE CANAVERAL, FLORIDA; INSTRUCTING THE CITY MANAGER TO
NEGOTIATE AN AGREEMENT WITH BREVARD COUNTY; REPEALING ALL OR PARTS
OF ORDINANCES IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE."
Mr. Firkins moved to adopt the ordinance. Mr. Berkebile
seconded the motion.
Motion was made by Mr. Thurm to amend by adding two
new sections:as follows:
Section 3. Section 4 -1 (i) of Brevard County Ordinance
No. 70 -15 is hereby amended to read "Board shall mean Board of
County Commissioners of Brevard County, Florida and City Council
of the City of Cape Canaveral, Florida where applicable."
Section 4. Pursuant to Section 4 -14 of Brevard County
Ordinance No. 70 -15, the City Council of the City of Cape Canaveral,
Florida does hereby designate all Public Parks and Public Beaches
as an area in which such animals are prohibited.
Mr. Firkins seconded the motion and the vote was unanimous
in favor of the amendment.
Vote on the main motion was unanimous and the ordinance
was adopted as amended.
NEW BUSINESS:
Item 1. Approval of Renewal $ Replacement Fund expendi-
tures.
Mr. Berkebile moved to approve payment of bills in the
amount of $836.39. Mr. Thurm seconded and the motion carried by
unanimous vote.
Item 2. Resolution 70 -35 - Appointment of City Prosecutor
Mayor Nicholas called for recommendations. Mr. Francis
recommended Mr. Richard, Scott. Judge Propper recommended Mr. Myron
Stevens.Mr. Thurm moved to appoint Mr. Scott with Mr. Firkins second-
ing the motion. Mayor Nicholas then read the resolution entitled
"A RESOLUTION APPOINTING CITY PROSECUTOR; PRESCRIBING COMPENSATION;
PRESCRIBING TERM OF OFFICE; PROVIDING AN EFFECTIVE DATE."
The vote was unanimous to adopt the resolution naming
Mr. Scott as prosecutor at $2400.00 per annum.

Mayor Nicholas read letters from the Department of
Commerce regarding the future Space Shuttle, and one from the
Chamber of Commerce concerning the Space Coast Fair to be held
October 30, 31, and Nov. 1, 1970.
By motion of Mr. Firkins, seconded by Mr. Nicholas,
the meeting was adjourned at 10:10 P.M.
