A Board of Adjustment Meeting was held on October 30, 2013, at the City of Cape
Canaveral Public Library, 201 Polk Avenue, Cape Canaveral, Florida. Board Member,
Paula Collins called the meeting to Order at 61:15 P.M. Board Secretary, Susan Chapman
called the roll.

I , Approval of Meeting Minutes: March 28, 2013.
Motion by George Sweetman, seconded by Douglas Raymond to approve the meeting
minutes of August 8, 2013, as written. Vote on the motion carried unanimously.

13-06 to Allow Townhouses in the C-1 Zoning District, (127, 131, 135 & 139
Oak Lane) - Sheropa, LLC, Property Owner.
Planning & Zoning Director, Barry Brown gave his Staff report. He summarized that the
applicant purchased four (4) lots on Oak Lane and desired to construct two-unit
townhomes on each lot. The properties are zoned C-1 Commercial, Residential Use is
allowed in this portion of the C-1. zoning district pursuant to a Special Exception. The
Board members reviewed elevations and a floor plan of the project; and a map
highlighting the property location as well as surrounding properties. Mr. Brown noted
that the proposed use was appropriate for residential. He noted the Oak Lane was a City
Public right-of-way, which was not improved; and described the roadways' condition, He

advised that utility water and sewer lines are available to the site. On October q, 2013,
the Planning & Zoning Beard recommended approval of the request.
Applicant, Patrick Lee advised that the property is zoned commercial because back in the
1980's, N. Atlantic Avenue was the only road that supported the Port; he desired to
construct the townhouse project as requested; and commented the dirt road adds to the
quaintness of the site and setting. Discussion ensued regarding the condition of the road.
Motion by Linda Drown, seconded by George Sweet an to approve the Special
Exception, as requested. 'dote on the motion carried unanimously.
3. Quasi-judicial and/or Public Hearing: Motion Re: Special Exception Request No.

Property Owner.
Planning & Zoning Director, Barry Brown gave his Staff` report. He showed the Board
members a map depicting the property location; and a survey highlighting the outside
display areas. He advised that outdoor display of merchandise areas are allowed by Code
with a granted Special Exception; the proposed area measurements for the outside
displays complied with Code; the applicant meets all setback requirements; and Staff
recommends approval. He noted that on October 23, 2013, the Planning & Zoning Board
recommended approval, with the condition that the outside display areas be delineated.
Attorney, Kim Rezanka representative for the property owner, summarized the request;
and noted that the vehicles displayed for rent would not be rented or stored at this
location; the vehicles were not part of the display area; and not part of the request.
The Board held brief discussion. Ex- officio Board Member, Lamar Russell explained
reasons why requests for outside display areas required a granted Special Exception.
Board member, Paula Collins opened the floor for public comment. There were no
comments from the public.
/motion by Linda Brown, seconded by George Sweetman to approve the Special
Exception, as requested. Vote on the motion carried unanimously.
OPEN DISCUSSION:
Planning & Zoning Director, Barry Brown gave a status update of the proposed Dollar
General project. He noted that delivery vehicles will make all turning movements on the
site; and depending upon how the property is built -out there may be a roadway
constructed to the immediate west of the property.

Mr. Brown polled the Beard members for their availability in the first week in December
if a meeting is scheduled. Three of the four Board members in attendance replied that
they were all leaving out-of-town on December 10th, and not returning until after the
holidays.

Special Exception 14-01
Request: For a Special Exception to allow for the assembly, outside display of merchandise,
service, and sales of electric vehicles.
Applicant and Owner of property: Stanley (Ed) Schoefield (Agent)
Subject properties; 7077 N. Atlantic Avenue. This property is 1.84 acres,
Future Land Use and Zoning Designation: C-2, Commercial
Surrounding zoning:
North — C-2, Commercial
South — C-2, Commercial
East — C -1, Commercial
West — C-2, Commercial
Surrounding uses:
North — multi-tenant office and light manufacturing
South — general office
East food /beverage
West — multi-tenant office and light manufacturing
Background/Analysis:
The applicant is requesting to establish a sales and service center for a line of all electric
vehicles. According to Section 110 -383 (c)(6) of the Code, a Special Exception must be granted
in order to allow the "Sales of new and used automobiles, major recreational vehicles..." within
the C-2 zoning district. The Code includes a definition of an "Automotive Vehicle" as a self-
propelled vehicle or conveyance designed and used for the purpose of transporting or moving
persons..." Although the current Code did not contemplate electric vehicles, the definition of an
automotive vehicle could incorporate the type of vehicle being proposed through this application.
Although the City does not have specific regulations for the operation of electric vehicles, the
State of Florida, as contained in F.S. 316, has established certain rules for their operation.
Section 110-383(c)(6) a-e of the City Code established certain requirements that must be met
when operating an automotive sales/service center. Notably, that all outside display areas shall
be paved, all repair activities shall be in an enclosed structure, and there shall be no parking or
storing of wrecked vehicles.
Planning and Zoning Board recommendation:
At its February 26, 2014 meeting, the Planning and Zoning Board unanimously
recommended approval of Special Exception 14 -01, with the following conditions
1. A maximum of eight (8) vehicles may be displayed in the parking lot at any one time.
2. All outdoor displays and /or merchandise shall be taken indoors at the close of
business each day.
3. A minimum five (5) foot wide landscape buffer shall be installed along the property's
frontage with N. Atlantic Avenue. The buffer shall be in conformance with See. 110 -
687(1)(a) and (b) of the City's Code. Credit towards the landscaping requirements
shall be given for existing landscape materials in the bufferyard.
4. Leasing of vehicles shall be prohibited.
Staff Recommendation:
Staff recommends approval of Special Exception 14 -01, with the following conditions:
1. A maximum of eight (8) vehicles may be displayed in the parking lot at any one time.
2. All. outdoor displays and/or merchandise shall be taken indoors at the close of
business each day.
3. A minimum five (5) hoot wide landscape buffer shall be installed along the property's
frontage with N. Atlantic Avenue. The buffer shall be in conformance with Sec. 110 -
687(l)(a) and (b) of the City's Code. Credit towards the landscaping requirements
shall be given for existing landscape materials in the bufferyard.
4. Leasing of vehicles shall be prohibited.

320.01 Definitions, general
(42) "Low-speed vehicle" means any four-wheeled vehicle whose top speed is greater
than 20 miles per hour but not greater than 25 miles per hour, including, but not limited
to, neighborhood electric vehicles. Low'-speed vehicles must comply with the safety
standards in 49 C.F.R. s, 571.500 and s. 316.2122.
316.2,122, Operation of a low-speed vehicle or mini truck on certain roadways. —
The operation of a low-speed vehicle as defined in s. 320.01(42) or a mini truck as defined
in s, 320.01(45) on any road is authorized with the following restrictions:
(1) A I'low-speed vehicle or mini truck may be operated only on streets where the posted
speed limit is 35 miles per hour or less. This does not prohibit a low-speed vehicle or mini
truck from crossing a road or street at an intersection where the road or street has a posted
speed limit of more than 35' per hour.
(2) A low-speed vehicle must be equipped with headlamps, stop lamps, turn signal lamps,
tail lamps, reflex reflectors, parking brakes, rearview mirrors, windshields, seat beits, and
vehicle identification numbers.
(3) A low-speed vehicle or mini truck must be registered and insured in accordance with s.
320.02 and titled pursuant to chapter 319.
(4) Any person operating a low-speed vehicle or mini truck must have in his or her
possession a valid driver's l,icense.
(5) A county or municipality may prohibit the operation of low-speed vehicles or miini
trucks on any road under its jurisdiction if the governing body of the county or municipality
determines that such prohibition is necessary in the interest of safety.
(6) The Department of Transportation may prohibit the operation of (low-speed vehicles or
mini trucks on any road under its jurisdiction if it determines that such prohibition is
necessary iin the interest of safety.
316.212 Operation of golf carts on certain roadways.—The operation of a golf cart
upon the public roads or streets of this state is prohibited except as provided herein:
(1) A golf cart may be operated only upon a county road that has been designated by a
county, or a municipal street that has been designated by a municipality, for use by golf
carts. Prior to making such a designation, the responsible local governmental entity must
first determine that golf carts may safely travel on or cross the public road or street,
considering factors including the speed, volume, and character of motor vehicle traffic using
the road or street. Upon a determination that golf carts may be safely operated on a
designated road or street, the responsible governmental entity shall post appropriate: signs
to indicate that such operation is allowed,
(2) A golf cart may be operated on a part of the State Highway System only under the
following conditions:
(a) To cross a portion of the State Highway System which intersects a county road or
municipal street that has been designated for use by golf carts if the Department of
Transportation has reviewed and approved the location and design of the crossing and any
traffic control devices needed for safety purposes,
(b) To cross, at midblock, a part of the State Highway System where a golf course is
constructed on both sides of the highway if the Department of Transportation has reviewed
and approved the location and design of the crossing and any traffic control devices needed
for safety purposes.
(c) A golf cart may be operated on a state road that has been designated for transfer to a
local government unit pursuant to s. 335.0415 if the Department of Transportation
determines that the operation of a golf cart within the right-of-way of the road will snot
impede the safe and efficient flow of motor vehicular traffic. The department may authorize
the operation of golf carts on such a road if:
1. The road is the only avaflabie public road along which golf carts may travel or cross or
the road provides the safest travel route among alternative routes available; and
2. The speed, volume, and character of motor vehicular traffic using the road is considered
in making such a determination.
Upon its determination that golf carts may be operated on a given road, the department shalt post
appropriate signs on the road to indicate that such operation is allowed.
(3) Notwithstanding any other provision of this section, a golf cart may be operated for the
purpose of crossing a street or highway where a single mobile home park is located on both
sides of the street or highway and is divided by that street or highway, provided that the
governmental entity having original jurisdiction over such street or highway shall review and
approve the location of the crossing and require implementation of any traffic controls
need,ed for safety purposes, This subsection shall apply only to residents or guests of the
mobile home park. If notice is posted at the entrance and exit of any mobile home park
where residents of the park operate golf carts or electric vehicles within the confines of the
park, it is not necessary for the park to have a gate or other device at the entrance and exit
in order for such golf carts or electric vehicles to be lawfully operated in the park.
(4) Notwithstanding any other provision of this section, if authorized by the Division of
Recreation and Parks of the Department of Environmental Protection, a golf cart may be
operated on a road that is part of the State Park Road System if the posted speed limit is 35
miles per hour or less.
(5) A golf cart may be operated only during the hours between sunrise and sunset, unless
the responsible governmental entity has determined that a golf cart may be operated during
the hours between sunset and sunrise and the golf cart is equipped with headlights, brake
lights, turn signals, and a windshield.
(6) A golf cart must be equipped with efficient brakes, reliable steering apparatus, safe
tires, a rearview mirror, and red reflectorized warning devices in both the front and rear.
(7) A golf cart may not be operated on public roads or streets by any person under the age
of 14.
(8) A local governmental entity may enact an ordinance relating to,
(a) Golf cart operation and equipment which is more restrictive than those enumerated in
this section. Upon enactment of such ordinance, the local governmental entity shall post
appropriate signs or otherwise inform the residents that such an ordinance exists and that it
will be enforced within the local government's jurisdictional territory. An ordinance referred
to in this section, must apply only to an unlicensed driver.
(b) Golf cart operation on sidewalks adjacent to specific segments of municipal streets,
county roads, or state highways within the jurisdictional territory of the local governmental
entity if:
1. The local governmental entity determines, after considering the condition and current
use of the sidewalks, the character of the surrounding community, and the locations of
authorized golf cart crossings, that golf carts, bicycles, and pedestrians may safely share
the sidewalk;
2, . The local governmental entity consults with the Department of Transportation before
adopting the ordinance;
3. The ordinance restricts golf carts to a maximum speed of 15 miles per hour and permits
such use on sidewalks adjacent to state highways only if the sidewalks are at least 8 feet
wide;
4. The ordinance requires the golf carts to meet the equipment requirements in subsection
(6). However, the ordinance may require additional equipment, including horns or other
warning devices required by s. 316.271; and
5. The local governmental entity posts appropriate signs or otherwise informs residents
that the ordinance exists and applies to such sidewalks.
(9) A violation of this section is a noncriminal traffic infraction, punishable pursuant to
chapter 318 as a moving violation for infractions of subsections (1)-(5) or a local ordinance
corresponding thereto and enacted pursuant to subsection (8), or punishable pursuant to
chapter 318 as a nonmoving violation for infractions of subsection (6), subsection (7), or a
local ordinance corresponding thereto and enacted pursuant to subsection (8).

Dear Susan:
In reviewing this special exception request for 7077 N, Atlantic Avenue, we note the following:
I . The C-2 District is directed towards a mix of low density commercial and light
industrial. Special exceptions in this District do allow:
a. Sales of recreational equipment-, and
b. Vehicle rental facility.
I While an initial concern was that this exception to C-2 zoning is not adjacent to
any other C-2 area, the engineering criteria is very favorable.
1 Minimum structure sizes of 10,000 s.f is required in C-2 (See. 110-385). The
submitted application does meet this criteria as well as other setbacks, parking,
etc.
Based on the above, it is recommended that this special exception be approved.

criteria to the extent applicable:
1. Land Use and Zoning
a. Is the Special Exception consistent with the intent of the Comprehensive Plan?
Yes, the C-2 Commercial land use classification allows for a mix of low density
commercial and light industrial uses adjacent to major arterial streets pursuant to a
Special Exception.
b. Is the Special Exception consistent with the intent of the zoning district in which
it is sought?
Yes, given the surrounding area has developed in a commercial nature.
c. Will the Special Exception meet all the requirements of the zoning district in
which the request is to be located, such as: lot requirements, building setbacks,
lot coverage, height, buffers, off-street parking, signs, storage, landscaping, etc.?

a. Is the Special Exception compatible and harmonious with properties and uses in
the surrounding area? Explain why.
Yes, the surrounding area is developed in a commercial nature.

c. Will the traffic generated - volume and type - adversely impact land use activities
in the immediate vicinity?

property been developed as a principal use?

c. Will there be adequate screening, buffers, landscaping, open space, off-street
parking, other similar site improvements to mitigate any adverse impacts of the
Special Exception?

f. Will the size and shape of the site, the proposed access, internal circulation, and
design enhancements be adequate to accommodate the proposed scale and
intensity of the Special Exception requested?

g. Are signs and exterior lighting designed and located so as to promote traffic
safety and to minimize any undue glare or incompatibility with adjoining
properties?

h. What are the hours or operation and how will they impact surrounding
properties?

c. What type and how much traffic will the Special Exception generate?
Typical retail traffic.
d. Are there adequate loading and unloading areas?
Yes.

Worksheet
An applicant for a Special Exception is required to meet with the Planning Director prior
to completing and submitting the application. The following worksheet will be used to
evaluate the requested Special Exception.
A Special Exception is a use that would not be appropriate generally or without
restriction throughout the zoning district, but which, if controlled as to number, area,
location, etc. would be appropriate. A Special Exception will promote the public health,
safety morals, order, comfort, convenience, appearance, prosperity or general welfare
of the neighborhood community.
It is the applicant's responsibility to make a case for the requested special exception
and this worksheet is the criteria by which the Planning & Zoning Board will make its
recommendation and Board of Adjustment will make its determination.
Nature of Special Exception
Describe what you are proposing to do and why. Describe in writing and prepare site
plans, floor plans, architectural renderings, photos, etc. as necessary to fully describe
the Special Exception requested.
1. Is the proposed special exception compatible and harmonious with properties and
uses in the surrounding area? Explain why.

Our request is keeping with the current zoning district except it restricts the sale of motor
vehicles. We at Space Coast Electric Vehicles respectfully request to sell our non-polluting
vehicles at our current location.
In keeping with the tradition, of Cape Canaveral our company is leading the charge in the
production of no emission vehicles for use on the street and neighborhood with speed limits of
35 mph or less.
Our facility will not be an ordinary "CAR LOT" as you know it, but a small area inside and out
to display our standard and custom carts and scooters.
