MICROFILMED 4.24 -80 REGULAR COUNCIL MEETING October 5, . 1965 The City,Council of the City of Cape Canaveral, Florida met in Regular Session at the City Hall, 105 Polk Avenue, on-I the 5th day of October, 1965 at 7930 P.M. The first meeting in the City's first new City Hall Build- ing was called to Order by Mayor Thurm and'the roll was called by the Clerk.. Officials present were. Mayor Richard Thurm; Councilmen Frank Hoog, Jack Hurck and Martin Schrider; City Manager J. A. Rickards and City Attorney T. David Burns. Mr. Hurck requestdd that the Minutes show that the City Hall is completely paid for. Following the invocation by the Reverend John Meyer, the Minutes of the Regular Meeting of September 21, 1965 and the Meeting of the Board of Adjustment were read by the Clerk and approved as read. The sewerage Progress Report was given by Mr. Tom Strang of Briley, Wild Adsociates. On a Motion by Mr. Hurck, seconded by Mr.6Hoog and carried unanimously, the Report was approved. OLD BUSINESS Item No. 1. City Gas Company Ordinance (2nd and Final Reading) Mr. Hoog made a Motion to table 2nd and final reading of the Ordinance until amendment is made to protect the City with regard to repairing of pavement and time limitations. Mr. Schrider y; J. seconded the Motion and it carried.unanimously. NEW BUSINESS With no objections, Item No. 2 was considered as Item No. 1 on the Agenda. Item I N o 1 Ordinance anc 0 e Repealing Ordinance 80-64 (service Stations) Mayor Thurm gave first reading to an ORDINANCE REPEALING ORDINANCE 8© -64 . ADOPTED NOVEMBER 3, 196+, RELATING TO GASOLINE AND AUTOMOTIVE SERVICE STATIONS LOCATED WITHIN THE CITY OF CAPE CANAVERAL F • LORIDA, PROVIDING AN EFFECTIVE DATE, On a Motion by Mr. Hurck, seconded by Mr. Schrader and carried unanimously, the Ordinance was approved. �4P �F PAGE) 0F3 ? Ordinance Amending Ordinance,'81 -64 (ServiceAtations) Mayor Thum gave first reading to an ORDINANCE AMENDING 'ORDINANCE N0. 81 -64 -G BY AMENDING SUB - SECTION 1, Q of SECTION 6 OF ARTICLE 5 AND AMENDING SUB - SECTION C (1) OF SECTION 10 OF ARTICLE 6,OF ORDINANCE N0. 81 -64 -G TO ALLOW AUTOMOBILE SERVICE STATIONS TO BE CONSTRUCTED AS A BONA FIDE PART OF ANY HOTEL, MOTEL OR-MOTOR ^COUR7- .COMPIZX OF.NdT-LESS THAN 200 GUEST ROOMS WITHOUT SAID STATIONS BEING REQUIRED TO BE 2,000 FEET FROM OTHER SERVICE STATIONS. PROVIDING FOR CERTAIN RESTRICTIONS ON ISSUANCE OF BUILDING PERMITS TO SUCH HOTEL, MOTEL OR MOTOR COURT COMPLEXES; PROVIDING AN EFFECTIVE DATE. Mr. Schrider made a Motion to approve first reading of the Ordinance. Mr. Hoog seconded the Motion which carried with Mr. Schrider and Mr. Hoog voting in. favor and Mr. Hurck voting against. Item No. 3. Ordinance Repealing Section of Ordinance 81 -64 Mayor Thum gave first reading to an ORDINANCE AMENDING ORDINANCE 81 -64 RELATING TO THE LOCATION OF AUTOMOTIVE SERVICE STATIONS WITHIN THE CITY OF CAPE CANAVERAL BY THE ELIMINATION OF ALL DISTANCE REQUIREMENTS; PROVIDING AN EFFECTIVE DATE. Mr. Hoog made a Motion to refer Item No. 3 to the Zoning and Planning Board for their consideration. After discussion, Mr. Hoog withdrew his Motion and then moved the rejection of the Ordinance. Mr. Schrider seconded the Motion to reject and it carried unani- mously. Item No. 4. Ordinance - Rules of Procedure- Zoning and Planning Board - Ist Reading. Mayor Thum gave first reading to an ORDINANCE PRESCRIBING RULES OF PROCEDURE FOR THE ZONING AND PLANNING BOARD OF THE CITY OF CAPE CANAVERAL, FLORIDA; PROVIDING AN EFFECTIVE DATE. On a Motion by Mr. Hurck, seconded by Mr. Schrider and carried unanimously, first reading of the Ordinance was approved. Item No. 5. Ordinance - City Manager Mayor Thum gave first reading to an ORDINANCE RELATING TO CITY MANAGER; PROVIDING FOR QUALIFICATIONS, APPOINTMENTS, TERM OF APPOINTMENTS, PROCEDURE FOR REMOVAL, DUTIES AND RESPONSIBILITIES OF MANAGER; POWERS OF APPOINTMENT AND REMOVAL; PROHIBITION OF COUNCIL TO INTERFER IN APPOINTMENT DR OVALS; PROVIDING FOR INVESTIGATIVE PROCEDURE AND PROVIDING PUNISHMENT FOR FAILURE TO OBEY SUBPOENA; PROVIDING FOR RIGHTS OF MANAGER AND OTHER OFFICERS IN COUNCCIL MEETINGS; PROVIDING AN EFFECTIVE DATE. On A Motion by Mr. Hoog, the Item was tabled until the City Manager could obtain model ordinances from six cities of like size to be studied. Mr. Hurck seconded the Motion and it carried unanimously.
