HomeMy WebLinkAbout10-06-1970 Regular Meetingr w MICROFILMED 4 -24 -80 • REGULAR MEETING CITY COUNCIL October 6, 1970 A Regular Meeting of the City Council of the City of Cape Canaveral was-held on October 6, 1970 at the City Hall, 105 Polk Avenue, Cape Canaveral, Florida at 7:30 P.M. The meeting was called to order by Mayor Leo Nicholas. The roll was called by the City Clerk. Officials present were Mayor Nicholas; Councilmen Charles Berkebile, George Firkins, G. J. Salvaggio and Richard R. Thurm; City Manager A. J. Francis; City Attorney Stanley Wolfman; City Clerk Anita Ostrom and Sgt. at Arms Willard Winnett. The minutes of the Regular meeting of September 15, 1970 were read by the Clerk. A change was made by Mr. Thurm by substituting the word "application" for the word "purchase" on page two, line four. The minutes were approved as amended. OLD BUSINESS: Item 1. Resolution 70 -32 - Brevard County Library Coordinator It was agreed to take up this item later in the agenda. Item 2. Ordinance 7 -70 - Amendment to Ordinance 81 -64 re: (2nd reading) Recreational Camping Equipment Mayor Nicholas read the Ordinance entitled "AN ORDINANCE AMENDING ORDINANCE NO. 81 -64, AS AMENDED, BY AMENDING ARTICLE VI BY ADDING A NEW PARAGRAPH REGULATING THE LOCATION OF RECREATIONAL AND CAMPING EQUIPMENT WITHIN THE CITY OF CAPE CANAVERAL; PROVIDING AN EFFECTIVE DATE." By motion of Mr. Thurm, seconded by Mr. Firkins and unanimous vote of the Council, second reading was approved and the ordinance was adopted. NEW BUSINESS: Item 1. Resolution 70 -33 - Adoption of 1970 -71 Valuation & setting millage .Mayor Nicholas read the resolution entitled "A RESOLUTION ADOPTING 1970 -1971 VALUATION OF PROPERTIES, FOR PURPOSES OF STORM DRAINAGE AD VALOREM TAXATION; SETTING AND PRESCRIBING RATE OF AD VALOREM TAXATION IN SUPPORT OF THE STORM DRAINAGE PROGRAM; PROVIDING AN EFFECTIVE DATE." By motion of Mr. Salvaggio, seconded by Mr. Berkebile and unanimous vote of the Council, the resolution was adopted setting the tax millage at three mills. Mayor Nicholas read the resolution entitled "A RESOLUTION AUTHORIZING THE CITY TO PARTICIPATE IN THE BREVARD COUNTY LIBRARY COORDINATOR PROGRAM AND APPROVING AGREEMENT BETWEEN THE BREVARD COUNTY LIBRARY BOARD AND THE CITY; AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID AGREEMENT; PROVIDING AN EFFECTIVE DATE." Mr. Lovchuk, Chairman of the Brevard County Library Board, was in attendance and explained the proposed program to the Council. Mr. Salvaggio moved to adopt the Resolution, Mr. Thurm seconded, and the motion carried by unanimous vote. NEW BUSINESS: Item 2. Resolution 70 -34 - Appointment of Liaison between Brevard County Government Study Commission & the City. Mayor Nicholas read the resolution entitled "A RESOLUTION APPOINTING A REPRESENTATIVE OF THE CITY OF CAPE CANAVERAL TO SERVE AS LIAISON BETWEEN THE CITY AND THE BREVARD COUNTY GOVERNMENT STUDY COMMISSION; PROVIDING AN EFFECTIVE DATE." By motion of Mr. Thurm, seconded by Mr. Firkins and unanimous vote the resolution was adopted appointing Mr. A. J. Francis. Item 3. Ordinance 8 -70 - Amendment to Alcoholic Beverage Ordinance re: Election Days (Ist. reading) Mayor Nicholas read the Ordinance entitled "AN ORDINANCE AMENDING ORDINANCE 6- 63-A, AS AMENDED, REPEALING SECTION 2B, WHICH REQUIRES THE CLOSING OF ALL BAR ROOMS, SALOONS, COCKTAIL LOUNGES AND OTHER PLACES WHICH SELL ALCOHOLIC BEVERAGES AT RETAIL, AND WHICH PROHIBIT THE SALE OF ALCOHOLIC BEVERAGES AT RETAIL WITHIN THE CITY OF CAPE CANAVERAL, FLORIDA, WHILE THE POLLS ARE OPEN FOR ANY STATE, COUNTY, MUNICIPAL, GENERAL OR PRIMARY ELECTION; PROVIDING AN EFFECTIVE DATE." First reading was approved by motion of Mr. Salvaggio, seconded by Mr. Berkebile and unanimous vote of the Council. Item 4. Ordinance 9 -70 - Personnel Program (1st reading) Mayor Nicholas read the ordinance entitled "AN ORDINANCE ADOPTING PERSONNEL POLICIES FOR THE CITY OF CAPE CANAVERAL, FLORIDA; PROVIDING AN EFFECTIVE DATE." By motion of Mr. Salvaggio, seconded by Mr. Berkebile and unanimous vote of the Council, first reading was approved. Item 5. Ordinance 10 -70 - Adopting County Animal Control (1st reading) Mayor Nicholas read the ordinance entitled "AN ORDINANCE ADOPTING BREVARD COUNTY ORDINANCE NO. 70 -15 PROVIDING FOR ANIMAL CONTROL IN BREVARD COUNTY AND WITHIN THE CONFINES OF THE CITY OF CAPE CANAVERAL, FLORIDA; INSTRUCTING THE CITY MANAGER TO NEGOTIATE AN AGREEMENT WITH BREVARD COUNTY; REPEALING ALL OR PARTS OF ORDINANCES IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE." Mr. Salvaggio moved to approve first reading. Mr. Firkins seconded and by unanimous vote the motion carried.
