RESOLUTION NO. 86 -6 A RESOLUTION APPROVING THE PLAT OF "HARBOR HEIGHTS TOWNHOUSES "; AUTHORIZING THE MAYOR AND CITY CLERK TO CERTIFY THE PLAT; PROVID- ING AN EFFECTIVE DATE. WHEREAS, Louie C. Human has complied with the platting provisions of the City ordinances of the City of Cape Canaveral, Florida, for "Harbor Heights Townhouses ". NOW, THEREFORE, BE IT RESOLVED BY the City Council of the City of Cape Canaveral, Florida, as follows: SECTION 1. The plat for "Harbor Heights Townhouses" is hereby approved. SECTION 2. Said plat approval is contingent upon the Maintenance Agreement which is attached hereto and made a part hereof being fully executed. SECTION 3. The Mayor and City Clerk are hereby authorized to execute said plat. SECTION 4. This Resolution shall become effective immediately upon its adoption. Fdrm; C or 1 MAINTENANCE AGREEMENT THIS .AGREEMENT made by and between CHRIS CAMPIONE and MARY CAMPIONE, his wife, and the CITY OF CAPE CANAVERAL, a Florida Municipal Corporation, on this day of February, 1986. W I T N E S S E T No WHEREAS, the City of Cape Canaveral is the owner and holder of a twenty -four (24) foot wide easement for ingress and agrees as described in Official Records Book 2575, Page 2265, Public Records of erevard County. Florida, and WHEREAS, the twenty -four (24) foot easement in favor of the City of Cape Canaveral is encompassed within the thirty -four (34) foot easement located on the southeastern portion of the Plat of HARBOR HEIGHTS TOWNHOUSES, and .WHEREAS,. the parties hereto ,wish to clarify, their respective maintenance obligations and rights concerning.. the thirty -four (34) foot easement shown on the Plat of HARBOR HEIGHTS TOWNHOUSES. NOW, THEREFORE, for good and valuable consideration and in consideration of the mutual covenants herein, the parties hereto agree as followsi' 1. That CHRIS CAHPIONE and MARY CAMPIONE, his wife, and their successors and assigns, the owners of Lot 5, in HARBOR HEIGHTS TOWNHOUSES, as recorded in Plat Book , Page , Public Records of Brevard County, Florida, do hereby agree to be solely responsible for the maintenance of the entire easement thirty -four (34) foot wide shown on the 'Plat of HARBOR HEIGHTS TOWNHOUSES, including the twenty -four (24) foot easement owned and held by the City of Cape Canaveral.' 2.
