HomeMy WebLinkAbout09-12-1967 Special MeetingSPECIAL COUNCIL MEETING PUBLIC HEARING September 12, 1967 The City Council of the City of Cape Canaveral, Florida, met in special session on September 12, 1967, at City Hall, 105 Polk Avenue, Cape Canaveral, Florida, at 7:40 P.M. The meeting was called to order by Mayor Richard R. Thurm. The roll was called by Dee Devlin. Members present were Mayor Richard R. Thurm; Councilmen Frank Hoog, Vincent Lindemann, and G. J. Salvaggio; City Manager - City Clerk Joseph A. Rickards; City Attorney T. David Burns; and Sgt. at Arms. Item 1. Abatement of Nuisance - Resolution 67 -43. Mayor Thurm read the resolution. Mr. H. F. Priebe, Building Official, was sworn in as a witness by the City Clerk. Mr. Priebe testified that each of the property owners had been notified of this hearing via certified letters and that the City has received notification of receipt of these letters by the,property owners. He also testified that each of the listed properties is a health hazard and a nuisance. Chief of Police Willard Winnett was sworn in as a witness by the City Clerk. Chief Winnett testified that he had taken photographs of the lots listed, and a notebook containing these photographs was entered as evidence. Mr. Burns requested that the minutes show that no one appeared in contravention of the City's action relativeto declaration of nuisances. Mr. Salvaggio made a motion that the following described properties be declared to be a nuisance and the proper officials of the City be directed to abate the nuisance conditions exist- ing on the respective properties and assess liens against the respective properties as authorized by the Charter of the City PAGE I ®F3 Is Special Council Meeting September 12, 1967 Page Two MICROFILMED 4 -24.8 of Cape Canaveral and the State of Florida. The properties herein declared to be nuisances all are located in Avon -by- the -Sea subdivision and are described as follows: The east 1/2 of lot 12, Lots 13 - 16, Block 14; Lots 13 and the south 1/2 of Lot 12, Block 30; Lot 14, Block 43; Lots 1 - 5, Block 29; Lots 9 - 11, Block 26; Lots 1 - 5,.Block 30; Lots 4 and 6, Block 26; Lots 16 - 18, Block 63; Lots 1 - 13, Block 18; Lot 15 and the south 50�ft. of Lots 6 - 10, Block 50; Lot 7, Block 55;. Lots 6 - 10, Block 35; Lot 1, Block 37; Lots 8 and 9, Block 34; Lots 15 and 16, Block 70; Lots 10, 14, and 15, Block 45; Lots 1 - 3, Block 67; Lot 7, Block 34; Lot 6, Block 55; Lot 13, Block 55; east 1/2 of Lot 15 and all of Lot 16, Block 13; Lot 14 and the west 1/2 of Lot 15, Block 13; Lots 11 - 13, Block 76; Lots 1 - 3, Block 42; Lot 3, Block 26; Lot 13, Block 13; Lot 4, Block 42; Lots 14 and 15, Block 24; Lots 9 and 10, Block 22; Lots 4 - 6, Block 74; Lot 6, Block 72; Lots 14 and 15, Block 30; Lots 6 - 10, Block 24; Lot 15, Block 18; Lots 6 - 9, Block 30; Lots 1 - 3, Block 41; all of Block 50 Avon -by- the -Sea subdivision except the south 50 feet; Lots 11 and 12, Block 44; Lot 2, Block 37; Lots 1 - 3, Block 59; Lots 7 and 8, Block 74; Lot 10, Block 72; Lots 1, 2, 6, and 7, Block 40; all of the beforementioned lots being located in Avon -by- the -Sea subdivision as recorded in the public records of the Clerk of the Circuit Court of Brevard County, Florida, and the respective registered owners of these said properties herein declared to be a nuisance notified of this action by the Council. Mr. Lindemann seconded the motion, and the motion carried unanimously.
