HomeMy WebLinkAboutResolution No. 1987-38 MICROFILMED JUNE 89 RESOLUTION NO. 87-38 A RESOLUTION AUTHORIZING THE MAYOR AND THE CITY CLERK TO ENTER INTO AN AGREEMENT WITH BREVARD COUNTY BOARD OF COUNTY COMMISSIONERS TO CONDUCT THE MUNICIPAL ELECTION FOR THE CITY OF CAPE CANAVERAL; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Cape Canaveral' s General Election will be held on November 3, 1987; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Cape Canaveral, Florida, as follows: SECTION 1. The Mayor and the City Clerk are hereby authorized to execute an agreement with the Brevard County Board of County Commissioners to assist with the Municipal election to be held on November 3, 1987. A copy of said agreement is attached hereto and made a part hereof by reference. SECTION 2. This Resolution shall become effective immediately upon its adoption. W I T N E S S E T H WHEREAS, the City has adopted a single permanent registration system with the County for the registration of electors of the Cityi and WHEREAS, the City desires the County to conduct the Municipal Election(s) of the City to be held on November 3, 1987 for the purpose of electing two Council Members and passible referendum questions NOW THEREFORE, in consideration of the premises and covenants herein contained, the County and the City agree as followss 1. The County agrees to do the followings (a) Provide adequate polling place facilities for each precinct. (b) Furnish and place at the polling places sufficient voting equipment. (c) Provide City Clerk with a list of registered voters qualified to vote in the City election. (d) Appoint Clerks and Inspectors at each polling place to conduct the election. (e) Furnish and place at the polling places the registration records for each precinct. (f) Coordinate printing of ballots. (g) Provide for absentee voting in accordance with the provisions of the laws of the State of Florida. (h) Handle tabulation and counting of all precinct and absentee ballots. (i) Advertise Data -Vote Logic and Accuracy Test of voting equipment. 2. The City agrees to do the followings (a) Furnish the County by the close of business a day of Sept�^h'r 15 1997 (last day of qualification) certified copy, under seal of the City clerk, of the proposed ballot showing the exact names of all qualified candidates for the election for each office, as they will appear on the official ballot. Also, the exact wording of questions or issues to be placed on the ballot. (b) To be bound by the laws of the State of Florida and specifically the Election Code of the Florida Statutes in conducting the City election. (c) Cause the sample ballot to be advertised in the newspaper as required by law. (d) The City shall be responsible for paying the cost of all legal advertisements, and to pay the normal rate paid by the County for the Election Board, and all other costs of the election. 3. The Supervisor of Elections shall count all votes, including absentee votes, certifying in duplicate the votes cast for each candidate. The Supervisor of Elections shall deliver two copies of the Certificate of Results of :he to the City Clerk who shall transmit one copy to the Mayor. The Mayor and City Clerk shall transmit the returns to the City council at a special meeting for the canvassing of the election which shall be held as soon as practicable following the election. After receiving the returns, including absentee ballots, the City Council shall approve the election results as submitted by the County and the City Council shall declare the results of the election based on said returns. The City shall then submit one copy of their Certification of Election to the Supervisor of Elections. -2- MICROFILMED JUNE 89 THE PARTIES hereto, by their respective proper officials, execute this Agreement on the date aforesaid.
