REGULAR COUNCIL MEETING
September 19, 1967
The City Council of the City of Cape Canaveral, Florida,
met in regular-session on September 19, 1967, at City.Hall,
105 Polk Avenue, Cape Canaveral, Florida, at 7:50 P.M.
The meeting was called to order by Mayor Richard R. Thurm.
The roll was called by Dee Devlin. Members present were
Mayor Richard R. Thurm; Councilmen Frank Hoog and G. J. Salvaggio;
City Manager - City Clerk Joseph A. Rickards; City Attorney
T. David Burns; and Sgt. at Arms Willard Winnett. Councilmen
Paul Knittel and Vincent Lindemann were absent.
The minutes of the regular meeting of September 5, 1967,
were read by Dee Devlin. Mayor Thurm requested that a correc-
tion be made to Item 3, inserting the words "the title of"
between the words "read" and "the" in Line 3. The minutes were
approved as corrected. The minutes of the special meeting of
September 12, 1967, were read by Dee Devlin. There being no
corrections or additions, the minutes were approved as read.
The Treasury Report was approved as submitted.
OLD BUSINESS:
Item 1. Ordinance 4 -67 -A. Second Reading.
Mayor Thurm read the ordinance entitled, "AN ORDINANCE
AMENDING ORDINANCE NO. 4 -67 PERTAINING TO APPOINTMENT OF BOARD
OF ADJUSTMENT UNDER THE CITY'S STANDARD HOUSING CODE; PROVIDING
AN EFFECTIVE DATE'.' Mr. Salvaggio made a motion to adopt the
ordinance, Mr. Hoog seconded the motion, and the motion was
carried unanimously.
Item 2. Ordinance 5 -67. Second Reading.
Mayor Thurm read the ordinance entitled, "AN ORDINANCE
REGULATING THE OPENING AND EXCAVATING OF STREETS, ALLEYS,
SIDEWALKS, AND OTHER PUBLIC GROUNDS; REQUIRING A PERMIT

THEREFOR AND PAYMENT OF A FEE; IMPOSING REQUIREMENTS FOR THE
PROTECTION OF LIFE AND PROPERTY IN CONNECTION WITH EXCAVATION
WORK, INCLUDING TRAFFIC AND PEDESTRIAN SAFEGUARDS AND THE PRO-
TECTION OF UTILITIES AND OTHER PROPERTY; REGULATING THE BACK -
FILLING AND RESURFACING OF EXCAVATIONS; PRESCRIBING SURETY
BOND AND DEPOSIT REQUIREMENTS; AND PROVIDING WHEN THIS ORDINANCE
SHALL TAKE EFFECT ". Mayor Thurm also read a letter listing
Southern Bell's objections to this ordinance. Mr. Salvaggio
made a motion to amend the ordinance as follows: In Section 1,
Line 2, insert the words "jet, bore and Jack" between the words
"tunnel" and "undermine "; In Section 1, Line 8, strike the
words "an excavation" and insert in lieu thereof the word "a ";
In Section 14, Lines 3 and 4, strike the words "One Hundred
Dollars ($100.00)" and insert in lieu thereof the words "Five
Hundred Dollars ($500.00) ". Mr. Hoog seconded the motion, and
the motion carried unanimously. Mr. Salvaggio made a motion
to adopt the ordinance, Mr. Hoog seconded the motion, and the
motion carried unanimously.
Item 3. Resolution No. 67 -50.
Mayor Thurm read the resolution entitled, "A RESOLUTION
APPOINTING A MEMBER TO THE ZONING AND PLANNING BOARD TO FILL
AN UNEXPIRED TERM; PROVIDING AN EFFECTIVE DATE: Mr. Salvaggio
made a motion to adopt the resolution, Mr. Hoog seconded the
the motion, and the motion carried unanimously.
NEW BUSINESS:
Item 1. Ordinance - first reading - setting millacre for storm
dr�#nage.
Item 2. Resolution re: $360,000 Construction Loan.
Mr. Salvaggio made a motion to table Items 1 and 2, Mr.
Hoog seconded the motion, and the motion carried unanimously.

Mr. Salvaggio made a motion to hold a special meeting on
September 22, 1967, at 5:00 P.M. to process Items 1 and 2,
Mr. Hoog seconded the motion, and the motion was carried
unanimously.
Item 3. Resolution 67 -51.
Mayor Thurm read the resolution entitled, "A RESOLUTION
APPOINTING TWO.(2) MEMBERS TO THE RECREATION BOARD; PROVIDING
AN EFFECTIVE DATE ",and the letters of resignation and
application. Mr. Salvaggio made a motion to adopt the reso-
lution, Mr. Hoog seconded the motion, and the motion was
carried unanimously.
Following the completion of the agenda items, a discussion
period was held.
Mr. Salvaggio made a motion to adjourn, Mr. Hoog seconded
the motion, and the meeting was adjourned at 10:00 P.M.
