The Regular Meeting of the Planning and Zoning Board was held
at.. 'J'Hall, 105 Polk Avenue on January 23, 19711• The meeting was

ITEM 1. Approval. of Minutes - ReRUlar 1•teetinp - December 19 1973
Minutes of the Regular Meeting of December 19, 1973 were unani-
mously approved, as submitted.
ITEM 2. COUNCIL REPORT - Mrs. Ann Thum
As Mrs. Thum was unable to attend the Regular Meeting of Jan -
uary 23, 1974, the Council Report was given by City Manager Francis.
Ordinance 49 -73 was passed as amended. The 90 day requirement for
answering board's recommendations was changed in word form but intent
is maintained.
ITEM 3. BUILDING OFFICIAL'S REPORT - MR. E.H. ALLEN
Mr. Allen gave his report and discussion ensued. Copies on hand.
OLD BUSINESS
ITEM 1. ZONING AND PLANNING REGULATIONS
Because of the nature of this item, Mr. Balough reported it
would be quite lengthy in content and presentation. Board was in
agreement to hold a special meeting of January 29, 1974 to review
the Zoning and Planning Regulations.
ITEM 2. C014PREHENSIVE PLAN (EMERGENCY TRANSPORTATION)
County planners to provide inputs on transportation at next
regular Planning and Zoning Board Meeting.
ITEM 3. MAPPED STREETS ACT - MR. W.E. STRANG
After Mr. Strangs report on Priority Number 1, ext. of Ridgewood
Avenue and connector road to Route 401 and at the request of Mr. Strang,
the Planning & Zoning Board voted unanimously to recommend that council

adopt and implement proceedures to finalize priority 1, the first part
of the Mapped Streets Act, to become a part of the transportation see-
tion of the city's comprehensive plan. Mr. Strang will prepare a report
on Priority 2 and present it at the Regular Meeting of March 6, 1974.
NEW BUSINESS
40 ITE14 1. DISCUSSION - SPECIAL BUILDING PROBLEMS
Multi- family complexes being built on Madison Avenue were having
parking problems conforming to the rules in the regulation book for
R -2. As only two members have actually seen the complexes, it was
decided by the Board for each member to visit the site at their
convenience and to bring this up at the Special Meeting of January
29, 1974.
ITEM 2. DISCUSSION AND RECOIMIENDATION RE: CANAVERAL TOWERS
• Mr. Pat McCarey presented the idea of taking out some of the
parking spaces for Canaveral Towers in order to build a tennis court
with the understanding that if any problems arise, they would be
glad to put back the parking. A bond issue will be researched by the
county planners. Mr. Balough will look into any necessary changes in Q
zoning. Motion was made by Mr. Moeller and seconded by Mr. Martin to

table the item and discuss it at their next regular meeting. Board's
vote was unanimous.
ADD ON ITEM - "HIDDEN HARBOR FINAL"
Motion was made by Mr. Moeller, seconded by Mr. Balough and un-
animous vote of the Board to put Hidden Harbor as an add on item on
the agenda.
The Hidden Harbor project was brought before the Board of Adjust- X

ment and aproved.nFinalizationtof this project met all of the Planning
and Zoning Board requirements. A recommendation was made by Mr. Moeller,
seconded by Mr. Allen, to pass this on to the Board of Adjustment.
A polled vote was taken with the following results: Mr. Balough -yes;
Mr. Moeller -yes; Mr. Allen -yes; Mr. Martin -yes; Mr. Van Wagner -yes.
Vote was 5 -Gin favor.
ADD ON ITEM - COUNTY PLANNER'S LAND USE PLAN REPORT
I-lotion was made by Mr. Balough, seconded by Mr. Allen and unan-
imous vote of the Board to put this Stem on the agenda.

Board requested an over -all comprehensive plan to estimate the
services that will be available from now through the next two -year
period, which will be, subject to review to see that it is correct.
Report will cover, among many other items, sewerage, volume of elec-

motion was made by Mr. Moeller, seconded by Mr. Allen and unanimous
vote of the Board to adjourn the meeting at 11:20 p.m.

The Regular Meeting of the Planning and Zoning Board was held
at City Hall, 105 Polk Avenue on February 6, 1974. The meeting
was called to order at 7:40 p.m, by Chairman Van Wagner.

ITEM 1. APPROVAL OF MINUTES - REGULAR MEETING - JANUARY 23, 1974
Under "Add On Item - 'Hidden Harbor Final "' insert after first
sentence, second paragraph, "Mr. Martin pointed out that building
setbacks from the streets do not meet required RPUD setbacks."
Under "Add On Item - County Planner's Land Use Plan Report," second
paragraph, last sentence will read "Estimated completion date July,
4974." Motion was made by Mr. Martin, seconded by Mr. Moeller, and
unanimous vote of the board to approve the minutes of the regular
meeting of January 23, 1974 with changes.
ITEM 2. APPROVAL OF MINUTES - SPECIAL MEETING - JANUARY 29, 1974
Under County Planning Department Mr. Hall'a name was deleted.
Secretary's name was Inserted. Motion was made by Mr. Martin,
seconded by Mr. Balough, and unanimous Vote of the Board to approve
the minutes of the special meeting of January 29, 1974 with changes.
ITEM 3. COUNCIL REPORT - MRS. ANN THURM
Amendment was passed which gets the length of time for building
permits was taken out of the zoning ordinance and put into the
Southern Standard Building Code. .Board members asked Mrs. Thum
about permits being tranaferrable, and she is looking into the matter.
ITEM 4. BUILDING OFFICIAL'S REPORT - MR. E.H. ALLEN
Mr. Allen was unable to attend the meeting but copies of his
report were provided for each member of the board. Copies on hand.

ITEM 1. REVIL14 - ZONING ORDINANCE 12 -71
Reference to parking in number 13 in ordinance is applicable
to non -RPUD structures only. Minimum Yard Requirements on Page 3'
of ordinance 72 -71; for Side Interior Lot shall now read " - -8 feet
.� or 10,% of width of lot, whichever is greater, up to 15 feet, plus
3 feet for each story above the first." Rear yard requirement shall
now read " - -20 feet, plus 3 feet for each story above the first."
NEW BUSINESS
ITEM 1. REVIEW - RPUD SECTION OF ZONING ORDINANCE
Mr. Balough gave his report on the rewrite of zoning ordinance
12 -71. It being a lengthy document with various changes after board
discussion, it was decided to incorporate Mr. Baloughts recommends -
tions with some changes, typed final copy for review at next regular
• meeting.
As there was no further discussion to come before the Board,
motion was made by Mr. Martin, seconded by Mr. Allen and unanimous
vote . of the Board to adjourn the meeting at 11:00 p.m.

was called to order at 7:40 p.m. by Chairman Van Wagner.

ITEM 1. APPROVAL OF MINUTES - REGULAR MEETING - FEBRUARY 6 7974
Under Item 3, Council Report, lot sentence, the word "gets"
was deleted and the word "removes" was inserted. Old Business,
Item 1, entire first sentence was deleted. First sentence now
reads "Planning and Zoning Board voted not to change the parking
regulations." Second sentence reads, with corrections, "Minimum
Yard Requirements, Section XII, R -2 of ordinance 12_71; for Side_
Interior Lot amended to read..." Last sentence with corrections,
shall now read, "Rear Yard Requirement was amended to read..."
In last paragraph of minutes, motion to adjourn was seconded by
Mr. Moeller. Mr. Martin motioned to approve the minutes ascor-
rected. Mr. Allen seconded the motion. Board wan unanimous.
ITEM 2. COUNCIL REPORT - MRS. ANN THURM
An Mrs. Thurm was unable to attend the meeting, Mr. Allen
presented the council report. Ordinance 4-74 passed with a alight
amendment of 3 -74, which put a time limit on extensions. Ordinance
osrpone�.
74 -5 on voter registration was passed. Bike path was -a1
Communicable rate increase was postponed. Planning and Zoning Board
was stymied trying to ascertain what the amendment was, as there
was no reference to any amendment, an obvious oversight by council
and others.

.Section VII, R -1, R -2, and R -3 were reviewed by the Board,
finalized, and voted for recommendation to city council.
ITEM 2. REVIEW - RPUD SECTION OR ZONING ORDINANCE
® The Board decided to .withhold action until RPUD is reviewed.
NEW BUSINESS
ITEM 1. SELECT AND SUBMIT ALTERNATE ZONING AND PLANNING BOARD
MEMBERS TO COUNCI
Board reaffirmed Mr. Wolever selection for recommendation
to city council as first alternate member. A polled vote was
taken with the following results: Mr. Martin -for; Mr. Moeller -for;
Mr. Balough -tor; Mr. Allen -for; Mr. Van Wagner -for. Mr. Hayes and
Mr. Peterman submitted their letters of recommendation to the board
which were reviewed. However, their not being present for interview,
selection for second alternate member was postponed until the next
regular meeting at which time both alternate members will be rec-
commended to city council.
As there was no further discussion to come before the Board,
motion was made by Mr. Martin; seconded by Mr. Moeller and unanimous
vote of the Board to adjourn the meeting at 10:30 p.m.

TO COUNCIL
Mrs. Joanne Bartoszek and Mr., Vernon Peterman were present at the
meeting for interview by the board after submitting their letters of
application. After review and discussion the Board took a polled vote
to select the 2nd alternate for the Planning and Zoning Board with the
• following results: Mr. Van Wagner: Peterman
'Mr. Martins Bartoszek
Mr. Moeller: Peterman
Mr. Balough: Peterman
Mr. Allen: Peterman
Vote was 4 -1 for Mr. Vernon Peterman to be 2nd alternate on the
Planning and Zoning Board. The rest of the applicants were listed in

City Council appointed George Wolever and Vernon Peterman as
first and second alternates of the Planning and Zoning Board. Off -
street parking and zoning regulations were referred back to the
Planning and Zoning Board for further discussion and recommendation.

March 20, 1974 were unanimously approved as submitted.
ITEM 2. COUNCIL REPORT - MRS ANN THURM
As councilwoman Ann Thurm was unable to attend the meeting, the
council report was given by City Manager Bert Francis. Council gave
approval to advertise the zoning ordinance in regard to ingress and
egress In the parking requirements.
ITEM 3. BUILDING OFFICIALS REPORT - MR.E.H. ALLEN
Mr. Allen gave file report and discussion ensued. Copies on hand.

ITEM 1. REVIEW - ZONING ORDINANCE 12 -71
Motion was made by Mr. Moeller and seconded by Mr. Allen to request
council for a decision as to how they Intend to review the ordinance.
Board's vote was unanimous.
NEW BUSINESS
ITEM 1. DISCUSSION - PROPOSED CHANGE INC -2 ZONE
C -1 and C -2 Zones were discussed and reviewed by the Board with the
following, changes made: Page 30, paragraph 1, Principal Uses and
2
Structures, item "1 ", "but not including automobile repairs" was deleted.
Also deleted in C-1, paragraph 1, item 1. C-2, paragraph 1, Principal
Uses and Structures, item "g" shall read "New and used automobiles, major
recreational equipment, mobile home sales or rentals, major automobile
repair garages with accessory services; ". Page 37, paragraph 1, item
® "g" (4) shall now read "There shall be no storage of junked or wreck
automobiles other then temporary storage which shall be In an enclosed
area and the vehicles shall not be visible from outside the property."
C -2, paragraph 4, page 38, Item "e" was deleted. Item "f" was changed
and should now read "drive -in theatres." Motion was made by Mr. Balough
and seconded by Mr. Nolever to have this item transferred Immediately
for consideration by council. Board's vote was 5 -0 In favor.
ITEM 2. DISCUSSION - SECTION VIII - RPUD FEES AND CHARGES
Item was tabled by Board for lack of information.
ITEM 3. REPORT - PUBLIC HEARING - MARCH 28, 1974 - He COASTAL CONSTRUCTION

Mr. Roy Moeller attended the public hearing of March 28, 1974 on
the coastal construction setback line with the following conclusions.
The proposed construction set back line to one hundred feet west of the
existing vegetation dune line. lie also reported that a variance could
be obtained with favorable results as most had been granted.

ITEM 11. BUDGET
The Planning and Zoning Board's budget was reviewed and discussed
with the Board and City Manager Bert Francis. Board's conclusion was that
there could be no cutbacks on the limited budget.
As there was no further discussion to came before the Board, motion
was made by Mr. Balough, seconded by Mr. Allen and unanimous vote of the
Board to adjourn the meeting at 11:30 P.m.

ITEM 1. SOUTHERN GULF HOMES - MR. JIM MAHONEY -
Mr. Mahoney came to the Board for recommendation on building,
aboat dock in the R -3 area for Southern Gulf Himes. This would
be a boat dock in a residential complex for residents of the complex
only. Item was discussed by the Board and it was determined that
this would be an acceptable use for the R -3 area. Board's . feeling
would be against a special exception.
ITEM 2. DISCUSSION - SECTION VIII - RPUD FEES AND CHARGES'
Motion was We by Mr. Balough that the amenPments to Section
VIII RPUD on Pages 59 ane 65 be aeopteA. In the event that it woule,..�
present a problem at some future Bate, the Beare would consiler'a
bone or escrow. Motion was seconeer? by Mr. Peterman an-- the vote was unanimous in favor of the adoption.
ADD -ON ITEM - Mr. Pat MCCereV - CANAVERAL TOWERS TENNIS COURTS.
Because putting tennis courts at Canaveral Towers would require
parking requirements,
a change in the / Mr. McCarey withdrew his request for reducing
parking.

was made by Mr. Balough that the amendments to Section VIII RPUD on
Pages 59 and 65 as presented by the city attorney Wolfman, be adopted."
Motion was made by Mr. Martin, seconded by Mr. Allen and unanimous vote
of the board to adopt the minutes of the regular meeting of P.pril 24,
1974 with changes.
ITEM 2. COUNCIL REPORT - MRS. LNN THURM
ordinances B-74 and 10 -74 were passed on the second reading.
ordinance 12 -74 amending ordinance 12 -71 regarding automobile repairs
in the C -1 and C -2 zones was passed on the first reading,. A resolution
was passed that no animals, leashed or otherwise shall be allowed on the
beach or in parks. An emergency ordinance was passed prohibiting liquor
at the ball park.

SUBJECT: Amendments to Chapter 380, Florida Statutes
Enclosed for your information is a summary of CS/House Bill 3767
which was recently passed by the Florida Legislature in their 1974
'session, amending Chapter 300, Florida Statutes. This law contains
several procedural revisions to the Developments of Regional Impact
review process, and a major substantive change regarding Areas of
Critical State Concern. Final copies of the law will be available
from the Secretary of State's office within several weeks. This
new law, along with the enclosed summary, should be read carefully
by your respective staffs, so that each of you will be fully prepared
to implement its provisions on July 1, 1974.
Additionally, regarding the revision of the Development of
Regional Impact - Application for Development Approval (ADA) form,
the current ADA form will continue to be used until further notice.

AMENDDSENTS TO CHAPT.?R 380, FLORIDA STATUTES '
ENACTED BY THE 1974 LEGISLATURE
(CS /HOUSE BILL 3767)
1. Paragraph (b) of §380.05(1), Florida Statutes, concerning areas of
critical state concern, is amended by granting discretionary authority
to the Administration Commission (the Governor and Cabinet) to apply
the principles for guiding development in an area of critical state
concern to any development undertaken subsequent to designation of
the critical area, but prior to the adoption of land development
regulations for the area. The economic impact of these principles
on development in process within an area must be considered by the
Administration Commission when adopting a rule under this provision,
and a state moratorium on development is specifically prohibited by
this amendment.
?. The vested rights provision of Section 380.06, Florida Statutes, has
been modified in two respects:
a. §380.06(4)(a) is amended to allow binding interpretations of
vested rights questions by the Division of State Planning on any
proposed DRI. Decisions by the Division of State Planning under
this provision will be binding on all state, regional, and local
agencies, as well as the developer.
b. The DRI vested rights provisions of §380.06(12), Florida Statutes,
have been modified to exempt from DRI review any development whose
subdivision plat was approved pursuant to local subdivision plat
laws, ordinances, or regulations, by a formal vote of a county d�
municipal governmental body having jurisdiction, after August 1,
1967, and prior to July 1, 1973. Additionally, the conveyance
or agreement to convey property as a prerequisite to zoning must
now be construed as an act of reliance for vested rights, if the
zoning change is actually granted for the development.
A major revision of Section 380.06(7), Florida Statutes, creates a
new statutory preapplication procedure prior to formal review of DRI's.
The procedure set forth in 5(7)(a) and (b) of Section 380.06, Florida
Statutes, as amended, is designed to facilitate an early determination
by the regional planning agency that a DRI application is ready for
review. Two key features toward this end are the establishment of
time benchmarks during the preapplication procedure, and the oppor-
tunity for the developer to decline in writing any requests for
additional information.
Under this new provision, a developer will initially submit the DRI
application to the local government and the regional planning agency
with jurisdiction, for a preapplication review. The Division of State
Planning will continue to receive the application only after the pre-
application procedure has been completed. .Upon receiving the applica-
tion, the local government cannot issue the notice of public hearing
on the DRI until it receives written notice from the regional planning
agency that the application contains sufficient information for the
regional impact review, or that any additional information requested
will not be supplied by the applicant.
When a DRI application does not contain sufficient information, the
regional planning agency must request any required additional infor-
mation within 15 working days of receiving the application. If the
applicant intends to provide the additional information, a written
statement of his intention to do so must be communicated to the
regional planning agency and the local government within 5 working
days of receiving the request for more information. The additional
information requested will then be collected and submitted to the
regional planning agency and the local government. Alternatively,
if the applicant decides not to provide some or all of the additional
information that has been requested, the applicant must notify the
0 regional planning agency and the local government in.writing that
the requested information will not be provided—In this case, the
required written notice would then be issued by the regional planning
agency to the local government, indicating that the application is
ready for formal review.
Once the preapplication procedure has been completed (i.e., the
regional planning agency provides written notice that the application
contains sufficient information, or that any additional information
requested will not be supplied by the applicant), the local government
must set a public hearing date on the DRI application at their next
scheduled meeting following receipt of the written notice from the
regional planning agency. The formal DRI review then proceeds.
4. In Section 380.06(7) and (8), Florida Statutes, the formal DRI review
time has been extended to 50 days, with an additional 10 day3provided
® to allow time for local governments and developers to review the report
and recommendations of the regional planning agency prior to the DRI
public hearing.
5. In Section 380.06M, local governments are now required to render a
decision on a DRI application within 30 days after the DRI public
hearing, unless an extension of time is requested by the developer.
6. A new subsection (f) is added to Section 380.06(7), Florida Statutes,
allowing local governments, at the request of the developer, to hold
a joint public hearing on a DRI that is proposed within the juris-
diction of more than one local government.
7. A new subsection (13) is added to Section 380.06, Florida Statutes,
allowing developers to file a comprehensive DRI application when a
particular development includes two or more separate DRI's.
8. An enforcement section is added, Section 380.11, Florida Statutes, .
granting injunctive relief powers (both temporary and permanent) to
the Division of State Planning, state attorneys, and all counties and
municipalities to enforce Chapter 380, Florida Statutes, and any rules,
regulations, or orders issued thereunder.
9. The effective date of this law is July 1, 1974.

Any person or persons, jointly or severally, aggrieved by any
decision of the Board of Adjustment, or any taxpayer, or any officer,

may present to a circuit court a petition for issuance of a Brit of Cer-
tiorari, duly verified, setting forth that such decision is illegal,
in whole or in part, specifying the grounds of the illegality in the-
manner and within the time provided by the Florida Appellate rules.
XCII. DUTIES OF BUILDING OFFICIAL. BOARD OF ADJUSTMENT. CITY COUNCI
ON MATTERS OF APPEAL
It is the intent of this ordinance that all questions of inter -
pretationand enforcement shall be first presented to the Building
Official, and that such questions shall be presented to the Board
of Adjustment only on appeal from the decision of the Building
Official, and that recourse from the decisions of the Board
of Adjustment shall be to the courts as provided by law and par -
ticularly by Chapter 176, Florida Statutes. It is further the
intent of this ordinance that the duties of the City Council Fn
connection with this ordinance shall not .include hearing and
deciding questions of interpretation and enforcement that may
arise. The procedure for deciding such questions shall be as
stated fin this section and this ordinance. Under this ordinance
the City Council shall have only the duties (1) of considering
and adopting or rejecting proposed amendments or the repeal
of this ordinance, as provided by law, and (�) of establishing
a schedule of fees and charges

the regulations, restrictions :end boundaries set forth in this ordi-
nance may, from time to time, be arwndod, supplemented, changed or
repealed in the manner prescribed by 'law.
1. .procedure
a. A district boundary . change may be initiated by (1) the
owner or owners of at least seventy-rive percent of
the property described in the application; (Z) tenant
or toiants, with owners' sworn -to consent; (3) duly
authorized agents evidenced by a written power of
attorney; (4) City Council; (5) Zoning and Planning
Board; (6) any Department or Agency of the City.
.Any amendment to this ordinance other than a district
boundary change may be proposed by (1) City Council;
(Z) Zoning and planning Board; (3) any Department
or Agency or the City; (4) any individual, corporation
or agency.
b. All proposed amendments shall be submitted to the Zoning
and Planning Board for Study and recommendations. the
Zoning and Planning board shall study such proposals to
determine: (1) the need and justification for the change;
(Z) when pertaining; to the rezoning of land, Ole effect
of the change, if any, on the particular property and on
surrounding properties; (3) when pertaining to the rezoning
of land, the amount of undeveloped land in the general area
and in the City having the sane classification as that
requested; and (4) the relationship of the .proposed
:uacndment to the purpose of the City's plan for develop-
ment, with appropriate consideration as to whether the
proposed change will further the purposcs of this ordi-
nance and the plan.
C. 'Pile Zoning and Planning Board shall submit the request
for change or ;amendment to the City Council with written
reasons for its recomiaondation.
d. No recommendatioh for change or amendment may he considered
by the City Council until due public notice has hoen given

as maintained by the assessor of taxes for the juris-
diction proposing the change and be postmarked no later
than ten (10) days prior to the first scheduled hearing
concerning the proposed change. 'file notice shall contain
tite legal description of the affected property, .tile existing
zoning Classification, the proposed zoning classification,
and the time and place of any scheduled hearing concerning
the proposed zoning change. prior to the effective date
Of any zoning classification change, the City Council shall
cause an affidavit to be filed with the City Clerk certifying
that said Council has cotnplicd' with the provisions of this
section. The filing of said affidavit shall he prima facie
proof of compliance with the requirements of this Section.
A failure to give npti._e shall not affect the validity of
zoning except as to the property of the complaining owner.

would not be proper to put in the zoning ordinance
2) Amendment to ordinance 53 -73 relative to Qualifications of persons

Motion was made by Mr. Van Wagner, seconded by Mr. Martin and unanimous
vote of the Board to include this item on the agenda. Codification of the
zoning regulations book was reviewed.

ITEM 1. RECONLMENDATION RE: APPOINTMENT OF TWO ZONING BOARD MEMBERS
Motion was made by Mr. Moeller and seconded by Mr. Balough for
incumbents Van Wagner and Allen to be reappointed to the Planning and
Zoning Board. A polled vote was taken with the following results:

1) At the .meeting of September 3, 19711, the
Council voted to change the bar-closing
hours to 4:00 am. I feel this would take
care of the problem of bottle and /or private
clubs as they would have to close at that
time also.
2) Re: two memds from Frank Martin which were
discussed with City Attorney and Council
at workshop meeting - Unofficial conclusion
was -

THE CASE OF BEER SALES AT PAPA SOL'S WOULD NOT BE LEGALLY. IN ACCORDANCE
WITH THE ORDINANCE SECTION 12, PARAGRAPH 20, SUB- PARAGRAPH b, PAGE 110
OF SUBJECT, ZONING ORDINANCE. IT IS REQUESTED THAT THE CITY ATTORNEY
.GIVE HIS OPINION ON THIS CASE IN WRITING TO THE BOARD SPECIFYING THE
REASONS. FOR ANY DISAGREEMENT. IN THE EVENT THAT THE ATTORNEY FEELS AN

A RESOLUTION DECLARING A MORATORIUM ON ISSUANCE
OF BUILDING PERMITS FOR CONSTRUCTION ON PROPERTY
FRONTING THE ATLANTIC COASTLINE WITiiIN I TIE CITY
OF CAPE CANAVERAL, FLORIDA; PROVIDING AN EFFECT -
IVE DATE.
• WHEREAS, the Cabinet of the State of Florida has postponed the
establishment of a Coastal Construction Setback Line for Brevard County,
Florida; and
WHEREAS, the Department of Natural Resources has requested
that the City declare a moratorium on coastal construction until the set-
back line Is established; and
WHEREAS, the City Council of the City of Cape Canaveral,"
Florida, deems it In the public interest to declare such a moratorium;
NOW, THEREFORE, BE IT RESOLVED BY THE CiTY COUNCIL
OF THE CITY OF CAPE CANAVERAL, FLORIDA, AS FOLLOWS:
SECTION 1. A moratorium is hereby declared on the issuance of
building permits for construction projects on property fronting the Atlantic
eastward of the proposed coastal construction setback line
Coastline/within the City of Cape Canaveral, Florida.
SECTION 2. This moratorium shall be to full force and effect
until the Cabinet of the State of Florida establishes a coastal construction
setback line.
SECTION 3. This Resolution shall become effective immediately
upon Its adoption by the City of Cape Canaveral, Florida.
ADOPTED by the City Council of the City of Cape Canaveral,
