REGULAR COUNCIL MEETING
March 15, 1966
The City Council of the City of Cape Canaveral
met in Regular Session at the City Hall, 105 Polk Avenue
at 7:30 P.M. on the 15th day of March, 1966.
The Meeting was called to Order by Mayor Thurm and
the roll was called by the Clerk. Officials present were
Mayor Richard Thurm; Councilmen Leo Collins, Frank Hoog,
Jack Hurck and Martin Sc-hrider; City Manager J. A. Rickards;
City Attorney T. David Burns; City Clerk Donna J. Anderson,
and Sgt. at Arms.
The Minutes of the Regular Meeting of March 1, 1966
and the Minutes of the Special Meeting of March 3, 1966
were read by the Clerk and with no additions or corrections
were approved as submitted. The Treasury Report was approved
as submitted.
OLD BUSINESS
Item 1. Ordinance #8 -66 Re: Juveniles - Curfew (2nd
and

Mr. Collins made a Motion that 2nd and Final Reading
of the Ordinance be approved. Mr. Schrider seconded the
Motion. Mr. Hoog then made a Motion to Amend in Section 2
setting curfew hours for minors under the age of 14 at 8 P.M.
on week days, and in Line 7 of Section 2 by striking 11 P.M.
and inserting in lieu thereof the words 10 P.M., the same
amendment in Line 8 and amending by renumbering the Sections
appropriately. The Motions died for lack of a second.
Mr. Schrider then made a Motion to Amend in Section 1,
Line 7 by striking 11 P.M. and inserting in lieu thereof
"10 P.M.' and in Section 2, Line 8 by striking 11 P.M. and
inserting in lieu thereof "10 P.M." and by adding a new

Section adopting the language of Section l in its entirety
with the exception that the new section would pertain to
minors under the age of 14, curfew hours at 9:00 P.M. week
days and 10:00 P.M. on Friday and Saturday nights, and
amending by adding a new section adopting the language of
Section 2 in its entirety with the exception that the new
section would pertain to minors under the age of 14, cur-
few hours at 9:00 P.M. week days and 10:00 P.M. on Friday
and Saturday nights. The Motion to Amend was seconded by
Mr. Collins and carried with Mr. Hoog, Mr. Schrider-and
Mr. Collins voting in favor and Mr. Hurck opposing.
Mr. Schrider then made a Motion that the Ordinance as
Amended be adopted. Mr. Collins seconded the Motion and
it carried with Mr. Hoog, Mr. Schrider and Mr. Collins
voting in favor and Mr. Hurck opposing.

Mayor Thurm gave 2nd and Final Reading to the Ordinance.
Mr. Collins made a Motion to approve. Mr. Hoog seconded
the Motion. After discussion, Mr. Hurck made a Motion
that the Item be tabled. The Motion died for lack of a
second. Mr. Collins then made a Motion to amend by striking
Section 3 in its entirety and renumbering the sections
appropriately. Then to Amend in Section 6, changing the
minimum fine to $25.00 in lieu of $150.00 and the same
amendment in Section 7. The Motions to amend were seconded
by Mr. Schrider and carried with Mr. Hoog, Mr. Schrider and
Mr. Collins voting in favor and Mr. Hurck opposing.
The Ordinance as Amended was approved with Mr. Hoog and
Mr. Collins voting in favor and Mr. Hurck and Mr.._Schrider
voting in opposition and Mayor Thurm voting in favor, thereby
breaking the tie.
Item 3. Ordinance Amending Ordinance #81 -64 Re: Building Permits,
On a Motion by Mr. Hoog, seconded by Mr. Collins and
carried unanimously, Item 3 was tabled.

Mr. Schrider made a Motion to approve. Mr. Hoog seconded
the Motion. Mr. Schrider then made a Motion to Amend in
Section 3 following the word

Mayor Thurm gave lst Reading to the Ordinance, an
ORDINANCE AMENDING ORDINANCE #81 -64 OF THE CITY OF CAPE
CANAVERAL BY ADDING TO ARTICLE V; PROVIDING FOR THE ESTABLI-
SHMENT OF A TR -1 SINGLE FAMILY MOBILE HOME ZONE; PROVIDING
AN EFFECTIVE DATE THEREOF.
On a Motion by Mr. Hurck, seconded by Mr. Collins and
carried unanimously, the lst reading of the Ordinance was
approved.
Item 2. Ordinance Amending Ordinance #81 -64 Re:. Trailer
Mayor-Thurm gave lst Reading to the Ordinance, AN
ORDINANCE AMENDING ORDINANCE No. 81 -64 OF THE CITY OF CAPE
CANAVERAL BY AMENDING SECTION 24 OF ARTICLE VI; PROVIDING
AN EFFECTIVE DATE.
On a Motion by Mr. Hoog, seconded by Mr. Hurck and
carried unanimously, the lst reading of the ordinance was
approved.
On a Motion by Mr. Collins, seconded by Mr. Hoog and
carried unanimously, an add on Item was placed on the Agenda.
Item 3. Resolution #66 -14
Mayor Thurm read a RESOLUTION DIRECTING THE CITY ATTORNEY
TO PREPARE A RESOLUTION APPROPRIATING $150,000 FROM CERTAIN
CITY REVENUE SOURCES FOR A PAYMENT OF A PORTION OF THE CITY'S
STREET PAVING PROGRAM AT A SPECIFIED TIME; PROVIDING AN
EFFECTIVE DATE.

On a Motion by Mr. Hurck, seconded by Mr. Hoog and
carried unanimously, the Council was adjourned.
Approved this 5th day of April, 1966.

After a short recess, the Board of Adjustment was
called to Order by Mayor Thurm.
BOARD OF ADJUSTMENT
The roll was called by the Clerk and officials present
were Mayor Richard Thurm; Councilmen Leo Collins, Frank
Hoog, Jack Hurck and Martin Schrider; City Manager J. A.
Rickards; City Attorney T. David Burns; City Clerk Donna
J. Anderson and Sgt. at Arms."
Item 1. Shuford Mills Request-- Lounge
Mayor Thurm read the Planning And Zoning Board Minutes
of March 9th, 1966 recommending the approval of the Request.
Mr. Hurck made a Motion that the Request for on premises
consumption be granted as recommended by the Planning and
Zoning Board. Mr. Collins seconded the Motion. After
lengthy discussion, Mr. Hurck voted in favor of the Motion
which failed to carry with Mr. Hoog, Mr. Schrider and Mr.
Collins voting opposed.
There being no further business before the Board of
Adjustment, the Meeting was adjourned on a Motion by Mr.
Collins, seconded by Mr. Hoog and carried unanimously.
