RESOLUTION NO. 86 -19
A RESOLUTION AUTHORIZING THE CITY OF CAPE
CANAVERAL, FLORIDA, TO ENTER INTO AN
AGREEMENT WITH THE BOARD OF COUNTY
COMMISSIONERS OF BREVARD COUNTY, FLORIDA,
TO INSTALL A TRAFFIC SIGNAL AT THE INTER-
SECTION OF NORTH ATLANTIC AVENUE AND
CENTRAL BOULEVARD IN THE CITY OF CAPE
CANAVERAL, FLORIDA; PROVIDING AN EFFECTIVE
DATE.
BE IT RESOLVED by the City Council of the City of
Cape Canaveral, Florida, as follows:
SECTION 1. The Mayor and City Clerk are hereby
authorized to execute an agreement with the Board of
County Commissioners of Brevard County, Florida, to in-
stall a traffic signal at the intersection of North
Atlantic Avenue and Central Boulevard in the City of
Cape Canaveral, Florida; a copy of said agreement being
attached hereto and made a part hereof by reference.
SECTION 2. This Resolution shall become effective
immediately upon its adoption.

TRAFFIC SIGNALIZATION AGREEMENT
AGREEMENT made and entered into this 29th day of _April
1966, by and between the CITY OF CAPE CANAVERAL, a municipal
corporation existing under the laws Of the State of Florida, herein-
after referred to as "City',. and THE BOARD OF COUNTY, COMMISSIONERS OF
RREVARD COUNTY, FLORIDA, a political subdivision of the State of
Florida, hereinafter referred to as "County ".
W IT N E S E T Ht.
WHEREAS, both the City and County have determined that it is
desirable to construct a traffic signal at the intersection of North
Atlantic Avenue and Central Avenues and
WHEREAS,' the signal will be located on a county- maintained road-
way and constructed by Brevard County, but will also benefit the City
in controlling traffic at the intersections and
WHEREAS, the City has agreed to contribute to the County total
cost of construction of said signal.
NOW, THEREFORE, in consideration of the covenants herein
contained, it is mutually agreed between the parties as follows
11 The County agrees . that it will construct or cause to be
constructed a' traffic signal at the intersection of North Atlantic
Avenue and Central Avenue, the signal to be constructed shall be a
four -phase controller, in a'four- phase cabinet.,
2. The County will be totally 'responsible for construction,
liability insurance, operation and maintenance of the signal.
3. The City 'agrees that it will pay to the County, upon
demand, the total cost of construction and installation of the above
described traffic signal.
4. The 'County agrees that it will provide adequate signal
timing that will be conducive to all intersection approaches using
appropriate, acceptable, traffic, engineering standards.
5. The County . agrees that it Will cause the installation of
the signal as soon as .practicable, but, in no event, longer than
ninety (90) days after receipt'pf said equipment.
