HomeMy WebLinkAboutResolution No. 1987-32RESOLUTION N0. 07-32 A RESOLUTION ASKING THE U.S. CONGRESS TO REJECT PROPOSALS BY THE EXECUTIVE BRANCH TO REMOVE THE CURRENT EXEMPTIONS FOR LOCAL GOVERNMENT VEHICLES FROM FEDERAL HIGHWAY GASOLINE AND EXCISE TAXES} PROVIDING AN EFFECTIVE DATE. WHEREAS, the proposed budget submitted to the U.S. Congress by the executive Branch the imposition of federal gas and excise taxes on local government vehicles in an attempt to e raise $800 million new federal tax dollars annually; and ' WHEREAS, such forms of taxation are in conflict with the Constitutional concept of reciprocal immunity which provides that one level of government may not tax another; and WHEREAS, the City of Cape Canaveral will be required to pay federal highway gas and excise taxes if the exemption for local government vehicles is repealed] and WHEREAS, Florida municipalities are restricted by State law in their ability to increase local revenues to absorb such a mandated additional cost; and WHEREAS, federally funded loan and grant programs to munici- palities have diminished over the past several years; and WHEREAS, the increased costsassociated with .federally mandated legislation, combined with the decreasing funding sources, has prevented member municipalites of the Brevard County League of Cities from addressing major infrastructure needs; NOW, THERFORE, BE IT RESOLVED by the City Council of the City of Cape Canaveral, Brevard County, Florida, as follows: SECTION 1. The City Council of the City of Cape Canaveral hereby opposes the repeal of .the exemption for local government I vehicles from federal highway gas and excise taxes as provided by the Executive Branch. SECTION 2. Senators Lawton Chiles and Bob Graham, Representative Bill Nelson and all other members of the Florida Congressional Delegation are hereby formally requested to oppose the repeal of the exemption for local government vehicles from federal highway gas and excise taxes. The City Clerk is hereby directed to provide 1 copies of this Resolution to Senators Lawton Chiles and Bob 1 Graham, Representative Bill Nelson, all other members of the 1 Florida Congressional Delegation, the Florida League of Cities and the Brevard County Commissioners. ■ SECTION 3 . This Resolution shall become effective immed- iately upon its adoption.
